WITNESSETH, that the party of the first part, duly nominated and appointed Trustee under
DCl:d orTrust dated 1/1175, by vilrtue of the title and authority in me vested by the terms of said
Trust, and in considemtion of TEN (SIO.OO) DOLLARS paid by the party of the second part,
does hereby grant and release unto the party of the second part, the heirs or successors and .
assigns of the party oftbe second part forever,
ALL THAT CERTAIN plot, piece or pareel of land, with the buildings and improvements
thereon erected, situate, lying and being at Fishers Island, Town of Southold, County of Suffolk,
State of New York, being more panicularly bounded and described as follows:-
COMMENCING at a small rock on the shore visible at ordinary high tide (said rock being in the
southeastern comer of said lot and 35 feet from the nearest surface of a large and high rock
easterly therefrom, and also 42 filet from the nearest surface of a still larger rock lying on the
shore at high tide and northwesterlly fmm said point);
THENCE nonhwesterly by and along the shore of the so-called "Western Harbor", 172 feet to
the northerly face of a high rock located 16.5 feet from another rock in the same direction still
farther on;
THENCE South 38.5 degrees West 98 feet to a point 18 feet from a large rock lying northerly
therefrom (this comer of98 feet marking the easterly side of a road or passageway about one rod
wide leading to the water);
THJENCE South I I degrees West by and along said road or passageway 210 feet to a merestone;
THENCE North 31.75 degrees cail! 300 feet 10 a small rock, the point of departure.

by 'George W. Robens and Nellie A. Roberts (parents of Alfred E. Roberts and George W.
Roterts) including. however, in this conveyance all right, title and interest of the grantor herelo
under the reservation in said deed to David Torrance dated September 10, 1885, of the right to
draw water from the well on the premises thereby conveyed, and the right therein reserved to

pass and re-pass to and from saidl well, and all rights reserved in and by said deed in respect of
the rights of way therein granted and the right to locate or relocate such rights of way.
SUBJECT TO the rescrvation of Alfred E. Roberts and Bertha R. Roberts, their heirs and
assigns, of the right to use in common with others the dock or wharf extending from the premises
first above described with th~ right to pass with or without their guests and invitees to and from
the same over the land above desl:ribed in the most reasonably convenient way for all concerned
at 1111 times during the liv~s of said Alfred E. Roberts, Bertha R. Roberts and their daughter,
Barbara Delphine Lange, or the survivor of them, such reservation contained in the deed from
Alfred E. Roberts and Bertha R. Roberts dated Mareh 24, 1949, and recorded in Suffolk County
Libel' 2943 page 59.
BEING AND INTENDED TO BE thc samc premises conveyed to the party of the first part by
decd from Katherine H. Arnold flllla Katherine R. Hale dated July 24, 1996, and recorded in the
Suffolk County Clerk's Omce on August 20,1996, in Libel' 11788 page 40].
TOGETHER WITH all right, title and interest, ifany, of the party ofthc first part in and to any
streets and roads abutting thl: above-described premises to the center lines thereof;
TOGETHER WITH the appurtenances and all the estate and rights of the party of the first part
in s,nd to the said premises which the party of the second part has the power to conveyor dispose
of; TO HAVE AND TO HOLl1Ithc premises herein granted unto the party of the second part
andlor assigns forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been incumbered in any way whatever, except a.~
afolresaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will rcl:cive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of improvement and will apply the same first to the payment of the cost of the improvement
befiJre using any part of the total c,fthe same for any other purpose.
The: word ''party'' shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
