A. For new building or new use: 1. Final survey of property with accurate location of all buildiugs, property lines, streets, and unusual natural or

2. Final Approval from Health Dept. of water supply and sexverage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Undem, dters.
4. Sworn statement from plunrber certifying that the solder used in system contains less than 2/10 of 1% lead.

of Code Compliance from architect or engineer responsible for tile building.

SEQRA DETERMINATION: The Zordng Board of Appeals has visited the property under
consideration in this application and determines that this review fails under the Type II
category of the State's List of Actions, without further steps under SE QRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This apphcation was referred as required
under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk
County Department of Planning issued its reply dated January 16, 2008 stating that this
application is considered a matter for local determination as there appears to be no
significant county-wide or inter-community impact.
LWRP DETERMINATION/TOWN CODE CHAPTER 268: This application is determined
consistent exempt under Chapter 268 of the Town Code, in accordance with the February 22,
2008 letter of recommendation from the Town LWRP Coordinator.
BASIS OF APPLICATION: Request for Variances under Section 280-124, based on
the Building Inspector's February 21, 2008 amended Notice of Disapproval
concerning as-built and existing deck construction, proposed for reconstruction with
enlargement resulting in a rear yard setback at less than 50 feet and single side
yard setback at less than 15 feet.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on February
28, 2008, at which time written and oral evidence were presented. Based upon all
testimony, documentation, personal inspection of the property, and other evidence,
the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The relief requested is for new open, unroofed
deck replacement set back 10 inches from the side lot line at its closest point, and
surrounding the existing swimming pool. The applicants (by their Architect) state that the
area of the site for lot coverage calculations is 22,396 square feet, and the proposed lot
coverage at 15.89% is actually less than the existing lot coverage of 16.56%, and at the same

height as the existing deck construction. Greater detail is more fully shown on the 2'5-2008
site survey mapped by Architecnologies.
ADDITIONAL INFORMATION: The property contains an overall size of 29,557 square feet
(22,395 square feet measured between the current edge of wetlands and the road) and is L'
shaped. The existing dwelling decks and swimming pool have been in place for many years.
The vicinity of this property is similar to a small compound of approximately ten (10)
substandard adjacent properties that lie within a few hundred feet of the Long Island Sound.
The homes are serviced by a series of two rather narrow private roads, which have separate
egress and ingress locations.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials
submitted and personal inspections, the Board makes the following findings:
1. Town Law §267'b(3)(b)(3)(1). Grant of the variances will not produce an
undesirable change in the character of the neighborhood or a detriment to nearby
properties because the deck reconstruction is located within the footprint of an
existing deck with fence around the swimming pool, and there is a right-of-way
adjacent on the easterly side. The deck has a Certificate of Occupancy, and the new
deck is mainly replacement, in-kind for a portion, and with the fence as shown on
the 2'5'08 site plan (mainly within the southwestern section of the property adjacent
to the rear of the dwelling).
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicants cannot be
achieved by some method, feasible for the applicants to pursue, other than an area
variance because the applicant proposes to reconstruct, in place and in kind, an
existing deck that has a certificate of occupancy.
3. Town Law §267-b(3)(b)(3). The relief granted herein is not substantial because
the existing setbacks will remain the same.
4. Town Law §267-b(3)(b)(5). The difficulty has not been self created it is created
because the applicant is proposing to reconstruct a portion what is already
recognized by the town as a legal deck and fence.
5. Town Law §267-b(3)(b)(4). There has been no evidence submitted to suggest that
a variance in this residential neighborhood may have an adverse impact on the
physical or environmental conditions in the neighborhood.
6. The grant of the variance is the minimum action necessary and adequate to
enable the applicants to enjoy the benefit of a replacement portion of the existing
deck which surrounds a swimming pool, while preserving and protecting the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and
applying the balancing test under New York Town Law 267-B, motion was offered
by Member Oliva, seconded by Member Simon, to

Grant the variance as applied for, as shown on the 2/25/08 elevation diagram
and site map dated 11-29-07 prepared by Architecnologies, subject to the
following Conditions:
1. The deck areas shall remain open to the sky.
2. The filter equipment which will be outdoors shall be placed within a
sound-deadening (sound-proof) enclosure.
The above conditions shall be written into the Certificate of Occupancy by the
Building Department before issuance.
Any deviation from the variance given such as extensions, or demolitions which are
not shown on the applicant's diagrams or survey site maps, are not authorized under
this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or other feature of
the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in
nature for an alteration that does not increase the degree of nonconformity.

Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of tbe Toum of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
January 23, 2008~ and in consideration of application fee in the sum of $250.00 paid by Richard & Mary Lou

The proposed construction, on a non-conforming 29,557 square foot lot in the Residential R-40
District, with two front yards, is not permitted pursuant to Article XXIII Section 200-I 24, which states
that non-conforming lots, measuring between 20,000 and 39,999 square feet in total size, require a
minimum rear yard setback of 50 feet and a single side yard setback of 15 feet.
The proposed construction notes a rear yard setback of+/- 4.16 feet and a single side yard setback of 0.
This Notice of Disapproval was written based on a site plan dated 11/29/07 by Frank Notaro~
