THIS INDENTURE, made as of the J {dday of June, Two Thousand and Two,
between THOMAS W. CASHEL of27 Main Street, Walpole, New Hampshire 03608,
hereinafter called the grantor, party of the first part, and THOMAS W. CASHEL and
SARAH STRIFE CASHEL, Trustees of The Thomas W. Cashel Qualified Personal
Residence Trust dated June A I:, ,2002, both of 27 Main Street, Walpole, New
Hampshire 03608, hereinafter called the grantees, party of the second part:
WITNESSETH, that the party of the first part, in consideration ofTen Dollars
($10.00), lawful money of the United States paid by the party of the second part, does
hereby grant and release unto the party of the second part, their successors and assigns
forever, all that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being on Fishers Island, Town of Southold, County of
Suffolk and State of New York, more particularly bounded and described as follows:-
BEGINNING at a stone monument set on the northerly side of a road 40 feet
wide, said monument being 6,538 and 47/100 feet west of a point which is 124 and
42/100 feet north of another monument marking the U.S. Coast & Geodetic Survey
Triangulation Station "Chocomount 2" (which said "Chocomount 2" monument is located
on the summit of the highest hill on Fishers Island New York about 2Y4 miles west of the
east em end of Fishers Island and lies south 79 degrees 29 minutes and 46 seconds east of
north Dumpling Light in Fishers Island Sound); and running thence westwardly along the
northerly side of said road (and following the arc of a curve to the left whose radius is
976 and 40/100 feet and the direction of whose radius at that point is south 12 degrees I
minute and 42 seconds east) 288 and 4/100 feet to an iron pipe; thence still along the
northerly side of said road, south 61 degrees 4 minutes and 10 seconds west 15 and
48/1 00 feet to an iron pipe; thence north 26 degrees 2 minutes and 45 seconds west 174
and 45/100 feet to an iron pipe, thence north 54 degrees and 9 minutes west 122 and
73/100 feet to an iron pipe; thence north 15 degrees 57 minutes and 20 seconds east 147
and 28/1 00 feet to an iron pipe on the shore of Fishers Island Sound; thence with the
meanders of said Sound, south 48 degrees and 26 minutes east 83 and 62/100 feet; north
82 degrees 52 minutes and 30 seconds east 80 and 62/1 00 feet; north 44 degrees 18
minutes and 40 seconds east 58 and 70/1 00 feet; north 11 degrees 7 minutes and 40
seconds east 62 and 17/100 feet; and north 76 degrees 20 minutes and 50 seconds east
193 and 7/100 feet to an iron pipe; and thence south 5 degrees 26 minutes and 20 seconds
east, passing 2 iron pipes 367 and 6/100 feet to the monument at the place of beginning;
containing approximately 2.98 acres.
TOGETHER with all land if any, between the meander lines above mentioned
and the highwater line of Fishers Island Sound, to the land under the waters of Fishers
Island Sound and in and to any land which may lie between the meander lines as
aforesaid and the actual shore line.
TOGETHER with an easement for ingress to and egress from the premises above
described over and along such private road connecting the said premises to the nearest
public highway.

BEING the same premises conveyed by Deed dated May 2, 1975 by Fiduciary
Trust Company of New York in the Office of the Clerk of Suffolk County, in Liber 7836
of Deeds, at page 47.
TOGETHER with all right, title and interest, if any, of the party ofthe first part in
and to any streets and roads abutting the above described premises to the center lines
thereof,
TOGETHER with the appurtenances, and also alJ the estate and rights of the party
of the first part in and to the premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part, the distributees or successors and assigns of the party ofthe second part
forever.
AND the party of the first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatever, except as afores'aid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party ofthe first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost ofthe improvement and will apply the same first to the
payment of the cost of the improvement before using any part ofthe total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed
as of the day and year first above written.
