Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., August 20, 2008 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of MO AHMADZADEH
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance, and Chapter 111 of the Southold
Town Code, Coastal Erosion Hazard Areas, applications dated July 3, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 20, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 and
Chapter 111 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of MO AHMADZADEH
to reconstruct the existing decking totaling 1,330 sf., a 192 sf. deck addition, and a 172'
sf. deck addition, and as depicted on the survey prepared by John T. Metzger dated
June 5, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town
Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided
on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the SouthoM Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The reconstruction and addition to the existing deck is a nonmaior addition to the existing structure and is
allowed in the primary dune area pursuant to § 111-13.
§ 111-13. Dune area.
Dunes prevent overtopping and store sand for coastal processes. High, vegetated dunes provide a greater degree of
protection than low, unvegetated ones. Dunes are of the greatest protective value during conditions of storm-induced high
water. Because dunes often protect some of the most biologically productive areas as well as developed coastal areas,
their protective value is especially great. The key to maintaining a stable dune system is the establishment and
maintenance of beachgrass or other vegetation on the dunes and assurance of a supply of nourishment sand to the dunes.
A. In primary dune areas:
(5) Nonmajor additions to existing structures are allowed on primary dunes pursuant to a coastal erosion
management permit and subject to permit conditions concerning the location, design and potential impacts of the
structure on the primary dune.
If the action is approved the following best management practice (BMP) is recommended:
1) Avoid disturbances to native dune vegetation such as beachgrass which provide stabilization to the natural
protective features of the Primary Dune.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.
