GORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765-1938 A regular meeting of the Southold Town Planning Board was held on Monday, March 5, 1979 at the Town Hall, Main Road, Southold, New York. Present were: John Wickham, Chairman Henry E. Raynor, Jr., Vice-Chairman Frank S. Coyle, Member Frank Bear, North Fork Environmental Council (9:00 p.m.) Millicent Gossner, League of Women Voters Douglas Love, L. I. Traveler-Watchman Absent were: Frederick E. Gordon James Wall Thomas and Jean Jones minor subdivision. This minor subdivision of two lots was discussed. On the final map it will be necessary to show spot elevations, sketch in edge of the salt meadow, number lots, note on the map there will be no further subdivision, send in fee, application and legal description of the property. The Board will require written covenants and restrictions that the property will not be further subdivided which will be recorded in the Suffolk County Clerk's Office. On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to approve the sketch map of the minor subdivision of property of Thomas and Jean Jones located at Cutchogue. Vote of the Board: Ayes: Wickham, Raynor, Coyle The Environmental Assessment Form will be sent to the Building Inspector, George Fisher, for his determination as to what other agencies should be notifed and who should be lead agency. Planning Board -2- March 5, 1979 Julius Zebroski. Laurie Dowd, Attorney, appeared. She presented a map. T~e property is dredged fill. The Board will require contours and elevations. An Environmental Assessment Form will be sent for completion. There are five lots in the subdivision so it will have to be a major. Ms. Dowd told of a plan to casual sale one lot and come in with the rest for a four lot minor. She was told this can't be done as there can only be four lots in a minor subdivision. Mr. Wickham suggested she go to the Board of Health regarding the chance of having cesspools. Mr. Wickham doesn't feel the necessary spaoe between wells and cesspools is there. Murphy-Raeburn minor subdivision. Laurie Dowd, Attorney, appeared. There has been a court order dividing the property into three pieces. It was originally two in joint tenancy. Mr. Raynor requested that the maps show building setback lines and setback lines from the top of bluff of 100 feet. The 65,000 square foot lot will require a covenant not to be further subdivided and a notation on the map. There was a question, after reviewing the deeds, that the easterly lot did not have a right-of-way to the road, On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to authorize the expenditure of $50 or whatever it may cost to engage Van Tuyl surveyors to provide the Planuing Board with a suggested proposed road from Cummins property east in Orient. Vote of the Board: Ayes: Wickham, Raynor, Coyle Mr. Wickham reported that he had not yet had a conference with the Town Attorney regarding the proposed division of the Haven Emerson property. Mr. Wickham reported that Mr. Robert Gillispie, Chairman of the Board of Appeals, had called him regarding five different actions the Board of Appeals had taken. They have granted the privilege of dividing into three lots the Hartung property and Mr. Gillispie said something like this wouldn't slip by the Board of Appeals again. In addition, the state SCS has been giving Mr. Wickham a bit of a problem. He needs to repair his dikes and the dikes are the only thing that is keeping salt water off land immediately north of the Village of New Suffolk. The only thing that keeps New Suffolk from having salt water intrusion problems and if he had failed to ~ake the necessary arrangements, there could be problems not only with that but emergency vehicles Planning Board -3- March 5, 1979 vehicles getting to New Suffolk in case of a hurricane. He felt the population density in the Village of New Suffolk is by virtue of those dikes on private property over which the town, county and state have no authority. The population density in the Village of New Suffolk is a very critical matter and should be so considered. Mr. Gillispie thanked Mr. Wickham and said it was something the Board of Appeals could hang their hats on in the future. There are over 100 acres that would be flooded by salt water if those dikes were broken and New Suffolk would immediately be in a critical state. Mr. Wickham informed the Planning Board that he has copies of letters from Lee Koppelman and others on this subject recommending to the Suffolk Co~mty Agricultural and Stabilization Committee and Suffolk County Soil and Water Conser- vation District that every effort be made to assist in repairing those dikes. Mr. Raynor reported that he and Mr. Gordon had met on February 26th with the Fire Chiefs' Council. There were some suggestions made with regard to subdivision regulations, in particular, Fire hydrants and/or well~ in subdivisions, and there was the suggestion of the Fire Chiefs~ Council subject to approval by the Fire Commissioners that the Planning Board make some changes with regard to the number "3__~0" which is the dwelling unit number for hydrant and/or well. They want this included in the subdivision regulations as a bonded item. It was suggested that the subdivisions would come for recommendations to the District's Board of Commissioners and they in turn would forward any recommendations to the Planning Board. They would like in the regulations the word "bronze screening" be deleted and it be "stainless steel screening". Mr. Raynor is submitting this for the ~-~a'r8 and suggesting it be forwarded to the Town Attorney for his consideration. Mr. Raynor reported as a representative of the Planning Board on the airport committee. After a number of meetings, the committee has completed a set of recommendations with regard to the proposed airport and within the next week to ten days there will be a rough draft for submission to the Planning Board as well as the Town Board. Moebius minor subdivision (formerly Mothersele Estate) Richard Lark, Esq., and Janet Melot appeared. Mr. Lark explained that this is a rather unique situation where it is a rather large area in an area of small lots. There were various ways of dividing this property which were discussed and no decision was reached by the developer or her attorney on how to proceed. Planning Board -~- March 5, 1979 Lawrence Kirk site plan. Richard Lark, Esq. and Steve Tsontakis appeared. The driveway has been changed to the extreme east of the property. Mr. Wickham said they will need drainage for a 6 inch rainfall. He also felt the two houses are so old that it would be out of keeping to have a brick walk in front. He thinks it should be kept in grass as long as it is going to be kept in residential. Mr. Raynor inquired about the existing dwellings and Mr. Lark said he had talked to the building inspector and he had said it was a pre-existing use. Mr. Tsontakis will send in a revision and detailed planting schedule. On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to forward the map of "Richmond Shores at Peconic" to the Southold Fire Commissioners and request their rec'ommendation on the placement of a fire well in the subdivision. Vote of the Board: Ayes: Wickham, Raynor, Coyle Whitcom Investment Corporation. Richard Cron, Esq., appeared. The ~-8-~-w-~ require covenants and restrictions that none of the middle land can be developed. The area can be released upon receipt of covenants and restrictions that it can never be resubdivided also. No action will be taken until receipt of the above items. North Fork Equities. Richard Cron, Esq., Mr. Robert Gillispie III and Mr. Dempsey appeared. They are now thinking in terms of a four-lot minor subdivision. Mr. Raynor said cross-circulation would still have to be provided even if it is a minor by either reserving or building a 50 foot area across the parcel. Mr. Cron questioned the feasibility of constructing an east west road. There didn't seem to be a problem with reserving for it as long as the to~n would put it in at a future date if it wanted it. Mr. Cron questioned going into a private road with a cross road. The reservation will be placed between Snug Harbor and Wiggins Lanes in the vicinity of lot 85. cC~Utchogue Joint Ventures. Richard Cron, Esq., appeared. Mr. ron presented a possible cluster of the lots which the Planning Board reviewed. Mr. Raynor questioned lot 15 with a gutter right through the middle of it. Talked about moving the 50 foot road west on the other side of lot 15. Between lots l0 and ll the highway frontage is 35 feet instead of 50 where in the future there could be access. Mr. Cron questioned this as this is open space. Mr. Wickham was not impressed with the cluster the way it was laid out. If it went to the north he felt it might be a good idea. Mr. Raynor did not like the location of lots 14, 15 and 16 and thinks they should stay away from that location on the property. Planning Board -5- March 5, 1979 The Board wants to make another inspection of the property. Mr. Raynor requested that lot 14 be staked. Soundwood Farm. Richard Cron, Esq., appeared. He said he was going to present to his client the idea of possibly having a four-lot minor subdivision on the sound with only two lots having beach rights. O~d To~n Park. James Bitses, Esq., appeared. On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to approve the sketch map of the subdivision to be known as "Old Town Park" owned by Catherine Bitses and located at Southold, New York, subject to a joint 25 foot driveway being placed between lots 2 and 3, the existing driveway being used for lot 4 and lot I having access only from the 50 foot right-of-way. Vote of the Board: Ayes: Wickham, Raynor, Coyle Mr. Frank Bear made the following report on a meeting he attended the past weekend. He and Mr. Wickham attended a three-day work- shop sponsored by the Conservation Foundation and funded by the EPA, all expenses paid, for the purpose of waste water management training program. He got to know a lot of people who could be helpful one way or another for advice and suggestions and benefit of their experience in regard not only to waste water management but sludge disposal and solid waste. What excited him the most was alternate methods of handling all kinds of wastes not just by dumps or burning or other methods we ~now about. There are methods being tried in different places and in Europe. These methods will be a lot cheaper than the usual method of building big plants and at the same time would be recycling. The local situation would have to be studied. Mr. LaRow from DEC has some knowledge and expertise and he would be willing to come to this town on the invitation of the Town Board to discuss possible alternatives and possibly be willing to speak at a public meeting where the public could get a feeling of what this might be about. There was a yo~mg fellow from EPA who talked about how EPA is coming out with new regulations which would consolidate or integrate different methods that would include solid waste, waste water, air pollution. Funding could amount to as much as 85% from the Federal Government not counting what might be obtained from the State. Mr. Wickham said he was invited directly from Albany. Mr. Wickham would like to recommend that he and Mr. Bear be designated by the Planning Board to present this idea to the Town Board for its consideration and ask Mr. LaRow to come to Southold. Planning Board -6- March 5, 1979 On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to designate Frank ~ear and John Wickham to present to the Southold Town Board that the Town of Southold invite Mr. William Co LaRow, P. E., Assistant Chief, Bureau of Sewage Programs, Division of Pure Waters of the New York State Depart- ment of Environmental Conservation to present the idea of an integrated approach to its waste water, cesspool sludge, solid waste and disposal area problems. Vote of the Board: Ayes: Wickham, Raynor, Coyle The Planning Board acknowledged receipt from the Village of Greenport of petition of Vector Yardarm Corporation to amend Chapter 85 of Zoning Ordinance to allow waterfront aondominiums. Also included are various notices in regard to this hearing. Peter Sled~eski minor subdivision. Mr. Gordon is ill and has not presented his report in regard to the width of the right- of-way in this subdivision. On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to accept and approve the conditions of the Suffolk County Planning Commission in regard to the subdivision to be known as "Paradise-by-the-Sound", located at Greenport, New York, and owned by John Rath. Vote of the Board: Ayes; Wickham, Raynor, Coyle The Southold Town Planning Board reviewed the plan of Mr. and Mrs. Eric Bergman to purchase the house including one acre of property from Marlake Associates (formerly Stelzer Estate). The Planning Board has determined that filing for a minor subdivision would be a hardship in this instance and as long as zoning requirements are met 150 foot front and one acre of property - there would be no objection to this land being parcelled out. Notification is to be sent to Mr. and Mrs. Bergman and the building inspector, George Fisher. Mr. Schriever's letter regarding radius curves in his subdivision was reviewed by the Board and it was the board's finding that they should be put in as per the request of the Suffolk Co,muty Department of Planning. Planning Board -7- March 5, 1979 On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to send the map of the subdivision to be known as "Orient Hills" to the Soil and Water Conservation District for its determination as to the advisability of swale construction for the roads and drainage. Vote of the Board: Ayes: Wickham, Raynor, Coyle motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to set 7:30 p.m., Tuesday, March 27, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the map of the minor subdivision of ~hilip and Sharon Ofrias. Vote of the Board: Ayes: Wickham, Raynor, Coyle On motion made by Mr. Raynor, seconded by Mr. Coyle, it was RESOLVED to grant final approval to the site plan of S_~cott-____Ben subject to a one-year review by the Planning Board. Vote of the Board: Ayes: Wickham, Raynor, CoYle The Planning Board is in receipt of a letter from Benjamin Kasper regarding the possible extension directly east of Oregon Road and whose expense it might be. The construction of the road would be the sole responsibility of the developer. If the subdivision is to be five or more lots, the roads would have to be constructed according to the Highway Specifications of the Town of Southold, a copy of which m@y be obtained from the Town Clerk. There being no further business to come before the Board, Mr. Coyle made a motion, seconded by Mr. Raynor and carried to adjourn the meeting.
