party of the second part,
WITNESSETH, that the party of the filSt part, in consideration of Two Hundred Nineteen Thousand Seven

paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
November 7,1991 and recorded in the Office ofthe Suffolk County Clerk on December 16,1991 in Liber 11386
page 141.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER w~h the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party ofthe first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

BEGINNING at a monument on the northeasterly line of an unimproved road, said monument being located
1521.55 feet North of a point which is 1898.35 feet East of a monument marking the United States Coast and
Geodetic Survey Triangulation Station "PROS" and;
RUNNING THENCE North 50 degrees 47 minutes 09 seconds East, 431.18 feet to a point;
THENCE South 43 degrees 45 minutes 36 seconds East, 268.00 feet to a point;
THENCE South 44 degrees 02 minutes 23 seconds West, 444.40 feet to an Iron pin on the said northeasterly
line of said unimprov~d road;
THENCE northwardly along said road line following the arc of a curve to the left having a radius of 4608.54 feet
for a distance of 319.62 feet to the monument at the point of BEGINNING.
TOGETHER WITH a right of way for all purposes for which a highway is ordinary used over an unimproved road,
