WARRANTY DEED
THIS INDENTURli, made the 4th day of October, two thousand and four
. BETWEEN HENRY H. F'ISHER and LYNNE G. FISHER, husband and wife, of
712 Mountain Road, West Hanford, CT 06117, pany of the first pan, and HENRY
FISHER AND LYNNE FISHER, TRUSTEES OF THE HENRY AND LYNNE
FISHER R1iVOCABLE TRUST UNDER AGREEMENT DATED OCTOBER 4,
2004. of 712 Mountain Road. West Hartford. CT 06117, party of the second part.
WITNESSETH, that the pany of the first part, in consideration of Ten Dollars
and other valuable consideration paid by the pany of the second part, doc'! hereby grant
and release unto the party air the second part. the heirs or successors and assigns of the
party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thel1con erected. situate, lying and being in the
Town of Southold, at. Fishers Island, County of Suffolk and Slate of New York,
being bounded and dl~scribed as follows:
BEGINNING at a point on the Southwesterly side of Montauk Avenue 83.39
feet as measured along the Westerly side of Montauk Avenue from a drill hole
in the faee of a wall which drill hole is located on the Northeasterly comer of
land now or formerly of Barbard B. Parrott and from said point of beginning:
RUNNING THENCE northwesterly along the westerly side of Montauk Avenue
North 28 degrees 07 minutes 30 seconds West 65.36 feet to a lead plug in a
walk: and
RUNNING THENCE South 42 degrees 03 minutes 30 seconds West 115.06 feet
to a drill hole in the f.lce of a wall;
RUNNING THENCE South 54 degrees 30 minutes IS seconds East 85.34 feet
10 the Southwesterly (:orner of the above referenced land of Barbara B. Parrott;
RUNNING THENCE North and East along the aforementioned land of Barbara
B. Parrott North 12 degrees 24 minutes 20 seconds East 62.28 fect and North
56 degrees 57 minuu:s 30 seconds East 29.60 feet to the Westerly side of
Montauk Avenue at the point or place of BEGINNING.

herein granted unto the parlJI of the second pan, the heirs or successors and assigns of
the party of the second pan forever.
Being and intending to convc:y the same premises conveyed to the party of the first pan
by Bargain aDd Sale Deed dated August 22, 1977 and recorded in the Suffolk County
Clerk's Office on October 2ti, 1977 in Liber 8332 at page 196.
AND the party of the first pan, in compliance with Section 13 of the Lien Law,
covenants that the party of the first pan will receive the consideration for this
conveyance and will hold the right to receive such consideration as a UUSt fund to be
applied first for the purpose of paying the cost of the improvement and will apply the
same first to the payment of' the cost of the improvement before using any pan of the
total of the same for any othc~ purpose.
AND the party of the: first pan covenants as follows: thai said pany of the first
part is seized of the said premises in fee simple, and has good right to convey the same:
that the party of the second pan shall quietly enjoy the said premises; thai the said
premises are free from enc~lmbrances, except as aforesaid; that the party of the first
part will execute or procwre any further necessary assurance of the title to said
premises; and that said party of the first pan will forever warrant the tille to said
premises.
The word "party" shall be O[)nstrued as if it read "panics. whenever the sense of this
indenture so requires.
