premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party rf the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before usin!J any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

ALL that trf::.ct or parcel of land, with the
bUilding and l.mprovements thereool. situate on Fishers
Island, in the Town of Southold, county of Suffolk
and State of New York, bounded and described as fol-
lows:
, BEGINNING at a point on the Southerly line of
the Peninsula Road, so called, a private roadway
ovmed by Fishers Island Estates, Inc., at a point
located 1660.34 feet north of a point which is
1228.94 feet east of a monument marking the U. S.
Coast and Geodetic Triangulation Station rrpROSH; and
fro::;:; said begi::mln,; point running Scuth 67 degrees
42 minutes East., along the Southerly side of said
Peninsula Road, a distance of 35.4 feet to an iron
driven in the i~rOlU1d; thence running South 42 degrees
55 minutes Eas,;, along the Southwesterly side of
said Peninsula Road, a distance of 71.7 feet; thence
running Southwesterly, at right angles to the last
mentioned course, 37 feet more or less to the North-
erly shore of the Inner Cove of Great Harbor; thence
running 'Westerly, along the Northerly shore of the
above mentioned Cove, 100 feet more or less to a
point, said potnt being on the shore of the above
mentioned Cove and being opposite the point of begin-
ning in a line running from said point of beginning
on a course Sou~th 24 degrees 4 minutes Westj and
thence along said line North 24 degrees 4 minutes
East 118 feet rr,ore or less to the point of beginning;
RESERVING tc the party of the first part, its
successors and assigns, from the grant of the prem-
ises hereby conveyed, an easement and right of way
for all highway purposes over that part of the land
hereby conveyed which lies within the lines of' the
present roadway leading from the easterly termination
of East End Road (sometimes called Oriental Avenue)
to the Peninsul,a in West Harbor, the southwesterly
line of said right of way being the southwesterly
line of' said rOd.dway, which easement and right of' way
shall attach to" run with and benefit the remaining
lands of the pa:rty of the first part, now or hereafter
having means of access thereto, including lands on
said Peninsula; provided, however, that in the event
the location of said roadway now in use shall be
changed so that the use, for highway purposes, of
such part thereof as lies wi thin the bonndaries of
the land hereby conveyed shall be abandoned, said
easement and rights so hereby reserved for highway
purposes shall terminate; and
RESERVING to the party of the first part, its
~uccessors and assigns, from the grant of the prem-
lses hereby conveyed, easements and rights of way
wi thin a strip (If land 5 feet wide along the first
and second courses of the boundaries of said Dremises
for the erection thereon of poles to support ;'ires
for the transmission of electricity for light, heat,
telephone and other purposes and for the construction,
operation and maintenance of pipe lines and conduits
under the surface of said reservation for any lawful
purpose whatsoever, but the party of the first part
shall have the right at any time to release the prem-
ises above described from these particular easements
