WITNESSETH. that the party of the first part, in consideration of Six Hundred Two Thousand Five Hundred and

and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed. daled October
21, 1999 and recorded inthe Office of the Suffolk County Clerk on November 4, 1999 in Uber 11998 page 797.
TOGETHER with all right. litle and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof: TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the' premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants thai the party of the first part has not done or suffered anything wnereby
the said premises have been encumbered in any way whalever, except as aforesaid.
AND the party of the first part, In compliance with Section 13 of the lien Law. covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the tolal of the same for any other
purpose. The word "party" shall be construed as if It read "parties" whenever the sense of this IndenllJre so
requires.

SCHEDULE A - DESCRIPTION
All that certain plot, piece or parcel of land, situate, lying and being at Fishers Island, in the Town
of Southold, County of Surrolk and State of New York, bounded and described as follows:
BEGINNING at a stone monument set on the northerly side of a road forty feet wide at the westerly
end of said road, said monument being 395.95 feet north of B point which Is Z81.09 feet east of
another monument marking the U.S. Coast and Geodetic Survey Triangulation Station
"Chocomount Z", (WhiCh said 'Chocomount Z" monument Is located on the summit of the highest
hili on Fishers Island, New York, about. two and one-quarter miles west of the Eastern end of
Fishers Island and lies south 79 degrees Z9 minutes 46 seconds east of North Dumpling light In
Fishers Island Sound);
RUNNING THENCE South 05 degrees 13 minutes 30 seconds East 41.63 feet to the southerly line of
sa Id road;
THENCE South 20 degrees 46 minutes 15 seconds West 220.82 feet to an aluminum pipe set in the
ground on the northeaste~y line of another road 40 feet wide;
THENCE Northwestwardly following the arc of a curve to the left whose radius of 108.65 feet (and
. the direction of whose radius at that point is south 36 degrees 13 minutes 15 seconds west) a
dlstan"ce of 58.77 feet measured along the arc of said curve;
THENCE North 84 degrees 46 minutes 10 seconds West along the northeasterly line of the last
mentioned road a distance of 26.45 feet to a stake;
THENCE North 26 degrees 55 minutes 00 'seconds West 320.00 feet to a stak,e;
THENCE North 00 degrees 09 minutes 30 seconds East 170.74 feet to a iron pipe on the
southeasterly line of another road 40 feet wide;
THENCE northeastwardly following the arc of a curve to the left, whose radius is 331.11 feet (and
the direction of whose radius at that point is North 19 degrees 14 minutes 20 seconds west) a
distance of 158.57 feet measured along the arc of said curve;
THENCE North 43 degrees 19 minutes 10 seconds East 153.15 feet to II stake;
THENCE Northeastwardly follOWing the arc of a curve to the right, whose radius is 28.56 feet (and
the direction of whose radius at that point is South 46 degrees 40 minutes 50 seconds east) a
distance of 25.27 feet measured along the arc of said curve to a monument;
THENCE South 05 degrees 13 minutes 30 seconds East 438.97 feet to the point or place of
BEGINNING.
