party of the second part,

and being at Fishers Island, Town of Southold, County of Suffollk and State of New York, being more particularly
bounded and described as set forth on Schedule A hereto.
BEING AND INTENDED TO BE the same premises convey'ed to the party of the first part by deed, dated
September 15, 1999 and reconted in the Officeofthe Suffolk CClunty Clerk on September 28, 199.} In Liber 11991

TOGETHER wnh all right, title and interest, if any, of the part)' of the first part in and to any streets and roads
abutting the above described premises to the center lines themof; TOGETHER wilh the appurtEtnances and all
the estate and rights of the party of the first part in and 10 said plremises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party ofthe fir.;! part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of lhe Uen Law, covenants thatlhe llarty of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost Ilf the Improvement and will applll the same first
to the payment of the cost of the Improvement before using any part of the to1al of the samll for any other
purpose. The wont "party" shall be construed as if It read "parties" whenever the sense of thils Indenture so
requires.

All that certain plot, piece or parcel of land, with the bui.ldings and improvements thereon
erected, situate, lying and being at Fishers Island in the Town of Southold, County of
Suffolk and State of New York, being a part of that porUon of Fishers Island known I~S the
Park, lying easterly of the following line, viz.:
BEGINNING at a point on the southeasterly corner of Iclnd now or formerly owned by the
United States, known as Fort H.G. Wright Military Reservation, Mount Prospect Tract, on
the shore of Block Island Sound or the Atlantic Ocean (I~S said tract was constitutecl prior
to the extension thereof by the acquisition of additional lands in condemnation proceedings
instituted in 1942); and
RUNNING THENCE northerly following the east boundl~ry of the said tract of land now or
formerly of the United States (as the same was constituted prior to the extension thl~reof)
to the southerly line of East End Road (sometimes called Oriental Avenue) and which point
is the northeasterly corner of said tract of land now or formerly of the United States (ciS the
same was constituted prior to the extension thereof);
THENCE crossing the East End Road and following the same course as the last 1:0 the
shore of West Harbor or Fishers Island Sound; said lot or parcel of land being bOLlnded
and described as follows:
BEGINNING at a monument on the southeasterly side l:n a private road, said monument
being 1286.90 feet North of a point which is 97.04 feet e;~st of another monument malrking
the U. S. Coast and Geodetic Survey Triangulation Station "NIN" (which said "'NIN"
monument is located near the western end of a ridge, overlooking the south shclre of
Fishers Island on the highest point between Chocomount and Mount Prospect and lies
South 45 degrees 17 minutes 26 seconds East of North Dumpling Light in Fishers 1,.land
Sound); and
RUNNING THENCE along said road line South 26 degmes 22 minutes 40 seconds West,
75.19 feet to a point of curve to the right whose radius is 405.12 feet and the direction of
whose radius at that point is North 63 degrees 37 minutes 20 seconds West;
THENCE southwesterly along said road line and following the arc of said curve, 4327 feet
to a point of curve to the left whose radius is 25 feet and the direction of whose radii us at
that point is South 52 degrees 07 minutes East (Descriptiive) South 46 degrees 16 rrinutes
36 Seconds East (Actual);
THENCE southerly along the easterly side of said road and following the arc of a said
curve, 31.48 feet (Descriptive) 36.80 feet (Actual) to a point of curve to the right whose
radius is 396 feet and the direction of whose radius at that point is South 50 degrel~s 21
minutes 30 seconds West;
THENCE southeasterly along the northeasterly side of another private road of the grantor
and following the arc of said curve, 61.85 feet;
THENCE along said road line South 30 degrees 41 minutes 20 seconds East, 30.00 feet
to a point of curve to the left whose radius is 162.72 feet and the direction of whose r.~dius
at that point is North 59 degrees 18 minutes 40 seconds East;
THENCE southeasterly along said road line and following the arc of said curve. 115.89
feet to a monument;
THENCE North 02 degrees 32 minutes 30 seconds East, 233.21 to an iron pipe; and
THENCE North 60 degrees 29 minutes 40 seconds We!;t, 107.96 feet to the point or place
of BEGINNING.
TOGETHER WITH an easement for ingress and e!~ress from the premises hereby
conveyed over and along such private roads as now are or may hereafter exist connl!cting
the premises hereby conveyed with the public highway.
