WITNESSETH, that the party of the first part, in consideration of Seven Hundred Seventy

paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
Iymg and being-ill-lhe at Fishers Island, Town of Southold, County of Suffolk and State
of New York, being more particularly hounded and described as set forth on
Schedule A hereto.
BEING AND INTENDED TO BE the same premIses conveyed to the party of the first
part by deed dated December 10, 1999 and recorded In the Office of the Suffolk
County Clerk on January 5" 2000 In Liber 12011 page 593.
TOGETHER WITH all rIght, tItle and Interest of the party of the fIrst part in
and to the pier, wave break and boathouse lying on the above described premises
or ImmedIately to the north thereof In FIshers Island Sound, Including all
permits and approvals from governmental authorities relating thereto as the
same have been modified or amended from time to time.
TOGETHER WITH all right, title and interest of the party of the first part In
and to a driveway easement created by a Driveway Easement Agreement recorded in
the OffIce of the Suffolk County Clerk in Liber 10865 page 356 in favor of other
premises of the party of the fIrst part adjoInIng the above described premises
on the north (said other premises beIng known as and by Block 19, Lot 1-C on the
aforesaid Map of Fishers Island Development CorporatIon), it beIng Intended that
such driveway easement shall cease and terminate by the merger of title upon the
recording of this deed.
TOGETHER with all ri9ht, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

ALL that certain lot or parcel of land, with the buildings and improvements thereon, lying
and being at Fishers Island, in the Town of Southold, Suffolk County, State of New York,
said premises constituting revised Lot 1-B in Block 19 as shown on the "Map of Fishers
Island Development Corporation", which map was filed in the Office of the Suffolk County
Clerk on September 25, 1991 as Map No. A421, said revised Lot 1-B being bounded and
described as follows:
BEGINNING at an iron pipe set on the westerly side of a road 40 feet wide, said iron pipe
being 1668.40 feet West of a point which is 291.51 feet North of a monument marking the
U S. Coast and Geodetic Survey Triangulation Station "Chocomount 2" (which said
"Chocomount 2" monument is located on the summit of the highest hill on Fishers Island,
N. Y. about two and one-quarter miles West of the Eastern end of Fishers Island and lies
South 79 degrees 29 minutes 46 seconds East of North Dumpling Light in Fishers Island
Sound); and
RUNNING THENCE North 71 degrees 36 minutes 59 seconds West, 424.11 feet to the
mean high water line of Fishers Island Sound;
THENCE with the meanders of said Sound, along said mean high water line, the following
approximate courses and distances, to wit: South 89 degrees 33 minutes 20 seconds East,
129.00 feet, North 67 degrees 33 minutes 45 seconds East, 68.57 feet, North 32 degrees
02 minutes 39 seconds East, 143.75 feet, North 30 degrees 03 minutes 10 seconds West,
70.86 feet, and North 08 degrees 46 minutes 21 seconds West, 25.58 feet to a point;
THENCE South 64 degrees 13 minutes 30 seconds East, 36.00 feet to a point;
THENCE South 25 degrees 46 minutes 30 seconds West, 10.00 feet to a point;
THENCE South 64 degrees 13 minutes 30 seconds East, 347.15 feet to a point on the
westerly side of said road; and
THENCE along the westerly side of said road, South 41 degrees 10 minutes 20 seconds
West, 254.50 feet to the iron pipe set at the place of BEGINNING.
