BETWEEN the COUNTY OF SUFFOLK, a municipal corporation of the State
of New York, having its principal office at the Suffolk County Center, Center
Drive, Riverhead, New York 11901, party of the first part, and
JEFFREY A. ClTERA AND ANGELA M. ClTERA, his wife, 55 Gagens
Landing Road, Southold, NY 11971, party of the second part,
WITNESSETH, that the party of the first part, pursuant to Resolution Number
144-2008 adopted by the Suffolk County Legislature on March 18, 2008 and,
thereafter, approved by the County Executive on March 27, 2008, in
consideration of Three Thousand Dollars and other valuable consideration paid
by the party of the second part, does hereby grant and release. unto the p_arty of

ALL, that certain plot, piece or parcel of land with any
~mprovements thereon erected, situate, lying and being in the Town of Southold,
County of Suffolk and State of New York, described on the Tax Map of the
Suffolk County Real Property Tax Service Agency as Distdct 1.000, Section
070.00, Block 10.00, Lot 005.001, and acquirad by Tax Deed on September 24,
2003, from John C. Cochrane, the County Treasurer of Suffolk County, New
York and recorded on September 26, 2003, in Liber 12274, CP 351, and
otherwise known as and by Town of Southold as Distdct 1000, Section 070.00,
Block 10.00, Lot 005.001; and,
AND the premises described herein shall not be independently improved by
the erection of any structure, and can be merged with grantee's adjoining parcel
if applicable so as to form one single lot. There can be no further subdivision of
the merged pamel unless it is consistent with local town and/or village zoning
codes and standards of the Suffolk County Department of Health Services,
applicable at the time application is made.
THIS restrictive covenant shall be enforceable by the County of Suffolk by
injunctive relief or by any other remedy, in equity, or at law. The failure of the
County of Suffolk or any agency thereof to enforce this covenant, shall not be
deemed to impose any liability whatsoever upon the County of Suffolk or any
officer, employee or agent thereof.
THIS covenant and restriction shall run with the land and shall be binding
upon the grantee, its successor and assigns, and upon all persons claiming
under them.
TOGETHER with all right, title and interest, if any, of the party of the first part
of, in and to any streets and roads abutting the above-described premises to the
center lines thereof;
TOGETHER with the appurtenances anti al~ the estate and rights of Jim par[y
of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part, the heirs or successors and assigns of the party of the second part
forever.
SUBJECT to all covenants, restrictions end easements of record, if any.
SUBJECT to any state of facts which an accurpte survey m!ght show.
AND the party of the first part, in compliance with Section 13 of the'Lien Law,
hereby covenants that the party of the first part will,receive th.e consideration for
this conveyance and will hold the right to receive such considetation as a trust
fund to be applied first for the purpose of paying'the ~o~st of th'e'imprevement
