paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns ofthe party ofthe second part forever,
ALL that certain plot, piece or parcel of land, wtth the buildings and improvements thereon ereded, situate, lying
and being at Fishers Island. Town of Southold. County of Suffolk and State of New York, being more partfcularly
bounded and described as set forth on Schedule A hereto. .
BEING AND INTENDED'TO BE the same premises conveyed to the party of the first part by deed. dated
December 23,2002 and recorded in the Office of the Suffolk County Clerk on January 12, 2003 in Liber 12228
page 022.
TOGETHER with all right. title and interest, If any, of the party of the first part in and to any streets and roads
abutting the above descrtbed premises to the center lines thereof; TOGETHER wtth the appurtenances and all
the estate and rlghtsofthe party ofthe first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever. .
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, In compliance wtth Sedlon 13 of the Uen Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consldlll'ation as a
trust fund to be applied first for the purpose of paying the cost of the Improvement and will apply the same first
to the payment of the cost of the Improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

BEGINNING at a monument set on the northerly line of the road to the East End, said
monument being located 174.22 feet North of a point which is 3001.82 feet East of a
monument marking the U.S. Coast and Geodetic Survey Triangulation Station
"CHOCOMOUNT 2"; and
RUNNING THENCE South 10 degrees 08 minutes 50 seconds East, 58.92 feet partly
along the west end of said road to an iron pipe at the shore of a pond; .
THENCE following the meanders of said shoreline South 51 degrees 52 minutes 50
seconds West, 90.72 feet;
THENCE South 48 degrees 54 minutes 30 seconds West, 86.31 feet;
THENCE South 09 degrees 46 minutes 10 seconds East, 40.84 feet;
