Project Description: Maintenance trim the existing vegetation along the top of
the bluff within the central section of the property.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
survey prepared by John C. Ehlers Land Surveyor, last dated May 20, 2008, and
received on May 22,2008.
Special Conditions: None.
Inspections: Final inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the South old Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

Dear Mr. King,
This Firm represents L1loyd Kaplan in connection with the property
referenced above. Two months ago, Mr. Kaplan was cited with a violation of the
Town's Wetland Ordinance for trimming vegetation at the top of the bluff. That
enforcement matter was settled in Justice Court. I was advised that an
administrative wetland permit would be required in order to maintain by trimming
the bushes at the top of the bluff. An administrative Wetland Permit was filed
with your Board on May 9, 2008. Subsequently, I received a request from Mrs.
Standish to add the Coastal Erosion Hazard Line onto the survey and to expand
the application to include an LWRP Analysis with accompanying application fee
of $250.00. I assume that there would be another public hearing for the
amended application because of the Coastal Erosion Hazard Law jurisdiction
noticed in the usual way.
Enclosed herewith please find a revised survey prepared by John C
Ehlers last dated May 20, 2008 showing the Coastal Erosion Hazard Line and
also showing the area where bushes would be trimmed.
I have reviewed ~111 of the Town Code, COASTAL ERIOSION
HARZARD AREAS and note that at ~111-6, REGULA TED ACTIV/TIY is defined
as follows:
The construction, modification, restomtion, or placement of a structure, or
major addition to a structU18, or any action or use of land which materially
altelS the concJition of the land including grading, excavating, dumping,
mining dtedging, fining or other disturbance of soil.

I note that the trimming of bushes does not fit within the definition of
REGULA TED ACTIVITY.
~111-6 defines UNREGULA TED ACTIVITY as follows:
Excepted activities which am not regulated by this chapter include but
are not limited to elevated walkways or stairways constructed solely for
pedestrian use and built by an individual property owner for the limited
purposes of providing noncommercial access to the beach; clocks, piers,
whaNes or structures built on floats, columns, open timber piles or other
similar open worl< suppotts with a top sutface ama of less than 200 squam
feet or for which am removed in the faD of each year; normal beach
grooming or cleanup; maintenance of structums when normal and
customal}' ancVor In compliance with an approved maintenance program;
planting vegetation and send fencing so as to stabilize or entrap sand in
primal}' dune and secondary dune amas in order to maintain or increase
the height of dunes; routine agricuItut8I operations, Including cultivating or
harvesting; and the implementation of practices recommended in a soil
and water conservation plan as defined in 9 3, Subsection (12), of the Soil
and Water Conservation Districts LaW; provided, however, that agricultural
operations and implementation of practices will not be construed to
include any activity that involves the construction or placement of a
structum.
I note that the trimming of bushes is akin to UNREGULA TED ACTIVITY
particular1y because the activities described are broad and Include but ate not
limited to a potpourri of "soft" activities which should logically include the
trimming of bushes.
Please give this analysis some thought and let me know whether or not
the trimming of bushes should be subject to the Town's Coastal Erosion Hazard
Law. I would greaUy appreciate that this matter be resolved no later than your
regular meeting of June, 2008.

along the top of bluff Consequently, attached please find a completed Wetlands Application
reflecting this project. Application contents are as follows:
(1) Town of South old Trustees Wetlands Permit Application (original and two [2J
copies);
(2) Short Environmental Assessment Form (original and two [2J copies);
(,'I) Location Map (three [sJ copies);
(4) Survey prepared by JOHN C. EHLERS, L.S., last dated January 28, 2008, indicating
the current conditions thereon (as well as our previous proposal to construct a
swimming pool, patio, fencing. pool equipment and drywell thereon), including
annotation of the area of proposed maintenance trimming, as per this office (three [SJ
sets); and
(5) Check made payable to the Town of South old to cover the requisite application fee.
