WITNESSETH, that the parties of the first part, as a gift, and without monetary
consideration, by their deed dated December 6, 1999 recorded in Liber a e 031
did remise, release and quitclaim unto SARAH HALE POR her heirs,
successors and assigns forever the remainin~ interest of e Eliot Hale Porter, 2nd
Revocable Trust under agreement dated')inuary 22, 1990 and/or of Eliot Hale Porter
2d in and to all of the plots, pieces or parcels of land, with the buildings and
improvements thereon described in Schedule A attached hereto, which 14% remainin
interest in the absolute fee of said premises was held by first peso owmg execu on
and delivery of a Quitclaim Deed dated August 3, 1995 from Shawmut Bank of
Connecticut, N.A. &: Eliot Hale Porter 2nd, as Cotrustees of the Eliot Hale Porter, 2nd
Revocable Trust under agreement dated January 22, 1990 to Sarah Porter Mullen as
CJlStodian for Sarah Eliot Mullen &: Marilyn Porter Mullen under the New York Uniform
Gifts to Minors Act. Said 1995 deed conveyed the interests in the fee estate in said
premises together with the appurtenances thereto hereinafter described to the
following named parties:

To SARAH PORTER MULLEN of 10 South Gateway, Winchester,
Massachusetts, as custodian for SARAH ELIOT MULLEN under the New York
Uniform Gifts to Minors Act, an absolute Five (5%) percent interest in the fee estate
of said parcel;
To SARAH PORTER MULLEN of 10 South Gateway, Winchester,
Massachusetts, as custodian for MARILYN PORTER MULLEN under the New York
Uniform Gifts to Minors Act, an absolute Five (5%) percent interest in the fee estate
of said parcel;
It was the intention of FLEET NATIONAL BANK, Successor to SHA WMUT
BANK OF CONNECflCUT, N.A. &: ELIOT HALE PORTER 2ND, as Cotrustees of the
Eliot Hale Porter, 2nd Revocable Trust under agreement dated January 22, 1990,
through said conveyance recorded on December 6, 1999 in Liber 12005 Page 031 to
convey to said SARAH HALE PORTER a/kJa SARAH PORTER MULLEN ,omy tbjt
remainin~ 14% interest in the fee estate of said premises held by said Trust follOWIng
delivery.of the atore&a1Q I..!wtcllum ueed dated August 3,1995, which deed was
inadvertently not recorded by the New York holder thereof, Chicago Title Insurance
Company without knowledge of the parties. Said original deed of August 3, 1995 is to
be recorded immediately prior hereto in the Suffolk County Land Records.
Through this indenture, the parties of the first part confirm and ratify as a gift
and without monetary consideration their conveyance on August 3, 1995 aforesaid as
follows:
WITNESSETH, that the parties of the first part, as a gift, and without monetary
consideration, does hereby confirm the remise, release and quitclaim conveyance by
the Shawmut Bank of Connecticut, N.A. &: Eliot Hale Porter 2nd, as Cotrustees of the
Eliot Hale Porter, 2nd Revocable Trust under agreement dated January 22, 1990 as of
August 3, 1995 unto SARAH PORTER MULLEN of 10 South Gateway, Winchester,
Massachusetts, as custodian for SARAH ELIOT MULLEN under the New York "
Uniform Gifts to Minors Act and to SARAH PORTER MULLEN of 10 South Gateway,
Winchester, Massachusetts, as custodian for MARILYN PORTER MULLEN under the
New York Uniform Gifts to Minors Act and the heirs, successors and assigns of said
minors forever of the following interests in fee in all of the plots, pieces or parcels of
land, with the buildings and improvements thereon described in Schedule A attached
hereto:
To SARAH PORTER MULLEN of 10 South Gateway, Winchester,
Massachusetts, as custodian for SARAH ELIOT MULLEN under the New York
Uniform Gifts to Minors Act, an absolute Five (5%) percent interest in the fee estate
of said parcel;

Massachusetts, as custodian for MARILYN PORTER MULLEN under the New York

TOGETHER with the appurtenances thereto.
Being a portion of premises conveyed by Quitclaim Deed of Eliot Hale Porter,
2nd a/k/ a Eliot H. Porter dated July 29, 1994 and recorded in the Suffolk County
Clerk's Office on August 16, 1994 in Liber 11689 Page 967.
TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part and their heirs, successors and assigns forever.

second part and her heirs, successors and assigns forever.
IN WITNESS WHEREOF, the parties of the first and second part and SARAH
PORTER MULLEN, INDIVIDUALLY confirming said deeds of conveyance have

FIRST PIECE:
All that certain plot, piece or parcel of land, with the buildings and improvements thereon
. erected, lying and being in the Town of Southold, County of Suffolk and State of New York, being
a part of that portion of Fishers Island belonging to Fishers Island Corp. (which portion is
hereinafter called the "Park"), being more particularly bounded and described as follows: .
BEGINNING at a stone monument set on the Southerly side of a road 40 feet wide, said
monument being 2452.61 feet South of a point which is 1942.14 feet West of another monument
marking the U.S. Coast and Geodetic Survey Triangulation Station "NIN" (which said "NIN"
monument is located near the Western end of a ridge overlooking the South shore of Fishers
Island and on the highest point between Chocomount and Mount Prospect and lies South 45
degrees 17 minutes 26 seconds East of North Dumpling Light in Fishers Island Sound); and
RUNNING THENCE Northeasterly along the Southerly side of said road (following the arc of a
curve to the left whose radius is 752.62 feet and the direction of whose radius at that point is
North 12 degrees 38 minutes 24 seconds West) 166.25 feet;
THENCE South 38 degrees 52 minutes 50 seconds East 284.42 feet;
THENCE. South 26 degrees 32 minutes West 220.39 feet;

THENCE North 74 degrees 45 minutes 20 seconds West 93.85 feet;
THENCE North 23 degrees 18 minutes 40 seconds West 370.14 feet to the Southerly side of said
road, and the point or place of BEGINNING.
Being the same premises conveyed to Eliot Hale Porter 2nd by Deed of Richard H. Wilmer, Jr. and
Elisabeth Farnum Wilmer dated May 10, 1967 and recorded in the Suffolk County Land Records
Liber 6155, Page 582
SECOND PIECE:
All that lot or parcel of land, with the buildings and improvements thereon, in the Town
of Southold, Suffolk County, State of New York, being a part of that portion of Fishers Island now
or formerly belonging to. the Fishers Island Development Corporation (which portion is
hereinafter called the "Park") lying to the east of Peninsula Road, said lot or parcel of land being
bounded and described as follows:
BEGINNING at a point at the Southeasterly comer of land of the party of the first part said
point being located 2620.05 feet South of a point which is 1606.65 feet West of a monument
marking the United States Coast and Geodetic Survey Triangulation Station ''NIN'' and thence
running South 26 degrees 32' 00" West 220.39 feet; thence South 74 degrees 45' 20" East 90.15 feet
to the shore of Block Island Sound; thence along said shore line North 26 degrees 25' 07" East
20274 feet; thence North 63 degrees 28' West 88.0 feet to the point of beginning.
Containing 0.43 acres, more or less and being a parcel of beach frontage adjoining land of
the party of the first part. Together with the appurtenances, and all the estate and rights of the
party of the first part in and to said premises;
SUBJECT to any state of facts an accurate survey may show; and
SUBJECT to all covenants, restrictions, easements, rights, grants, and declarations of
record, if any, and easements for use of public utilities, including, but not limited to, all
covenants, restrictions, easements, rights, grants, and declarations contained in a Deed from the said
Fishers Island Development Corporation to Eliot H. Porter dated April 7, 1977 and recorded in the
Suffolk County Land Records.
It is expressly covenanted by the parties hereto that no rights, appurtenances, privileges or
personal advantages not herein expressed. run with or are attached to the land conveyed.
Being the same premises conveyed to Eliot H. Porter from Fishers Island Development
Corporation by deed dated April 7, 1977 and recorded in the Suffolk County Land Records, Liber
8611 Page 575.
