HomeMy WebLinkAboutL 11871 P 432 7 t3197RICT SBCT M BLOCK LOT SUCCESSOR TRUSTEE'S DEED e 20Ci O 0 0' THIS INDENTURE, made the day of December, nineteen hundred and ninety-seven BETWEEN FLEET NATIONAL BANK, a national banking association having a place of business at 777 Main Street, Hartford, CT 06115, formerly known as Fleet National Bank of Connecticut, as Assignee of the FDIC as Receiver of The New Connecticut Bank and Trust Company, N.A., as Assignee of the FDIC as Receiver of The Connecticut Bank and Trust Company, N.A., formerly known as The Connecticut Bank and Trust Company, as SUCCESSOR TRUSTEE under agreement dated October 24, 1969, as amended by First Amendment dated April 16, 1982, made by NINA HEWITT STANLEY (also known as NINA H. STANLEY), late of the Town of West Hartford, County of Hartford and State of Connecticut, party of the first part, and TALCOTT STANLEY of 148 Westmont, West Hartford, CT 06117, party of the second part, WITNESSETH, that the party Of the first part, by virtue of the power and authority to it given, and in consideration of TEN AND NO/100 DOLLARS ($10.00), paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, all that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Fishers Island, Town of Southold, Suffolk County, New York, more particularly bounded and described on Schedule A attached hereto and made a part hereof. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights which the party of the first part has or has power to convey or dispose of by virtue of said trust or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the: cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be donstrued as if it read "parties" whenever the sense of this indenture so requires. PARCELII: BEGINNING at a point on the northeasterly line of said Crescent Avenue at a point which is north 7 degrees 30 minutes 30 seconds east 53.64 feet from said monument at the point of beginning of the above described tract, and; running thence along said Avenue line, the following two (2) courses and distances: (1) south 61 degrees 15 minutes 20 seconds east, 17.29 feet, and (2) south 66 degrees 09 minutes 30 seconds east, 272.25 feet, to lands of Fishers Island Electric Corporation; running thence north along lands of Fishers Island Electric Corporation, 12 degrees 06 minutes 30 seconds east, 70 feet, more or less, to the shore of West Harbor; running thence northwesterly along the shore line of West Harbor, 285 feet, more or less, to lands now or formerly of A. John Gada, and; running thence south 7 degrees 30 minutes 30 seconds west, 25 feet more or less, to the point of beginning. TOGETHER WITH a perpetual right of way, for the purpose of ingress or egress by foot or vehicle, or for the installation of maintenance of public service utilities in, along or over Crescent Avenue the roadway lying in front of the above described Parcel One on the north and east, over its entirety and extending out to the nearest town highway. TOGETHER WITH all right, title and interest, if any, of the party of the first part of, in and to the lands lying between said mean high water line and mean low water line of Fishers Island Sound, and to the lands lying under the waters of Fishers Island Sound, in front of and adjoining the above described Parcel Two.
