HARVEY a/kJa John Locke Harvey, residing 106 St. Albans Way, Baltimore, Maryland 21212, GRACE WALKER HARVEY, residing at 171 West 71" Street, #7A, New York, New York 10023 and ROSE HARVEY formerly Rose Harvey Gwathmey, residing at 40 West 77th Street, New York, New York 10024, as tenants in common, party of the second part, WITNESSETH, that the party of the first part to whom ancillary letters testamentary were issued by the Surrogate's Court, Suffolk County, New York on February 6, 2001, and by virtue of the power and authority given in and by said last will and testament and/or by Article II of the Estates Powers and Trust Law and as part of the distributive share in said estate of the party of the second part, does hereby grant and release unto the party of the second part, the distributees or successors lmd assigns of the party of the second part forever, all of the deceased FREDE!UC!S. B~~g~.H~.~YEY JR:'.~.~n.::.~ft~ undivL~;~~~e~n and to ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, Suffolk County, State of New York, being a part of that portion of Fishers Island belonging to Fishers Island Corporation (which portion is hereinafter called the "Park") lying easterly of the following line, viz: BEGINNING at the southeasterly comer of land owned by the United States, known as the Fort H.G. Wright Military Reservation, Mount Prospect Tract, on the shore of Block Island Sound, or the Atlantic Ocean and running thence northerly fi)llowing the East boundary of the said land of the United States to the southerly line of East End Road (sometimes called Oriental Avenue) and which point is the northeasterly comer ofland of the United States; thence crossing the East End Road and following the same course as the last to the shore of West Harbor or Fishers Island Sound; said lot or parcel ofland being bounded and described as follows: BEGINNING at a stone monument set on the southerly side of a road 40 feet wide, said monument being 1069.58 feet East of a point which is 351.31 feet North of another monument marking the U.S. Coast and Geodetic Survey Triangulation Statiorr"Nin" (which said "Nin" monument is located near the westerly end of a ridge overlooking the south shore of Fishers Island and on the highest point between Chocomount and Mount Prospect and lies South 45 degrees 17 minutes 26 seconds East of North Dumpling Light in Fishers Island Sound); and running thence Northeastwardly along the southerly side of said road (following the arc of a curve to the left whose radius is 271.42 feet and the direction of whose radius at that point is North 49 degrees 12 minut(~s 28 seconds West) 50.07 feet to a stake; thence, still along the southerly side of said road, North 30 degrees 13 minutes 20 seconds East , 36.44 feet to a stake marking a point of curve to the right whose radius is 151.09 feet and the direction of whose radius at that point is South 59 degrees 46 minutes 40 seconds East; thence northeastwardly still along the southerly side of said road (and following the arc of said curve) 176.39 feet to a stake; thence, still along the southerly side of said road, South 82 degrees 53 minutes 20 seconds East 49.90 feet to a stake marking a point of curve to the left whose radius is 191.15 feet and the direction of whose radius at that point is North 7 degrees 6 minutes 40 seconds East; thence Eastwardly still along the southerly side of said road (and following the arc of said curve) 125.54 feet to a stake; thence South 28 degrees 8 minutes 40 seconds East 20 feet to a stake; thence South 42 degrees 23 minutes 30 seconds West 210.37 feet to a stake; thence South 26 degrees 26 minutes 20 seconds West 164.20 feet to a stake; and thence North 46 degrees 8 minutes West 223.86 feet to the point or place of BEGINNING. The Trustees ofthe trusts established under the Will ofF. Barton Harvey, Jr.join in this conveyance to certify that the above described property was allocated to the "Non-Exempt Marital Trust" established for the primary benefit of the decedent's wife, GRACE HARVEY, under Section 3.1.A.(2)(b) of said Will, and because this Non-Exempt Marital Trust was not funded with the above described property prior to the death of the decedent's surviving spouse, GRACE HARVEY, on February 4, 2001, they wish, as Trustees under SECTION 3 of the decedent's Will and as Trustees of said Non-Exempt Marital Trust established under Section 3.I.A(2)(b) of said Will to join in the direct conveyance of the decedent's interest in the above described property to the parties of the second part hereunder who, upon the death of GRACE HARVEY, pursuant to Section 3.3.C.(3)(b) of the decedent's Will, became entitled to receive distribution of all assets held in or allocated to such Non-Exempt Marital Trust including the above described property. BEING AND INTENDED to be, all the right, title and interest ofF. BARTON HARVEY in the above premises as devised to him under the Last Will and Testament of Rose Hopkins Harvey deceased (Ancillary Probate, Surrogate's Court, Suffolk County 1986 P 1980) whose title derived from deed recorded in Liber 1281 cp 551 and subsequent deed to F. Barton Harvey and others from Ellen Harvey Kelly and Jean Harvey Baker recorded in Liber 9255 cp 289. TOGETHER with all right, title and interest, ifany, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said pmmises, and also the estate therein, which the party of the first part has or has power to conveyor dispose of, whether individually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid.
