JAKLEVIC and ROBERTA JAKLEVIC, as tenants in entirety, residing at 900 Old harbor Road, New Suffolk, New York, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten and 00/100 -($10.00)-dollars, and other good and valuable consideration and distribution of the premises from the aforesaid Estate paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at New Suffolk, Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows: BEGINNING at a point on the southwest side of Old Harbor Road, at a concrete monument marking the northeast corner of land of Kwit, and running thence South 43 degrees 41'30" West 225.97 feet to a point at the northwest corner of said land of Kwit; running thence along lal"d of Kwit, Wickham and Lockwood through a concrete monument South 29 degrees 52'40" East 197.75 feet to an iron pipe; running thence South 87 degrees 55' 00" East 110.00 feet into Canal Number Two in School House Creek; running thence through School House Creek, the following three (3) courses and distances: (1) South 29 degrees 52' 40" East 225.68 feet; thence (2) North 85 degrees 22' 40" West 266.54 feet; thence (3) North 29 degrees 52' 40" West 286.77 feet; Running thence through a concrete monument South 87 degrees 55' 00" East 110.00 feet partly along land of Raynor to a concrete monument; running thence along land of Raynor North 29 degrees 52' 40" West 136.37 feet to land of Endemann; running thence along said land the following two (2) courses and distances: (1) South 87 degrees 55' 00" East 12.23 feet; thence (2) North 43 degrees 41' 30" East 239.83 feet to the southwest side of Old Harbor Road; Running thence along the southwest side of Old Harbor Road South 46 degrees 18' 30" East 33.00 feet to a concrete monument and the point or place of beginning. TOGETHER with an easement for driving and maintaining a well, installing and maintaining pumping equipment in the pump house on premises nor or formerly of Kwit approximately 15 feet southeast of the first course above mentioned and approximately 150 feet southwest of Old Harbor Road, and for laying and maintaining a water main from said pump house the premises conveyed herein and the northeast corner of the premises in Liber 3754, page 63. TOGETHER with all right of ways easements and privileges and subject to all covenant, restrictions and agreements of record. Subject to rights of others over the road, 33 feet in width, running from Old Harbor Road southwesterly and thence southeasterly through a portion of the premises. The parties of the second part, their heirs, executors, administrator and successors shall have a right of way and free access to all of the canals in the Harrington H. Tuthill property, known also as School House Creek Association, and to have sole use of 15 feet in the canals in front of and adjacent to the premises herein conveyed to maintain landing and docks: the parties of the second part and their grantees or successors in interest to leave a right of way for vessels to come and go freely of at least a 30 foot channel in the middle of the canals. Being and Intended to the same premises conveyed to Fritz C. Kohn and Anna E. Kohn by deeds in Liber 3754 cpo 63; Liber 6441 cpo 234; Liber 6140 cpo 404; corrected by Liber 6166 cpo 199; and Liber 7097 cpo 356; less the premises conveyed by Liber 7097 cpo 352. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive t~le consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so requires.
