This Indenture, made the 2nd day of January, Two Thousand
and Seven,
MAY D. HARBES and ED~dtD W. HARBE8, JR., both residing at
555 Sound Avenue, Msttituck, New York 11952; as to a 97.8%
interest in the premises as tenants in conunon,
party of the first part, and
PATRXCXA DXV~.vn, residing at 220 Bloss~ Bend, Mattituck,
New York 11952; as to a 2.2 % interest in the premises,
party of the second part,
WXTNESSETE, that the party of the first part, kn
consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release guitclaim unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, all of the party of the
first part's interest in
ALL that certain plot, piece or parcel of land, with
buildings and improvements thereon erected, situate, lying
and being in the Hamlet of Mattituck, Town of Southold,
County of Suffolk, State of New York;

at the southeasterly corner of land of Koroleski, 200.00
feet southerly along Aldrich Lane from Sound Avenue, said
point of beginning be%nE the northeasterly corner of the
premises herexn descrxbed; running thence along Aldrich

BEZNG AND XNTENDED TO BE a portion of the same pr~mlses
conveyed to the' G~antor by Deed dated September 7, 2006
and recorded in the Suffolk County Clerk's Office on
October 13, 2006 in L'.~r D00012474, page 088, the Grantor
being the same person described as the Grantee in said
Deed. An additional 2.2% of the premises was conveyed by
the Grantor by Deed dated December 20, 2006 and recorded
in the Suffolk County glerk's Office on February 25, 2008
in Liber D000}2541, page 709.
The aforesaid'parcel was created by virtue of a resolution
adopted by the Town of Southold Planning Board held on May
24, 1993.
Together with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above-described premises to the center
lines thereof;
Together with the appurtenances and all the estate and
rights of the party' of the first part in and to said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the
purpose of paying the cost of improvement and will apply
the same first to the payment of the cost of the
improvement before using any part of the total of the same
for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
this indenture so requires.
