party of the first part, and JEFF GRATHWOHL and AUDREY GRATHWOHL, husband and wife, both residing
at 1'13 Arrowhead Avenue, Riverhead, New York 11901
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN and no/100ths ($10.00) dollars paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk, State of New York, bounded and described as
follows, to wit:
BEGINNING at a concrete monument located at a point on the Northerly line of the subject premises where
the westerly line of land now or formerly of J. T. Maran intersects and said Northerly line abruptly changes
direction;
RUNNING THENCE from said point of BEGINNING along the Southerly line of said land now or formerly of J.
T. Maran South 80 degrees 34 minutes 50 seconds East, 55.46 feet to a point;
THENCE South 9 degrees 25 minutes 10 seconds West, 155.92 feet to a point;
THENCE South 82 degrees 20 minutes 10 seconds West, 252.30 feet to the Easterly side of Breakwater
Road;
THENCE along the Easterly side of Breakwater Road North 7 degrees 39 minutes 50 seconds West, 150.0
feet to the Southerly line of other land now or formerly of J. T. Maran;
THENCE along the Southerly line of said other land now or formerly of J. T. Maran North 78 degrees 45
minutes 30 seconds East, 245.57 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from
Donald J. Cooper dated September 1, 1988, and recorded in the Suffolk County Clerk's Office on October 6,
1988, in Libel' 10707 cp 351.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvemant and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
