and being in-tbe at Fishers Island, Town of Southold, County of Suffolk and State of
New York, the center line of said right of way being specifically described as follows:
BEGI]~ING at a point on the northeasterly line of Oriental Avenue, said point being
979.91 feet North of a point which is 969.90 feet West of a monument marking the
U.S. Coast and Geodetic Survey Triangulation Station "PROS"; and
RUNNING THENCE North 45 degrees 12 minutes 00 seconds East, about 504 feet.
BEING AND INTENDED TO BE the ten foot wide right of way for a water line over an
approximately 3.11 acre parcel own'ed by the party of the second part and designated
on the Suffolk County Tax Map as District 1000, Section 10, Block 8, Lot 15, said
right of way having been described in prior instruments of record, including those
recorded in the Office of the Suffolk County Clerk in Liber 3383 page 250, Liber
6921 page 168, Liber 12019 page 399, Liber 12053 page 870, Liber 12053 page 871
and Liber 12053 page 876.
This deed to the owner of the servient estate is being recorded for the purpose of
terminating and extinguishing the above described ten foot wide right of way.
TOGETHER with all right, title and interest, ifany, ofthe party ofthe first part of, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forevl:r.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
