3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/1 0 of I % lead.
5. ConU11ercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
. d. Upon approval ofthis application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of South old, Suffolk County, New York, and other applicable Laws, Ordinances or

SEaRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's Ust of Actions,
without further steps under SEQRA.
PROPERTY FACTSIDESCRIPTION: The applicants' 24,807 square foot parcel with 102.03feet along Summit
Drive. The property is Improved with a two-story. single-family house. as shown on survey prepared by
Joseph A. Ingegno dated April 10, 2000, updated March 16. 2006.
BASIS OF APPLICATION: Request for a Variance under Section 100-30 A.3 based on the Building
Inspector's March 30, 2005 Notice of Disapproval conceming a request to amend Building Permit No. 29780-z,
for approval of construction that exceeds the code limitation of 2-1/2 stories, as built.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred pursuant to Suffolk County
Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning replied on
February 13, 2007 stating that the application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 29, 2007, at which lime
writtan and oral evidence were presented. Based upon all testimony, documentation, personal Inspection of
the property. and other evidence, the Zoning Board fmds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant requests relief from the determination issued by the
Building Inspector concerned the 'as built floor area" and stating that the dwelling does not constitute three (3)
stories. For the record,
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The pians depict a 2% story home, Including garage in the area below grade
which encompasses about two-third of the entire as-built basement floor area. The neighborhood consists of
hilly slopes. Photographs were submitted by applicant's attorney of severai homes with similar designs and
hillsides.

2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than a variance. Tha new dwelling was constructed wHh 2% stories pursuant to plans submitted
under a building permH issued 7/18101, revised 9/5/03 (also file ref. BP# 29700-z). In reviewing the record, a
full grading plan from all elevations was not evailable, howevar, during Inspections under the building permit, it
was found that the finished grade did not conform to the zoning code requirements for a half-story, although
consisting mainly of occupancy as a garage, storage areas, and a small percentage of the overall living area.
Based on the information given, the grading exceeded the maximum allowable by approximately eight (8%)
percent. The applicant's attorney confirmed that the lower area will remain as built, without expanding the
floor area and without a third story. The owner will maintein the proposed use of approximately two-thirds of
the lower story, mainly for garage and storage purposes, and the remaining floor area use, as permitted under
the building permit #29700-z.
3. The variance granted herein Is substantial. After viewing the record and the homes in the neighborhood of
nearby hillsides, the Board determined that the relief grented for tha building, as exists, is the maximum that
they would allow for use of floor areas equivalent to the floor area nolad in plans submitted under building
permit #29700-z.
4. The difficulty has not been self~ated. Backfilling would not be able to be completed to meet the code
percenteges because the foundation is covered with earth, placing a larger percentege of the proposed half
story below grade, exceeding code requirements, and the floor area remains the same as that shown on the,
interior floor plan. ' ,
5. No evidence has been submitted to suggest that a variance, in this residential community will have an
adverse impact on the physical or environmentel conditions In the neillhbOrhood.,
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of backfilling the foundation, while preserving arid protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Oliva, and duly
carried, to
GRANT the variance as applied for, as shown on the survey prepared by Joseph A. Ingegno, Land
Surveyor dated April 10, 2000, updated March 16,2006 and elevation plans prepared by Jeffrey T.
Butler, P.E. dated January 16, 2007.
Any deviation from the variance IIlven such as extensions, or demolitions which are not shown on the
applicanfs diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject property that may violate the Zoninll Code, other than such uses,
setbacks and other features as are expressly addressed In this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that
does not increase the degree of nonconformity.
