second part, does hereby grant and release unto the party of the second pall, the heirs or successors and assigns
of the party of the second part larever,
ALL Iha1 certain plot, piece or parcel of land, situa1e, lying and being at Fishers Island, TDWIl of Southold, County
of Suffolk and State of New York, being a 12-foot- wide right-of-way lying between Lots 48 and 47 and Lots 48
and 49 as shown on a certain map, entitled "Plan of Peninsula at Fishers Island DWIled by Chartes W. Hedge and
Frances G. Thorp, made by Chandler & Palmer, Engineers, Norwich, Connecticut, 1913", and filed in the Office
of the Clerk of the County of Suffolk on March 1t, 1913, File No. 223.
BEING AND INTENDED TO BE a portion of the same premises conveyed 10 the said Elbert W. Burr, deceased,
by deed, dafed February 18, 1964 and recorded in the Office of the Suffolk County Clerk on February 26, 1984
in Liber 5505 page 260.

TOGETHER with all right, title and interest, if any, of the party of the first part, in and 10 any streets and roads
abutting the above described premises 10 the center lines thereof: TOGETHER with the appurtenances, and also
aU the estate which the said decedent had afthe lime of deceden1's dea1h in said premises, and also the estate
therein, which the party oflhe first part has or has power to conveyor dispose of, whether Individually, or by virtue
of said will or otherwise: TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants Iha1 the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, In compliance with Section 13 of the Lien Law, covenants thafthe party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
10 the paymen1 of the cost of the improvement before using any part of the Iotal of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
