Parkinson residing at 105 Cove Rd., Lyme, Connecticut 06371, party of the first part, and Louisa p, Evans, residing at No# Whistler Avenue, Fishers Island, New York 06390, party of the second part, CQ~ r <@0 WITNESSETH, that the party of the fust part, in consideration of TWO HUNDRED THOUSAND AND 00/100 ($200,000.00) DOLLARS, lawful money of the United States, and other good and valuable consideration paid by the party of the secoud part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that celtain plot, piece or parcel ofland, with the buildings and improvements thereon erected, if any, situate, lying, and being at Fishers Island, Town of Southold, Suffolk County, State of New York, more particularly described as follows (hereinafter called the Premises): ~ crf BEGINNING at a drill hole in the walk located northerly of Whistler Avenue, said point being 106.93 feet north ofa point which is 4815.23 feet west ofa monument marking the United States Coast and Geodetic Survey Triangulation Station "Pros" and thence running north 22 degrees, 47 minutes West 243.57 feet to a point; thence North 62 degrees, 21 minutes East 100.43 feet to a point; thence South 22 degrees, 47 minutes East 251.88 feet to a drill hole; thence south 67 degrees, 13 minutes West 100.00 feet to the point of beginning. Containing 0.57 acres, more or less, SUBJECT HOWEVER, to Covenants, Restrictions and Easements as set forth in Liber 4615 Cp 283 and Liber 6035 Cp 442 in the Office of the Suffolk County Clerk, including Right of First Refusal and Reverter. BEING and intended to be the same premises conveyed to the Grantors herein by deed dated April 15th, 1996 recorded May 6,1996 in Liber 11772, cp 058 in the Office of the Suffolk County Clerk, and conveyed to Stephen Morrell and Ann D. Morrell, his wife, by deed dated September 14, 1966 and recorded September 20, 1966 in Liber 6035 cp 442 in the Office of the Suffolk County Clerk. The aforesaid premises are not in an agricultural district and are entirely owned by the transferor herein. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center line thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of same for any other purpose. The word "party" shall be construed as ifto read "parties" whenever the sense of this indenture so requires.
