TOGETHER with all right, title and interest, if any, of the party or the first part in and to any streets and roads abutting the above desalbed premises to the center lines thereof: TOGETHER with the appurtenances and all the estate and rights or the party of the first part In and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party or the second part, the heirs or successors and assigns of the party of the second part forever. Kuijpers Deed Dated: November 1- ,2005 ALL those lots or parcels of land, with the buildings and improvements thereon, in the Town of Southold, Suffolk County, State of New York, being a part of that portion of Fishers Island lying Easter1y of the following line, viz.: BEGINNING at the southeasterly corner of land owned by the United States, known as the Fort H. G. Wright Military Reservation, Mount Prospect Tract, on the shore of Block Island Sound or the Atlantic Ocean; and RUNNING THENCE northerly following the East boundary of the said land of the United States to the southerly line of East End Road (sometimes called Oriental Avenue) and which point is the northeasterly corner of land of the United States; THENCE crossing the East End Road and following the same course as the last to the shore of West Harbor or Fishers Island Sound: Said lots or parcels of land being bounded and described as follows: PARCEL A (BLOCK 17 - LOT 4-Bl BEGINNING at a stone monument set on the Easterly side of a road 40 feet wide, said monument being 1630.41 feet West of a point which is 274.20 feet North of another monument marking the U. S. Coast and Geodetic Survey Triangulation Station "Chocomount 2" (which said "Chocomount 2" monument Is located on the summit of the highest hill on Fishers Island, N.Y. about two and one-quarter miles West of the Eastern end of Fishers Island and lies South 79 degrees 29 minutes 46 seconds East of North Dumpling Light in Fishers Island Sound); and RUNNING THENCE, along the Easter1y side of said road, North 41 degrees 10 minutes 20 seconds East, 293.02 feet to a point; THENCE South 74 degrees 57 minutes 30 seconds East, 337.18 feet to a point; THENCE South 29 degrees 56 minutes 20 seconds West, 364.66 feet to a point; THENCE South 18 degrees 44 minutes 50 seconds West, 51.42 feet to a point; THENCE North 63 degrees 55 minutes 30 seconds West, 171.23 feet to a point; and THENCE North 46 degrees 45 minutes West, 228.21 feet to the monument set at the place of BEGINNING. LOT 4-Gl BEGINNING at a stone monument set on the Westerly side of a road 40 feet wide, said monument being 884.39 feet West of a point which is 184.98 feet North of another monument marking the U. S. Coast and Geodetic Survey Triangulation Station .Chocomount 2" (which said .Chocomount 2" monument is located on the summit of the highest hill on Fishers Island, N.Y. about two and one quarter miles west of the Eastern end of Fishers Island and lies South 79 degrees 29 minutes 46 seconds East of North Dumpling Light in Fishers Island Sound); and RUNNING THENCE along the Westerly side of said road, South 21 degrees 3 minutes 40 seconds West 193.70 feet to a point of curve to the right whose radius is 199.48 feet and the direction of whose radius at that point is North 68 degrees 56 minutes 20 seconds West; THENCE Southwestwardly (following the arc of said curve), 248.13 feet to a point; THENCE North 87 degrees 40 minutes West, 162.34 feet to a point of curve to the left whose radius is 706.21 feet and the direction of whose radius at that point is South 2 degrees 20 minutes West; THENCE Westwardly (following the arc of said curve), 54.01 feet to a point; THENCE North 18 degrees 44 minutes 50 seconds East, 219.59 feet to a point; THENCE North 29 degrees 56 minutes 20 seconds East, 364.66 feet to a point; THENCE South 62 degrees 42 minutes 10 seconds East, 34.88 feet to a point; and THENCE South 43 degrees 36 minutes 20 seconds East, 284.88 feet to the monument set at the place of BEGINNING. TOGETHER WITH an easement for pedestrians and vehicles, as appurtenant to and for the benefit of the premises described as Parcel B above (hereinafter "Lot 4-G"), for purposes of ingress and egress to and from Lot 4-G and the private road adjoining Lot 4-G on the east and southeast, said easement being 16 feet in width and located on other premises of the party of the first part known and designated as Block 17 - Lot 4-H, Map of Fishers Island Development Corporation (Map No. A421 filed SepterTi:ler 25, 1991) (hereinafter "Lot 4-H"), and said easement having southeasterly, northeasterly and northerly limits that are more particularly described as follows: BEGINNING at a point at the northerly end of a road forty feet wide, said point being located South 68 degrees 56 minutes 20 seconds East, 20.00 feet from a monument located at the northeasterly comer of Lot4-G, said monument also being 184.98 feet North of a point which is 884.39 feet West of another monument marking the U.S. Coast and Geodetic Survey Triangulation Station "Chocomount 2"; and RUNNING THENCE North 21 degrees 46 minutes 40 seconds East, 32.19 feet to a point of curve to the left having a radius of 131.31 feet and the direction of whose radius at that point is North 85 degrees 54 minutes 07 seconds West; THENCE northerly and northwesterly, following the arc of said curve, 263.70 feet to a point on the last course described in the above description of Lot 4-G, which point is located South 43 degrees 36 minutes 20 seconds East, 71.23 feet from the point at which such last course begins. SUBJECT TO the right of the party of the first part or any future owner of Lot 4-H to terminate the aforesaid easement by filing an instrument to such effect in the Office of the Suffolk County Clerk; provided, however, that prior to so terminating such easement, the party of the first part or such future owner of Lot 4-H shall provide funds to the party of the second part or the then current owner of Lot 4-G in an amount sufficient to pay for the construction of a new driveway of comparable quality and width to the existing driveway which now serves Lot 4-G and is located in the above-described easement area as of the date hereof.
