A regular meeting of the Southold Town Planning Board was
on Tuesday, January 30, 1979, at 7:30 p.m. at the Town Hall,
Road, Southold, New York. Present were:
Vice-Chairman Henry E. Raynor, Jr.

7:30 p.m. Public Hearing on the matter of the approval of the
map of the minor subdivision of property of Felix Deerkoski and
Peter Deerkoski. Mr. Deerkoski was present at the hearing. Mr.
Raynor read the legal notice of hearing and presented proofs of
publication in the L. I. Traveler-Watchman and the Suffolk Times.
Mr. Raynor: It is a minor subdivision and the Board received the
sketch plan layouts on 10/25/78. The approval of the sketch plan
was given on November 27th and the secretary sent a letter with
the resolution of approval. Applicatien fee was paid and six
copies of the final map were supplied to the Board on December 19,
1978. The official submission was the 9th of January and the
public hearing is being held tonight. It was not sent up to the
Suffolk County Planning Commission because it does not fall under
their jurisdiction. Going through the file, I have the covenants
and restrictions and it is noted that the declarant represents
that the remainder of the lands will not be subdivided unless as
a major subdivision. It is subject to the granting of the Board
of the minor subdivision of the property in question. We have
the application and it is noted the fee has been paid. We have
correspondence to the applicant dating back to the month of
November 1978. The property in question fronts on the town road
presently and, therefore, there is no need for bonding for
additional improvements. As is the procedure with the Board at
a public hearing, we will ask if there is anyone present this
evening who would like to speak in opposition to the subdivision.

Hearing none, I would ask if there is anyone present that would
like to speak in favor of the subdivision of Felix and Peter
Deerkoski. Mr. Deerkoski, would you like to say something.
Mr. Deerkoski: I would like to see it approved.
Mr. Raynor: Is there anyone present this evening that has some
information in regard to this minor subdivision that should come
before the Board at this time? (The members had no comments to
make) There being no further discussion, I will declare the
hearing closed.
Mr. Henry Lytle and Mr. Richard Winters appeared at the meeting
and stayed a short while. Mr. Winters inquired as to whether
Southold Commons was on the agenda. It was.not.
Pe~.er Sled~eski minor subdivision. Frederick Tedeschi, Esq.,
appeared. This subdivision had been before the Board before and
after a public hearing and a conditional approval, Mr. Sledjeski
withdrew his application. Mr. Tedeschi would like to continue
where it ended without going through the public hearing again.
Mr. Raynor would like to check with the Town Attorney to see if
this is legal. Mr. Tedeschi stated there would be a 15 foot
right-of-way on the westerly line of the property. This had been
a bone of contention with Mr. Sledjeski in the past. Mr. Tedeschi
will present six maps of the subdivision to the Board.
Jean Jones minor subdivision of property. The Board directed
that Mrs. Jones be requested to send six copies of sketch map
to the Board showing the division she proposes. The minimum
side yard from the existing house should be 15 feet.
Scott Ben site plan. Mr. Wickham had reported to the secretary
that he had inspected the trees on the property and they were
not worth saving. A decision has to be made as to whether they
stay or go.
Mr. Coyle made a motion that the trees remain and something
else be done with the building. Mr. Wall seconded the motion.
Discussion followed and when a vote was called, Mr. Coyle voted
aye, Mr. Wall voted aye, Mr. Gordon voted nay and Mr. Raynor
abstained stating that the Board should take a further look at
the trees. Mr. Raynor requested that Mr. Coyle withdraw his
motion and Mr. Wall withdraw his second and the matter be tabled
for further inspection. Ail were agreeable.

North Fork EQuities. Richard Cron, Esq., and Robert Gillispie III
~peared. This is the former Dawn Estates - Kaplan property. Mr.
Cron presented 12 copies of sketch maps for a proposed five lot
subdivision. When questioned as to the owners of North Fork Equities,
Mr. Gillispie replied that he was and John Dempsey. Mr. Raynor
questioned the possibility of improving Maple Lane and Mr. Cron
said they couldn't improve it because it didn't belong to them
and they could not trespass. The Board will review the maps.
Mr. Wall made a motion, seconded by Mr. Gordon and carried
to approve the minutes of the regular meeting of the 9th of
January, 1979, with the amendment on page 13 regarding Long Pond
Estates, Section I that it should be Article III rather than s
Article II.
On motion made by Mr. Gordon, seconded by Mr. Coyle, it was
RESOLVED to approve the map of the minor subdivision of
property of Felix Deerkoski and Peter Deerkoski and authorize the
vice-chairman to sign the map.
Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall
On motion made by Mr. Wall, seconded by Mr. Coyle, it was
RESOLVED to approve the preliminary map of the subdivision
to be known as "Sebastian's Cove~ Section I" subject to the
following:
1. Resolution of the recommendations of Lawrence M. Tuthill,
Town Engineer, in which he recommends that a field survey be made
to correct the obvious errors in the contours and profiles due to
the inaccuracies of aerial photogrammetric surveys in heavily
wooded areas.
2. Recommendations of the Superintendent of Highways in
which he recommends a spur to the east off Sebastian's Cove Road
at the intersection of lot #6. He would also like more discussion
on the road leading to the creek.
3. Recommendations of the Suffolk County Department of
Planning which have not been received as of now.

Planning Board -4- January 30, 1979
At the request of John Davis, Planning Board Inspector,
a meeting will be held at the office of the Supt. of Highways
on Wednesday, February 7, 1979 at 10:O0 a.m. regarding the
roads and drainage in the subdivision to be known as "Oysterponds
Village". Invited to attend the meeting will be the Highway
Committee, Councilman Homart and Justice Surer; Planning Board
members who can attend; Mr. Davis; Lawrence M. Tuthill, Town
Engineer; and Supervisor Martocchia. At 9:00 a.m. there will be
a meeting with Mr. Wandoloski and Howard Young regarding the
drainage in the subdivision "Heritage Harbor" owned by Riverside
Homes. Howard Young would also like to discuss with Mr. Tuthill
and Supt. of Highways Dean the recommendations of Mr. Tuthill
regarding Bayview Woods Corporation. This will also take place
at 9:00 p.m.
The Board reviewed the two plans submitted by Mr. Thornton Smith
and would like to make a further inspection of the property to
determine which would be the better way to develop it.
On motion made by Mr. Wall, seconded by Mr. Gordon, it was
RESOLVED to approve the map of minor subdivision of property
to be conveyed to Rev. William H. Hilliard and authorize the
vice-chairman to sign the map.

On motion made by Mr. Coyle, seconded by Mr. Wall, it was
RESOLVED to request a completion report of items to be
done before the bond is released in the subdivision known as
"Country Club Estates" from John W. Davis, Inspector.
Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall
The Planning Board will not make recommendations on the release
of a bond until a report is obtained from the inspector in which
he states that all items are completed and he recommends the
release of the bond.
Mr. GQrdon made a motion, seconded by Mr. Wall and carried
to accept and approve the report of Mr. John Davis, Inspector,
as regards the fencing in the subdivision known as "Inlet East
Estates".

A letter has been received from the Fishers Island Utility Co.
regarding two pieces of property which they own on Fishers
Island. Because it is two separate parcels they can sell one
but not as a casual sale because it is not in the family. There
is no objection to the sale of lot #4. If they want to divide
lot #4 (1000-03-7-4) the applicant will have to file for a minor
subdivision. This information is to be transmitted to the Fishers
Island Utility Comapny, Inc.
On motion made by Mr. Coyle, seconded by Mr. Wall, it was
~ESOLVED to approve the map of the minor subdivisions of
Folly Beach Limited (C. Edmonds Allen) and Peter Kreh and
authorize the vice-chairman to sign the map.
Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall
Discussion was held on the site plan of Mr. Lawrence Kirk
of Fishermen's Rest. Mention was made of plantings along the
east boundary and along the stockade fence. Mr. Coyle and Mr.
Gordon will make an inspection of the property and make
recommendations to the Board.
The next meeting of the Board will be held on February 13,
1979. There being no further business to come before the Board,
Mr. Coyle made a motion, seconded by Mr. Gordon and carried to
adjourn the meeting. Meeting adjourned at 9:15 p.m.
