Witnesseth I that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs Clr successors
and assigns of the party of the second part forever,
All that certain plot. piece or parcel of land. with the buildings and improvements thereon erected, sitlmte, lying and
being under the water of Peconic Bay in the County of Suffolk, Tawn of Southold, State of New Y_ and described
es follows:
BOUNDED on the north by Radel, east by Public Grounds, South by Elsworth, and West by Putllic Grounds,
containing 200 acres, more or less, and being known as lots 7 and Nc), 8 on map of oyster grounds made by Otto w.
Van Tuyl on June 8, 1934 for the Andrew Radel Oyster Company, Incorporated.
The same are conveyed subject to the conditions, reservations, stipulatlons. and provisions in the original grants to
the Commissioners of Shell Fishelies of Suffolk County, New YO'k, and also to the conditions, reserva~ons,
stipulations and provisions contained in any of the laws of the State of New York applicable thereto
BEING AND INTENDED TO be the same premises conveyed to the party of the fitst part he,ein by deed dated July
18, 1974 and recorded in Liber 7685 cpo 536.
Together with all right, tttle and Interest, if anY\,of the party Of the fitst part in and to any streets and roads abutting the
above described premises to the center lines Vlsreof; Together with the appurtenances and all the estate and rights
of the party of the fitst part In and to said prem..es; To Have and to Hold the premises herein granted unto the party
oflhe second part, the heirs or successors and assigns of the party of the second part forever.
And the party of the fitst part covenants that the party of the fitst part has not done or suffered anything Whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
And the party of the fitst part, in compliance with Section 13 of the Lien Law, COvenants Ihatthe party of the fitst part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the s;ame for any other purpose.
The word "party" snail be construed as if it read "parties" whenever the !~ense of this indenture so requires.
