party of the second part,
WITNESSETH, that the party of the first part, in consideration of Seventy-Five Thousand
and 00/100--------------------($75,000.00)----------______-------------------dollars
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of thl~ party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being inihe at Fishers Island, Town of Southold, County of Suffolk and State
of New York, being more particularly bounded and described as set forth on Schedule
A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
and John J. Bogert by deed dated April 7, 1977 and recorded in the Office of the
Suffolk County Clerk on JIIay 24, 1977 in Liber 8240 page 172.
TOGETHER with all righi, title and interest, if any, of the party of the first part in and 10 any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
Ihe estate and rights of the party of the firsl part in and to said premises; TO HAVE AND TO HOLD Ihe
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold Ihe right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first 10 the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

SCHEDULE A - DESCRIPTION

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon, in the Town of
Southold, Suffolk County, State of New York, being a part of that portion of Fishers Island now or formerly
belonging to Fishers Island Development Corporation (which portion is hereinafter called the "Park") lying to
the east of Peninsula Road, said lot or parcel of land being bounded and described as follows:
BEGINNING at an iron pipe on the northwesterly side of a road 45 feet wide, said iron being located 1582.48
feet South of a point which is 1456.83 feet West of a monument marking the United States Coast and
Geodetic Survey Triangulation State "NIN," said pOint of beginning also marking a point of curve to the right
whose radius of 235.47 feet and the direction of whose radius at that point is South 33 degrees 58 minutes 04
seconds East; and
RUNNING THENCE northeasterly along said road line, following the arc of said curve, 88.92 feet to a point of
curve to the left whose radius of 10.00 feet and the direction of whose radius at that point is North 12 degrees
19 minutes 48 seconds West;
THENCE northeasterly along the northwesterly line of another road, following the arc of said curve, 15.70 feet;
THENCE alon9 the southwesterly line of said other road, North 18 degrees 00 minutes 30 seconds East, 82.50
feet to a point of curve to the right whose radius is 669.82 feet and the direction of whose radius at that pOint
is North 71 degrees 59 minutes 30 seconds East;
THENCE northwesterly along said road line, following the arc of said curve, 208.14 feet to an iron;
THENCE South 89 degrees 47 minutes 45 seconds West, 270.00 feet to an iron;
THENCE South 37 degrees 20 minutes 41 seconds West, 203.05 feet to an iron;
THENCE South 65 degrees 05 minutes 20 seconds East, 400.00 feet to the pOint or place of BEGINNING.
