sec:ond part, does hereby grant, bargain, sell, assign and release unto the party of the second part,
the: heirs or successors and assigrul of the party of the second part forever, that dwelling unit (the
"Unit") above the plane defined by the top of the concrete foundation located on that certain plot,
pic:cc or parcel ofland situate, lying and being in the Town of South old, County of Suffolk, Stale

prepared for Walsh Park Benevolent Corporation
and filed in the Office of the Clerk of the County of
Suffolk, SUite of New York, as Map No. 8871, on
December ~!2, 1989 ("Filed Map No. 8871"),
SUBJECT TO the lDeclaration of Covenants and Restrictions recorded in the
omce of the Clerk of the County IJfSuffolk, State of New York, in Liber 10969 at Page 329 on
November 20, 1989 (the "Declaration"); and
TOGETHER with the appurtenances and all the estate and rights of the party of
the first part in and to the Unit;
TO HAVE AND TO HOLD the Unit herein granted unto the party of the second
part. the heirs or successors and assigns of the party of the second part forever.
AND the party of tile first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
wh!lever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance and
will hold the right to receive such c:onsideration as a trust fund to be applied first for the purpose
of paying the cost of the improvement and will apply the same first to the payment of the cost of
the improvement before using any part of the total of the same for any other purpose.
