APPLICATION FOR CERTIFICATE OF OCCUPANCY
A. This application must be filled in by typewriter OR ink and submitted to the building)
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept, of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non -conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

RICHARD R. TERRY, residing at 87 Nash Street, Lake Placid, New York 12946, being
duly sworn, deposes and says:
1. That I have been asked by Attorney Abigail A. Wickham to provide an affidavit as
to my knowledge of a two -unit multiple dwelling located on the property of William
Zebroski, 415 Oaklawn Avenue, Southold, New York (SCTM4 1000-61-3-5).
2. I was born on April 23, 1949 in ELI Hospital in Greenport, New York and during my
first 18 years resided at 285 Oaklawn Avenue, Southold, New York in a house owned by
my parents, Rensselaer and Rebecca Terry. That residential property was and still is
located directly contiguous with (north of) the subject Zebroski property.
3. I can state that during the time I resided in my parents' home (at least during the
period 1954-1971) the residential structure in question on what is now the Zebroski
property was always used as a two -unit multiple family dwelling. In the 1950's and
1960's Ben and Ethel Nagel resided in the second story unit, and Mr. and Mrs. Clarence
Conklin resided in the first story unit. Each unit had separate entrances and to my
knowledge constituted separate dwelling units.
4. My mailing address is P.O. Box 584, Lake Placid, New York 12946. I am employed
by the NYS Adirondack Park Agency as a staff attorney. If there are further questions, I
