SHALL BE CONSIDERED A VIOLATION AND POSSIBLE REVOCATION OF THE

TERMS AND CONDITIONS
The Permittee Martin Schwartz. residing at 1950 9th Street. GreenDort. New York 11944 as part
of the consideration for the issuance of the Permit does understand and prescribe to the
following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion ofthe Board of
Trustees of the Town of South old.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Pennit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, August 20, 2008 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp., on behalf of MARTIN SCHWARTZ
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated July 2, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 4 & 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: changing the proposed retaining
wall to a single 1-2 ton rock revetment, maintaining the 10' wide non-turf buffer area
landward of the revetment, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 20, 2008, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board ofTrustees approve the application of MARTIN
SCHWARTZ to construct 120'+/- of single 1-2 ton rock revetment, backfill areas behind
revetment and re-grade as needed, construct a 3' wide access stairway to beach,
maintain 10' wide non-turf buffer area landward of revetment, re-vegetate any disturbed
areas with Cape American Beach Grass, with the condition that the 10' non-turf buffer
area be maintained, and as depicted on the site plan prepared by Costello Marine
Contracting Corp., last dated August 15, 2008, and received on August 20, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Conservation Advisory Council

At the meeting of the Southold Town Conservation Advisory Council held Wed., August
13, 2008, the following recommendation was made:
Moved by Jack McGreevy, seconded by Doug Hardy, it was
RESOLVED to NOT SUPPORT the Wetland Permit application of MARTIN SCHWARTZ
to construct 126' of new retaining wall using "C-Loc" vinyl sheathing. Construct new 3'
wide stairway to beach. Regrade area behind new wall with clean trucked-in sand approx.
85 cy., and re-vegetate the disturbed areas.

Inspected by: Jack McGreevy
The project was not staked, however, the CAC does Not Support additional hardening of
the shoreline.

Wetland Permit for MARTIN SCHWARTZ
SCTM#49-1-24
Costello Marine Contracting Corp. on behalf of MARTIN SCHWARTZ requests a Wetland Permit to construct 126' of new
retaining wall using "C-Loc" vinyl sheathing. Construct new 3' wide stairway to beach. Regrade area behind new wall with clean
trucked-in sand approx. 85 cy., and re-vegetate the disturbed areas. Located: 1950 9th St., Greenport. SCTM#49-1-24
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of South old Town Code and
the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records available to me, it is our recommendation that
the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP.
The applicant has not demonstrated that the erosion wonld warrant the hardenin!! of the shoreline. Durin!! a field visit to
site of the proposed bulkhead. the onlv evidence of erosion was identified at the westerlv corner of the property were
scourin!! has occurred due to the placement of the uei!!hbors bulkhead. Further. the proposed action is not consistent
with the Town Goals as exemplified in the LWRP: the Peconic Estuarv Pro!!ram adopted a "no net increase" policv.

6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southo/d Town Board of Trustees laws and regulations for all
Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
New bulkheads on the bay are prohibited pursuant to & 275-11 Construction and operation standards.
B. Shoreline structures. The following standards are required for all operations relating to shoreline structures on residential
properties. Operations conducted on properties zoned MI or M2 may be given greater flexibility in these requirements given the
water-dependent nature of their use. [Amended 10-11-2005 by L.L. No. 17-2005]

(h) New bulkheads in creeks and bays are prohibited, unless the operation involves construction of a low-sill
bulkhead.
Before a permit is !!ranted for anv erosion control structure. the applicant must demonstrate the purpose. fupction. and
impact of the proposed action. Alternatives to the proiect must be carefullv evaluated to determine whether the structure
is necessarv and whether adverse impacts can be avoided or minimized. The natural shoreline has an inherent natural.
social. and economic value that should be respected to ensure continuin!! benefits to the town. re!!ion and state.
While some erosion control structures are necessarv to protect development. there are manv erosion control structures
located alon!! the shoreline of the Town of Southold that are not necessarv for erosion protection. Erosion control
structures can be both beneficial and detrimental. While thev mav protect the immediate land behind the structure. thev
often contribute to erosion both on and off the site due to poor desi!!u and sitiu!! and lack of downdrift remediation of
sand. Poor desi!!n and sitin!! has resulted in accelerated erosion. aesthetic impairments. loss of public recreational
resources. loss of valuable maripe and wetland habitats. and water qualitv de!!radation. The cumulative impact of these
structures can be lar!!e in area and si!!nificant in impact.
Hardenin!! of the shoreline is to be avoided except when alternative means. such as soft en!!ineerin!! alternatives are not
effective. Beach reve!!etation is a preferred approach to control erosion because of lower cost and fewer environmental
impacts thau hard structures.
The use of uon-structural erosion control measures in restorin!! the natural protective features of the shoreline which
have a reasonable probabilitv of mana!!in!! erosion are recommended.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
B. Use vegetative non-structural measures to manage flooding and erosion hazards.
I. Use vef!etative non-structural measures which have a reasonable probability of managing flooding and erosion,
based on shoreline characteristics including exposure, geometry, and sediment composition.
The use of ve!!etative non-structural measures will further advance L WRP sub-policv 4.2 bv maximizin!! the protective
capabilities of the natural protective features of the shoreline as outliped below:
4.2 Protect and restore natural protective featnres.
B. Maximize the protective capabilities of natural protective features by:
1. avoiding alteration or interference with shorelines in a natural condition
2. enhancing existing natural protective features
3. restoring the condition of impaired natural protective features wherever practical
4. using practical vegetative approaches to stabilize natural shoreline features
C. Minimize interference with natural coastal processes by:
1. providing for natural supply and movement of unconsolidated materials andfor water and wind transport
D. Use hard structural erosion protection measures for control of erosion only where:
2. Vegetative approaches to controlling erosion are not effective.
3. Enhancement of natural protective features would not prove practical in providing erosion protection.
4. Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use.
7. Adequate mitigation is provided w*intained to ensure that there is no adver.' npact 10 adjacent property or to natural
'coastal processes and natural resour IIId, if undertaken by a pril'ale property G r, does not incur significant direct or
indirect public costs.

DEVELOPED COAST POLICIES
Policy 1 Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a mastallocation, and minimizes adverse effects of development.
Our proposal will be consistent with the surrounding properties. Both adjacent properties are
bulkheaded. The proposal will have no impact on open space or compromise the infrastructure of
the Town of Southold.

NATURAL COAST POLICIES

The proposed retaining wall is an effort to control the erosion on this property. The two adjacent
properties are bulkheaded allowing the project area vulnerable to scouring. The wall will aid in
preventing further erosion of this property. The structure is approximately 15' landward of the high
water mark so it does not impede onto public lands.
