Witnesseth, that the party of the lirst part, in consideration ofTen Dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors
and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
beingmaJ'lOC at Mattituck, Town of Southold, County of Suffolk and
State of New York, known and designated as Lot No. 4 on a certain
map, entitled, "Map of Farmveu Associates," and filed in the
Office of the Clerk of Suffolk on September 1, 1989, as Map No.
8808, together with mandatory membership in the Farmveu at
Mattituck Homeowners Association, Inc. (hereinafter called the
Association).
TOGETHER with the benefits and SUBJECT to the burdens,
covenants, restr~ctions, by-laws, rules, regulations and
easements, all as set forl:h in the Amendment to Declaration
(setting forth Covenants, Restrictions, Easements, Charges and
Liens) made by the party of the first part, dated June 7, 1993,
and recorded in the Office of the Clerk of the County of Suffolk
on the 8th day of July, 1993, in Liber 11635 of Conveyances at
Page 684 and other covenants, restrictions, easements and
rights-of-way of record.
Subject to a mortgage held by Kasper 1988 Trust FIBIO Kirsten
Vanessa Kasper dated December 4, 1992 and recorded in Libc( I !?5'o:f
Page .5""';> in the original principal amount of $125,000, as
currently reduced to $25,000 plus interest thereon, which the
purchaser will assume and agree to pay,
Together with all right, title and interest, if any, of the party of the first partin and to any streets and roads abutting
Ihe above described premises to the center lines thereof; Together with the appurtenances and all the estate and
righls of the party of the first part in and to said premises; To Have And To Hold the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
And Ihe party of the first part covenants thai the party of Ihe first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
And the party of the first part. in compliance with Section 13 of Ihe Uen Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying Ihe cost of the improvement and will apply the same first to the payment
of the cosl of the improvemenl before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if il read "parties" whenever the sense of this indenture so requires.
