WHEREAS, a public hearing was held in the Matter of the Application of MARK A. SQUIRES, Appeal No. 3378, and r.oncluded on August 8, 1985, and WHEREAS, the board members have considered all testimony and documentation entered into the record in I:his matter, and it is noted that there has been no opposition; and WHEREAS, the board members are personally familiar with Lhe premises in question and the surrounding properties; and WHEREAS, the board made the following findings of fact: 1. By this application, appellant requests permission t.o locate an inground 30' by 60' swimmingpool on a vacant parcel which would be accessory to their residence, abutting the parcel in question on the ~.out:h. 2. The vacant parcel in question is known as Subdivision Lot 356, Nassau Point Club Properties, Inc., and is identified on the County Tax Maps as District 1000, Section 111, Block 6, Lot 5. 3. The residence of the applicar!t to which this pool is accessory is known as Subdivision Lot 357, Nassau Point Club Properties, Inc., and is identified on the County Tax Maps as District 100(1, Section 111, Block 6, Lot 6. 4. Also to be erected is a fence enclosure around the pool of a pernranent chainlink or similar-type material of not more than two-inch mesh, at a height of four fret, provided with a self-closing, self-latching gate to prevent unauthor- ized use of the pool and to prevent accidents. The pool is to be incidental to the and accessory to the residential use of the 'adjoining premises and not operated for gain. In considering this appeal, the board has found that this project should be granted as conditionally noted below since: (1) the relief requested will not he detrimental to adjoining properties and will be used accessory to and incidental to the residential use of the adjoining premises, and not fcr gain; (2) the relief requested is not substantial in relation to the requirements of zoning, under the circumstances; (3) there will be no substantial change in the character of this dirt!°ict; (4) the relief requested will not cause a substantial effect of any increased population density since the property will continue to be used only as permitted by Article•III, Section 100-30; circumstances are unique. the Accordingly, on motion by Mr. Sawicki, seconded by Mr. Douglass, it was RESOLVED, that the re]ief requested under Appeal tJo. 3378 in the MatY.er of the Application of MARK SQUIRES for permission Lo locate inground swimniingpool with fence enclosure on vacant lot as an accessory use to his residence adjoining the subject Premises, BE AND HERE6Y IS APPROVED SUBJECT TO THE FOLLObJING t.~ - / 1. Southold New York Please find enclosed the forms you sent to me along with my check for $50.00 to cover the cost of the permit, and the C.O. for the Gazebo. When I purchased this unit I asked about the necessity of a permit. I was told that since this is not a permanent structure, and can be easily removed, it did not require one. I also checked with a local attorney who stated that since it is not a permanent structure, it probably did not require a permit, but he felt if the town wanted one, it would be in my best interests to comply. Obviously, the town has some type of an ordinance regarding Gazebos. I did not try to circumvent the town nor its authority to do its job. The gazebo is complete, and can be "inspected" at your earliest convenience.
