SUBJECT TO easements and rights-of-way which are hereby reserved by the party
of the first part for itself, and Its successors and assigns, and for Fishers Island
Utility Company, Inc., The I=ishers Island Electric Corporation, The Fishers Island
Telephone Corporation and Fishers Island Water Works Corporation, and their
successors and assigns, for the above ground and subsurface installation,
operation, maintenance, repair and replacement of equipment and other property
used in connection with the provision of utility services (including but not limited to
the existing sub-station and items required for the drilling of wells, the extraction of
water from wells and the f;ervicing of wells), whether now existing or hereafter
installed, over those portlcms of the subject premises as the entity installing,
operating, maintaining, replliring or replacing the equipment and other property for
the provision of a respectivl~ utility service shall in its sole and absolute discretion
deem necessary or advisable in order to provide such utility service to its customers
in a reliable manner and on an uninterrupted and sufficient basis; provided,
however, whenever the surl'ace of the ground shall be disturbed by such entity, it
shall be the duty of such entity, forthwith, at its own expense, to repair and restore
the surface of the ground Scl disturbed to subst<i1'ti'Sllly the same condition as shall
have existed before the time of such disturbance. .
SUBJECT TO an easement and right-of-way which is hereby reserved by the party
of the first part, its successors and assigns, to construct, maintain, repair and
replace a recreational path not greater than ten feet in width for use by pedestrians
and operators of non-motorized vehicles over such portion of the subject premises
as the party of the first part, its successors and assigns. shall in their sole and
absolute discretion determine.
By accepting this deed, the party of the second part, for itself and its successors
and assigns, agrees that, at the request of the party of the first part, It will cause
further instruments to be rec,orded from time to time against the premises conveyed
hereby confirming the specinc metes and bounds of any easements and rights-of-
way reserved herein.
