and being at Fishers Island, Town of Soulhold, County of Suffolk and State of New York, being more particularly
bounded and described as lIet forth on Schedule A hereto.
BEING AND INTENDED TO BE a part of the premises known, shown and designated as Block 15 - Lot 8 and
Block 15 - portion of Lot t 1 on the Map of Fishers Island Development Corporation, which said Map was filed in
the Office of the Suffolk County Clerk on September 25, 1991 as Map No. A421, the party of the first part having
acquired the said Block 15 - Lot 8 and Block 15 - portion of Lolll by deed, dated May 25, 2001 and recorded in
the Office of the Suffolk County Clerk on June 11,2001, in L1ber 12123 page 255.
The party of the second part acknowledges that the parcel desaibed on Schedule A hereto does not constitute
a separate building site under the Town of Soulhold Zoning Code and that, upon the recording of this deed in the
Office of the Suffolk County Clerk, such parcel will merge with and become a part of other premises of the parly
of the second part adjoining said parcel on the west and north, said adjoining premises being known, shown and
designated as Block 15 - Lot 9 on the Map of Fishers Island Development Corporation, which said Map was filed
In the Office of the Suffolk County Clerk on September 25, 1991 as Map No. A421, said Block 15 - lolli also
being designated on the Suffolk County Tax Map as District 1000, SectIon 004.00, Block 07.00, Lot 003.003.

/YOGETHER with all right, title and Interes1, If any, of the party of the first part In and to any streets and roads
. abutting the above described premses to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part In and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, In compliance with Section 13 of the Lien Law, covenants that the party of the first
part will recelve the consideration for this conveyance and will hold the right to recelve suCh consideration as a
trust fund to be applied first for the purpose of paying the COllI of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as If It read "parties" whenever the sense of this Indenture so
requires. ,

ALL that certain lot or parcel of land, with the buildings and improvements thereon, situate.
lying and being at Fishers Island, Town of Southold, County of Suffolk and State of New
York being bounded and described as follows:
BEGINNING at a point on the southerly side of East End Road located the following two
courses and distances from a monument set on said southerly side of East End Road.
which said monument is 674.06 feet South of a point which is 399.50 feet West of another
monument marking the U.S. Coast and Geodetic Survey Triangulation Station
"Chocomount 2" (which said "Chocomount 2" monument is located on the summit of the
highest hill on Fishers Island. N.Y. about two and one-quarter miles West of the Eastern
end of Fishers Island and lies South 79 degrees 29 minutes 46 seconds East of North
Dumpling Light in Fishers Island Sound):
(1) South 84 degrees 12 minutes 20 seconds East, 306.41 feet to a point; and
(2) along the arc of a curve to the left having a radius of 308.49 feet and the
direction of whose radius at that point is North 05 degrees 45 minutes 40
seconds East, 38.32 feet to the true point of beginning; and
RUNNING THENCe South 31 degrees 50 minutes 20 seconds East. 203.89 feetto a stake
marking a point of curve to the right whose radius is 73.50 feet and the direction of whose
radius at that point i's South 58 degrees 09 minutes 40 seconds West;
THENCE southerly and southwesterly (following the arc of said curve). 141.79 feet to a
point;
THENCE South 78 degrees 41 minutes 20 seconds West, 72.47 feet to a stake;
THENCE South 05 degrees 48 minutes 30 seconds East, 199.72 feet to the shore of Block
Island Sound:
THENCE along the shore line of said Sound North 70 degrees 01 minutes 50 seconds
East, 160.46 feet to a point;
THENCE North 07 degrees 00 minutes 53 seconds West, 444.37 feet to a stake on the
southerly side of East End Road;
THENCE along the southerly side of East End Road South 74 degrees 41 minutes 50
seconds West. 30.00 feet to a stake marking the point of a curve to the right whose radius
is 308.49 feet;
THENCE still along the southerly side of East End Road (and following the arc of said
curve), 75.27 feet to the point or place of BEGINNING.
