McGoldrick Groin Extension & Dredging Proposal
Dear Mr. Herrmann:
The Department of Environmental Conservation has completed its review of the McGoldrick
proposal to extend an existing timber groin and dredge the inlet of Halls Creek in Mattituck,
Town of Southold.
We have reconsidered our previously articulated position on this project, and must now object to
the proposed extension of the groin. If extended, the groin is likely to result in the long term loss
of shoals-mudFlat /littoral zone (SM / LZ) tidal wetland area on the McGoldrick property by its
action of trapping longshore sediment on the updrift side of the structure and building the beach
seaward. Given the documented abundance of sand in this littoral cell, we expect an area of
minimum dimensions 80' x 320' or 25,600 square feet to be lost, eliminating this biologically rich
area which provides marine food production and wildlife habitat benefits.
The proposed extension of the groin will also result in a significant reduction in the volume of
longshore sediment reaching the downdrift beaches east of the creek, and will probably contribute
to the loss of beach width and elevation in this area. This loss of beach will induce future
proposals by downdrift property owners with the potential to impact natural resources, such as
the construction of new bulkheading, construction of new groins, extension of existing groins and
beach fills.
The project should be modified to eliminate the extension of the groin. The proposed dredging of
the inlet is approvable provided that all material is placed on the downdrift beach sufficiently
landward to minimize the filling of SM / LZ tidal wetland. Specifically, the discharge of the
hydraulic dredge should be located at least 15 feet landward of the line of apparent high water for
every foot in elevation the beach is to be raised (1:15 slope). Pease provide four sets of detailed
site plan and crossview drawings depicting the downdrift spoil placement to the above described
specifications.

The inlets of creeks which enter the bay in this littoral cell (Deep Hole and Halls Creeks) seem to
tend in a southeast direction. The dredged channel into Halls Creek runs in a more north-south
direction. The applicant should explore the possible alternative of relocating the dredged channel
to be on the same southeast-northwest alignment as the naturally formed creek inlet as a long
term measure to maintain the inlet.
A permit can be issued upon receipt of acceptably revised site plan and crossview drawings as
described above.

The following action was taken by the Southold Town Board of
Trustees at the regular meeting on Wednesday, April 22, 1998:
RESOLVED that the Southold Town Board of Trustees Grants an
amendment to permit #4880 to place dredge spoil to the west of
McGoldrick on the community beach of the Bayview of
Mattituck Homeowner's Assoc.; the adjacent beaches of Patrick
Scollard to the west and Martin Suter to the east would
likely receive spillover sand. Also to include maintenance
dredging of the mouth of Hall's Creek subsequent to the initial
dredge event and groin extension, as discussed during the two
public hearing s on the project; up to 1000 c.y. of sand would
be maintenance dredged as needed over a ten year period. ( to
run with DEC).
This does not constitute approval from any other agencies.

The following action was taken by the Board of Town Trustees
during its Regular Meeting held on March 25, 1998, regarding the
above matter:
WHEREAS, NEIL MC GOLDRICK, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated February 6,
1998 and,
WHEREAS, said application was
Conservation Advisory Council
recommendations, and
referred to the Southold Town
for their findings and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 25, 1998, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning-this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW, THEREFORE BE IT
RESOLVED, that the Board of Trustees approves the application of
NEIL MC GOLDRICK to hydraulically dredge an irregular area
55+/-' (max. width) through the inlet of Hall's Creek to a
max. depth of 5' below MLW at a 1.3 slope. Approx. 2,000
c.y. of 1008 sand spoil to be pumped 1) up drift of existing 80'
groin on subject property and 2) down drift of groin at end of
Dean Drive to east. Extend existing 70' groin on west side of
inlet by 80' and that applicant do an elevation survey of 2
existing groins on his property and one on the east side that
extends out into the Bay, before project is started.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete protect will expire two vears
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months~of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

The following action taken at a meeting of the Southold Town Conservation
Advisory Council held Monday, March 23, 1998:
No. 1535 (Tabled 2/23/98)
Moved by Scott Hilary, seconded by Kenneth Meskill, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Wetland Permit Application of NEIL McCOLDRICK 116-4-16.4 to
hydraulically dredge an irregular area (+/-55' max. width) through the inlet of
Hall's Creek to a maximum depth of -5" at MLW at a 1:3 slope; approximately
2000 c.y. of 1000 sand spoil to be pumped:
1. updrift of existing 80' groin on subject property and
2. downdrift of groin at end of Dean Drive to east.
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Permit Application of NEIL McGOLDRICK
116-4-16.4 to extend existing 70' groin on west side of inlet by 80'.
The Council recommends disapproval of the groin. It has not been proven
that extending the groin would improve the situation.

Thank you for submitting your information to the Department of State (DOS) for the above referenced
project. Pursuant to 15 CFR 930.58, the following data and information is necessary to enable the
Department of State to adequately assess the coastal zone effects of this proposed project.
From the submitted site plan it is uncleaz as to who owns the property and underwater lands where the
proposed work is planned for. Please submit additional information which cleazly identifies the applicants
pazcel and its boundaries. With that information, include the adjacent pazcels and the associated owners
names. Was permission to place the dredged material secured from the appropriate landowner? If so,
please provide documentation.
It appeals that over time, the sedementaion of Hall's Creek will reoccur. Please elaborate how an
additional 80' of jetty, as proposed, would address the accretion issue in Hall's Creek. In that elaboration,
identify the anticipated increase of sand capacity updrift of the proposed jetty extention, and haw long the
proposed jetty extension would be effective.
Please identify what alternatives to the proposed project were considered. Include a discussion as to why
those alternative are not feasible.
Please provide the information requested above to the bepartment of State within thirty days from the date
of this letter. Pursuant to 15 CFR 930.64(d), if this necessary data and information is not provided, the
Department of State may object to your consistency certification on the grounds of insufficient information.
The Corps of Engineers cannot issue a permit for this project unless the Departrnent of State concurs with

site. Applicant needs to supply better location directions; also the council
has questions concerning the dredging and the extension of the groin.
