partnership. clo Shults & Bowen, LLP, One Clearlake Center, Suite 500, 250 Australian Avenue
South West, Palm Beach, Florida 33401. attention David A. Gart, party of the first part, and Bradley
I. Collins, now residing at 1021 Park Avenue, Apt.4-C, New York, New York 10028 and James C.
Collins,. now residing at Merriewood Farm, 12384 Merriewood Drive, Somerset, Virginia 22972,
parties of the second part.
WITNESSETH, that the party of the first part. in consideration ofTen Dollars ($ 1 0.00) paid
by the parties of the second part, docs hereby grant and release unto the partics of the second part,
the heirs or successors and assigns of the parties of the second part forever, as tenants-in-common
with fifty and one-half percent (50.5 %) being transferred to Bradley I. Collins and forty nine and
one-halfpercent (49.5 %) being transferred to James C. Collins.
ALL that certain plot, piece or parcel ofland. with the buildings and improvements thereon
erected, situate. lying and being on Fishers Island, Town of South old. County ofSufTolk and State
ofNcw York. being more particularly bounded and described as set forth on Schedule A hereto.

TOGETHER WITH all right, title and interest, if any. of the party of the first part in and to
any streets and roads abutting the above described premiscs to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the prcmises herein granted herein unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
thatlhe party of the first part will receive the consideration for this conveyance and will hold the
right to rcceive such consideration as a trust fund to be applied first for the purpose of paying the
cost ofthe improvement and will apply the same first to the payment of the cost ofthe improvement.

ALL that ccrtain plot, piece or parcel ofland, situate, lying and being on Fishers Island, in the Town
of South old, County of Suffolk and State ofNcw York, being a part of that portion of Fishers Island
lying Easterly of the following line viz:
BEGINNING at the Southeasterly comer of land owned by the United Slates, known as the Fort
H.G. Wright Military Reservation, Mount Prospect Tract, on the shorcofBloek Island Sound orlhe
Atlantic Ocean; and
RUNNING THENCE Northerly following the East boundary of the said land of the United States
to the Southerly line of East End Road (sometimes called Oriental Avenue) and whieh point is the
Northeasterly comer ofland of the United States;
THENCE crossing the East End Road and following the same course as the last to the shore of West
Harbor or Fishers Island Sound;
Said lot or parcel of land being bounded and described as follows:
BEGINNING at a stone monument on the Southeasterly line of the road leading to the East End, said
monument being 814.63 feet South of a point which is 4253.31 feet West of another monument
marking the U.S. Coast Guard and Geodetic Survey Triangulation Station "Chocomount 2"; and
THENCE RUNNING along the Southeasterly line of said road South 61 degrees 36 minutes 20
seconds West. 32.00 feet to a stone monument;
THENCE South 48 degrees 51 minutes 30 seconds East, 178.60 feet to a stone monument;
THENCE South 17 degrees 47 minutes 30 seconds East, 250.90 feet to a stone monument;
THENCE South 6 degrees 12 minutes 20 seconds West. 234.20 feet to a stone monument on the
shore of Middle Farm Pond;
THENCE following the meanders of said shore line in an Easterly and Westerly and Northerly
direction about ] 250 feet more or less to a point;
THENCE North 70 degrees 32 minutes 10 seconds West. 778.18 feet to the stone monument at the
point of place of BEGINNING.
