and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO EIE the same premises conveyed to the party of the first part by deed dated June
24,2005 and recorded in the Office ofthe Suffolk County Clerk on July 13, 2005 in Liber 12397 page 285.
TOGETHER with all right, title! and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the pa~ty of the first part In and to said premises: TO HAVE AND TO HOLD the premises
herein granted unto the party elf the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been E1ncumbered In any way whatever, except as aforesaid.
AND the party of the first part. iin compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the rlght to receive such consideration as a
trust fund to be applied first fo,' the purpose of paying the cost of the Improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as If it read "parties" whenever the sense of this indenture so
requires.

Suffolk and State of New York, known and designated as Lot No. 22 on a certain map,
entitled "Map of Highland Pclrk, Fishers Island, Suffolk County, New York 1885", and
fil,ed in the Office of the Clerk of the County of Suffolk on October 19, 1887 as Map No.
1 E;3, said lot being more particularly bounded and described as follows:
BEGINNING at a monument set at the southeasterly line of Equestrian Avenue, said
monument being 1653.25 feet North of a monument which is 3236.20 feet West of a
monument marking the U.S. Coast and Geodetic Survey Triangulation. Station "PROS";
and
RUNNING THENCE along the southeasterly line of Equestrian Avenue North 43
dE!grees 34 minutes.50 seconds East, 136.98 feet to a monument and land now or
formerly of Roland Oswald;
THENCE South 43 degrees 32 minutes 31 seconds East, 104.99 feet to a monument
and land now or formerly of The Henry L. Ferguson Museum, Inc.:
THENCE along the last mentioned land South 43 degrees 42 minutes 40 seconds
West, 122.31 feet;
THENCE still along the last mentioned land North 51 degrees 33 minutes 20 seconds
West, 105.00 feet to the southeasterly line of Equestrian Avenue and the monument
