LISA K. HOWLETT, 206 Cliff Avenue, Pelham Manor, New York 10803,
party of the second part,
WITNESSETH, that the partyofthe first part,ln consideration of Two Million Nine Hundred Thousand-------------

paid by the party ofthe second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being at Fishers Island, Town of Southold, County of SuffOlk and State of New York, being more particularly
bounded and described as set forlh on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part in two parcels, one of
which was conveyed by deed dated September 28, 1977 and recorded in the Office of the Suffolk County Clerk
on October 31, 1977 in Liber 8334 page 328 and the other of which was conveyed by deed dated November 21,
1977 and recorded in the Office of the Suffolk County Clerk on June 12, 1978 in Llber 8443 page 39.
TOGETHER with all right, t~le and interest, If any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights olthe party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in Cllmpliance with Section 13 of the Lien Law, covenants that the party ofthe first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read .parties" whenever the sense of this indenture so
requires. .

All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erE~cted, situate, lying and being at Fishers Island in the Town of Southold, County of
Suffolk and State of New York, being bounded and described as follows:
BEGINNING at a stone monument set on the southerly side of a road 40 feet wide, said
monument being 1577.88 feet South of a point which is 1246.95 feet West of another
monument marking the U.S. COBstand Geodetic Survey Triangulation Station "NIN" (which
said "NIN" monument is located near the western end of a ridge overlooking the south
shc)re of Fishers Island and on the highest point between Chocomount and Mount
Prospect and lies South 45 degrees 17 minutes 26 seconds East of North Dumpling Light
in Fishers Island Sound); and
RUNNING THENCE along the southerly side of said road North 83 degrees 55 minutes
20 seconds East, 117.00 feet to a stake marking a point of curve to the right whose radius
is 112.67 feet and the direction of whose radius at that point is South 06 degrees 04
minutes 40 seconds East;
THENCE eastwardly following the arc of said curve, 94.12 feet to a stake;
THENCE South 48 degrees 13 minutes 00 seconds East, 152.69 feet to a stake;
THENCE South 34 degrees 30 minutes 23 seconds West, 209.65 feet to a stake;
THENCE South 28 degrees 41 minutes 06 seconds West, 57.08 feet to a stake and land
now or formerly of Sturges:
THENCE North 65 degrees 06 minutes 20 seconds West along the last mentioned land,
474.75 feet to a stake and the easterly side of said 40 foot road;
THENCE northeastwefdly along the southerly side of said road (following the arc of a
curve to the right whose radius is 753.61 feet and the direction of whose radius at that
point is South 68 degrees 55 minutes 00 seconds East), 13.01 feet to a stake:
THENCE northeastwar6ly still along the southerly side of the said road (and following the
arc: of a curve to the right whose radius is 190.47 feet and the direction of whose radius
at that point is South 67 degrees 55 minutes 40 seconds East), 205.61 feet to a stake;
THENCE still along the southerly side of said road North 83 degrees 55 minutes 20
seconds East, 99.04 feet to the monument set on the southerly side of said 40 foot road
