Dear Mr. Bontje:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., June 18, 2008 regarding the above matter:
WHEREAS, B. Laing Associates, Inc. on behalf of GEORGE BALDWIN applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated May 12, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be

WHEREAS, the Board of Trustees has furthered Policies 6.3, 4.1, 4.2, of the Local
Waterfront Revitalization Program to the greatest extent practical through the imposition
of the following Best Management Practice requirements: the installation of a 10' non-
turf buffer along the landward side of the bulkhead, and,

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 18, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of GEORGE BALDWIN
to install 8' of bulkhead on each landward end of the existing bulkhead above AMHW;
place 24 If. of gabion baskets landward of AMHW to provide shoreline stabilization, with
the condition of a 10' non-turf buffer along the landward side of the bulkhead, and as
depicted on the plans prepared by B. Laing Associates, Inc. last dated July 21, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with the LWRP policy standards and therefore is
INCONSISTENT with the LWRP.
The proposed action to install 8' of new bulkhead on each landward end of the existinl!
bulkhead is not in compliance with & 275-11 and therefore is inconsistent with L WRP sub-
policy 6.3
~ 275-11 Construction and operation standards
B. Shoreline structures. The follOWing standards are required for all operations relating to
shoreline structures on residential properties.
(1) Bulkheads. retaining walls. revetments and gabions.
(a) Only in-place replacement of existing functional bulkheads (as defined in 3 275-2) is
permitted.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
1. Use vegetative non-structural measures to manage erosion such as Bio-Log
vegetative design.
2. Require the applicant to maximize a perpetual, non-turf huffer landward of the
existing bulkhead.
BMP #1 will further SUb-DOlicv 4.1 and 4.2 as outIioed below.

recommend the use of non-structural ve!!etative erosion control measures such as Bio-Lo!!

4.1 Minimize losses of human life and structures from flooding and erosion hazards.
B. Use vegetative non-structural measures to manage flooding and erosion hazards.
1. Use vegetative non-structural measures which have a reasonable
probability of managingflooding and erosion, based on shoreline
characteristics including exposure, geometry, and sediment composition.
2~Use vegetative measures to increase protective capabilities of natural
protective features. Discourage clearing of existing, particularly indigenous vegetation
during siting, design, construction and regrading phases of any

BMP #2 will further SUb-DOlicv 6.3 D. E. and F as outlined below.
6.3 Protect and restore tidal and freshwater wetlands.
In addition to protecting and improving the Town's wetlands, adjacent lands that provide
buffers to wetlands must be maintained and enhanced, and where appropriate, reestablished.
These buffers are necessary to ensure the long term viability of the Town's wetlands. Where these
lands are in private ownership, educating residential owners as to the long-term benefits of
compatible land use and landscaping techniques will be essential to maintaining the ecological
health of wetland areas.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and
activities in order to ensure protection of the wetland's character, quality, values, and junctions.
The adequacy of the buffer depends on the followingfactor:
4. Buffer width necessary to achieve a high particulate filtration efficiency
of surface runoff as detelfed by vegetative cover type, soil charactWcs, and slope of land.
E. Maintain buffers to ensure that adverse effects of adjacent or nearby
development are avoided:
I. Maintain buffers to achieve a high filtration efficiency of surface runoff.
F. Restore tidal wetlands and freshwater wetlands, wherever practical, to foster
their continued existence as natural systems by:
4. protecting lands adjacent to wetlands from alterations so as to maximize
natural buffers to wetlands.
Pursuant to 6 268-5 (I[) Waterfront Consistency Review. if the al!encv (Trustee's) makes a
contrary determination of consistency. the al!encv shall resDond in writinl!. describinl! the
manner and extent to which the action is consistent with the L WRP.
~ 268-5. Review of actions
H. In the event the LWRP Coordinator's recommendation is that the action is inconsistent
with the L WRP, and the agency makes a contrary determination of consistency, the agency shall
elaborate in writing the basis for its disagreement with the recommendation and state the manner
and extent to which the action is consistent with the L WRP policy standards.

A. INSTRUCTIONS
1. All applicants for permits" including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. "Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the L WRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.

Proposed Bulkhead Extension and Gabion Basket Installation
Dear Southold Town Board of Trustees:
B. Laing Associates, Inc. is the environmental consultant firm working with Mr.
George Baldwin on obtaining the necessary permits to install a landward bulkhead
extension and placement of gabion baskets landward of the apparent mean high water
line. The subject property is located on 1045 Island View Lane in Greenport. It is
bounded on the east and west by residential properties and the Conklin Point Bay behind
Shelter Island Sound (north) on the southeast. The property is identified on the Tax Map
as District 1000, Section 57, Block 02 and Lot 21. The purpose of the bulkhead and
gabion basket installation is to provide shoreline and adjacent upland stabilization. The
subject property recently obtained a Board of Trustees wetland permit (#6298) for
dredging. A similar tidal wetland permit for dredging was issued to neighboring
properties.
The proposed bulkhead extension would include the addition of 8 feet on each
end of the existing bulkhead (16 feet in total) located on the southeast portion of the
property. The purpose of this installation is to stabilize the adjacent upland area and
prevent further upland eroding. The bulkhead extensions will be placed landward of the
existing structure in the Town's and New York State Department of Environmental
Conservation (NYSDEC) tidal wetland adjacent area. The installation will also include a
tieback system. The purposed bulkhead extensions have been staked out on-site.
In addition to the bulkhead extensions, the applicant is proposing to place 24
linear feet of gabion baskets landward of the apparent mean high water line. The
purposes of the gabion baskets are to stabilize the shoreline and prevent further erosion.
They will also help in filtering any stormwater runoff from the adjacent area. The
attached photographs depict the current eroding state of the shoreline. The area of gabion

basket placement will be dredged about 18 inches to provide an even grade with the
upland area. The dredged material will be re-used to backfill the proposed bulkhead
extensions. Typical gabion baskets will be 3-foot length by 3-foot depth by 3-foot in
height. The middle 6 feet of gabion baskets will be 3-foot length by 3-foot depth by 1.5-
feet in height. This area will be kept at a lower elevation as it will provide boating access
for loading. Further, a wooden deck approximately 6-feet by 3-feet is proposed to cap
the lower gabion area to prevent damage from boats crossing over. The area of gabion
baskets has been stalked out on-site.
The proposed bulkhead and gabion baskets will not impact the tidal wetland area.
The structures are proposed landward of the apparent mean high water line. Erosion
control measures will be erected during construction to filter any stormwater runoff from
entering the water body.
At this time, we are submitting an application for the proposed bulkhead
extension and placement of 24 linear feet of gabion baskets. Additional applications are
also being submitted to the NYSDEC and the New York State Department of State,
Division of Coastal Resources.
