A regular meeting o£ the Southold Tow~ Pla~aning Board was
held at 7:30 p.m., Tuesday, March 27, 1979 at the To~m Hall, Main

7:30 p.m. ?ublie Hearing on the questiom of the approval of the
minor subdivisiom of property of Philip O£rias, Jr., and Sharon
O£rias. Philip O£rias, Jr., Esq. appeared.
Y~r. Raynor read the legal notice of hearing and presented proofs
of publication from the Suffolk Times and the L. I. Traveler-
Watchman.
~_r. Raynor: This is a minor subdivision of two lots. We have in
the file check from the applicant along with the application for
approval of plat signed and notarized. We have copies of the map,
proof of publication in the L. I. Traveler-Watchman, schedule of
covemants with regard to the real property described and
correspondence from the board to the attormey. As this is a mimor
subdivision of two lots and abuts an existing town road, there is
no report from the Superintendent of Highways with regard to this
subdivision. As is the policy with this board, we will ask if
there is anyone present this evening that would like to speak in
opposition to this subdivision of property of Philip 0£rias.
Hearing nome, is there anyone present that would like to speak
in favor of this subdivision.
~_r. Ofrias: Our purpose is it doesn't prove to be very saleable
the way it is and by separating the house on 1-1/4 acre a~d the
other 1-1/~ acre with the barn may be more marketable. We would
rather sell it the way it is. Ou~own feeling is it would detract
to divide it but it depends on the buyer.

Mr. Raynor: The board also notes with the covenants there is a
clause that the present applicant make no further application for
subdivision of this property. Usually we have a standard form
covenant and I think probably you may have included it all.
Mr. Ofrias: I spoke with Bob Tasker before preparing it and he
felt it would be appropriate.
Mr. Raynor: Fine. In review of the map I see one kind of glaring
feature and that is that the parcels are not numbered.
Mr. Coyle: Mine has numbers.
There was further discussion here and it was determined that Mr.
Van Tuyl had sent one copy of th~amended map. This map was the
one Mr. Coyle had with the numbers on it.

Mr. Gordon: The ordinance calls for a 50 foot setback and 150
feet at the building line. You would lose a little bit here.
Mr. Raynor: The building lot would have to be back in here.
Mr. Gordon: I should have picked that up on preliminary. In
other words~ the building line would be 50 feet back.
Mr. Ofrias: You are right. If you go back at all it will be less
than 150 feet.
Mr. Raynor: The building inspector would probably insist the house
be spotted in there.
Mr. Gordon: He might give you a hard time.
There was more discussion back and forth on this item.
Mr. Raynor: The setback line is going to have to be shown. We
are dealing with a two lot minor. This could be dotted in.
Whatever action the board would take would be subject to the
setback line being shown. We are just alerting you you might have
a problem in the future as far as the building inspector is
concerned. It is probably not critical. Is there any member of
the board that has anything they would like to add with respect to
this applicant.
Mr. Coyle: It is a beautiful estate to be cut up. My map shows
that there should be no further subdivision which should be part
of the record.
Mr. Raynor: We will have to have five more copies with the numbers
on them.
Mr. Ofrias: Anything he does now will have the numbers.

Y~r. Ray, or: They will have to be filed with us. Does anyone
else that is present have any i~formation that is pertinent to
the application being heard. Hearin~ none, I will declare the
hearing closed.
Michael Morris Estate. Marge Malone and Terri Elak appeared.
~rs. Malone said she had talked with the building inspector about
access and he had said something about 280A of the Town Law. She
has been informed that Longboat Lane will be 804 completed by the
end of the year. F~r. Ray, or suggeste~ they endeavor to get use
over the existin~ road (Longboat ~ane] as the right,of-way is
extremely long and would be costly to construct and maintain.
There will also have to be a right-of-way across the bottom of
the lots. It will be necessary to have a written agreement with
the developer of Soundview Acres at Orient. 100 foot setback
from the top of the bluff will have to be shown. The right-of-
way on the bottom of the lots must be 25 feet wide.
Mr. Raynor made the following report regarding his meeting on
Friday, March 16, 1979 with the ~ecutive Committee of the Tire
Chiefs Council and Fire Commissioners Council. The meeting was
held at the Cutchogue Firehouse.
In Article 106-33B it was suggested that the following sentence
be remoYed "there shall be a minimum of one fire hydramt and/or
£ire well for each 30 dwelling lots shown on the subdivision map."
Remove the word "bronze screen" and insert "stainless steel
screen" was recommended. The 350 gallon per minute pumping
capacity figure should remain.
It was also recommended that the 8 inch casing a~d 20 foot
minimum length on screen be left in specs for fire well. It was
requested that the Pla~ing Board supply a map to the respective
£ire district commissioners and recommendations would be forth-
coming within thirty days from said fire commissioners. It was
agreed that the district commissioners would be able to meet within
the thirty day response period so that a recommendation could be
back to the Planning Board within this time frame. Final
determination of fire hydrant and/or fire wells will naturally be
a Pla~nin~ Board decision.

Gentlemen:

The Southold Town Fire District Officers Association would
like to recommend the following changes and additions to the
regulations for Subdivisions pertaining to requirements for
firewells for your consideration.
E~iminate the number of dwellings required for each firewell.
The determination as to the need for fire protection should be at
the discretion of the fire district involved.
Location of firewells should be determined by the Officers
of the ~ire District.
A map of the proposed subdivision should be sent to the
Commissioners of the Fire District. The Fire District will respond
within 30 days as to the need of firewells.
The well should be at least 8 inch minimum, 20 foot stainless
steel screen minimum, mesh to be determined as to type of strata
encountered: should produce 350 GPM.
Final testing and approval by the Board of Commissioners
with notifications of acceptance to the Planning Board.

Y~r. Raynor feels that this should be taken under consideration
as well as some of the ideas that were worked on in January and
sit down with the Tovrn Attorney soon and work out what should be
put in the Code. The decision of where the fire hydrants and/or
firewells should be has to come from the Planning Board but the
Fire Commissioners have more experience and the Board should try
to utilize their suggestions and recommendations. Y~r. Wall was
asked how this would affect Fishers Island and he said they go
overboard and had the equipment to take care of this and wouldn't
be in need of fire hydrants or firewells.
Charles Witherspoon minor subdivision. Stanley Corwin, Esq.
appeared.
Both lots are oversized so the board would require restrictive
covenants so there would be no application for resubmission. Y~r.
Corwin was asked if there would be any objection to a covenant
that there be no further subdivision of the parcel directly to
the west of number 1. ~r. Corwin said he didn't feel he could
make that representation fo~he owner. Then he said he could
give a covenant not to subdivide the adjacent piece. TheBoard
will take the sketch map under consideration and give some
determination with regard to it.

~ 9/17/7b plan presented by Mr. Walsh is no longer valid.
Mr. Corwin is willing to go along with a two lot minor and a
restriction that any further subdivision would be ~ajor
subdi¥ision. The lots will have to be numbered and the Board
will get back to Mr. Corwin.
Sebastian's Covet Section I. The following letter was forwarded
to the Board from Mr. Start Pauzer ofthe Soil and Water Conservation
District in Riverhead.
Dear Stan:
We need the following information to develop specific
drainage recommendations for the "Sebastian's Cove, Section One"
Subdivision:
1. an accurate topographic map with 2-foot contours (1-foot
contours would be more desirable).
2. soil profiles of the test holes.
3. design details of the catch basins planned for
Sebastian's Cove Road.
plans for development and stabilization of the playground
area.
Unless we can obtain this information, only general comments
be developed.

A letter is to be written to Mr. Toumanoff enclosing these
recommendations telling him that the Soil and Water Conservation
District wants more information and nothing can be done until
such information is forthcoming. The Planning Board will forward
information to the District upon receipt of same. The Board will
also not process this application any further until such time as
Mr. Toumanoff lets the Board know what his plans are for Sections
II and III.
Lon~ Pond Estates? Section One. The Board has received a letter
from the Dept.of Environmental Conservation as to designation of
lead agency in this matter.
On motion made by Mr. Coyle, seconded by Mr. Wall, it was
RESOLVED that the Southold Town Planning Board inform the
New York State Department of Environmental Conservation that it
does not wish lead agency status forthe subdivision known as
"Long Pond Estates, Section One". ThePlanning Board has alreadY_s
had final hearings with regard to this application and the proce~

involved with the town is in its final steps. There£ore~ it would
be inconsistent for the Plan~ing Board to desire lead agency status.
Vote of the Board: Ayes: Raynor, Coyte, Gordon, Wall
Fontana - George Friedman appeared. YLr. Friedman was advised that
]~-~tana should come in for a four lot minor subdivision with a
25 foot right-of-way. There should also be access to ~attituck
Creek for the lot owners on the road. ~ir. Friedman will return.
Mr. Coyle made a motion, seconded by Mr. Gordon andtoarried
that the request of Peter Bhreh to have the right-of-way to his
property named Kreh Road be granted.
On motion made by ~'. Gordon, seconded by Mr~ Coyle, it was
RESOLVED to over-ride the condition of/the Suffolk County
Planning Commission as regards the subdivision of Peter Sledjeski
in that a 50 foot right-of-way be provided for the following
reason. ~e Stillo minor subdivision is an approved pre-existing
minor subdivisio~ in the Town of Southold with a 30 foot right-
of-way and it would make no sense to run a 50 foot right-of-way
into a 30 foot right-of-way.

On motion made by Itt. Coyte, seconded by ~dr. %,~al]., it was
RESOLVED to grant approval to the sketch map o£ the minor
subdivision of Peter SledOeski subject to a 15 foot right-of-way
being shown on the westerly side of the property for Rose and
securing of a curb cut from the State o£ New York.

On motion made by Mr. Wall, seconded by Mr. Gordon, it was
RESOLVED to set 7:30, Monday, April 16, 1979 at the Town Hall,
Main Road, Southold, New York, as the time and place for a public
hearing on the question of the approval of the minor subdivision of
property of Thomas and Jean Jones.

~. Raynor announced the the Natural Resource Class from ~attituck
Cutchogue High School will be at the town hall on Thursday to
find out something about subdivisions. Any board members that
can be at the TownHall are welcome.
Mr. Raynor announced a meetin~ at the Supt.of Highways office
with regard to Greenbriar Acres roads. This meetin~ will be held
Wednesday morning at 8:30 a.m.
Southold Savings Bank has requested an inspection of its property
with regard to the site plan which was approved by the ?tannin~
Board. ~. Gordon will make the inspection on Thursday and report
back to the board.

Motion was made by Mr. Coyle, seconded by ~.%r. Gordon and
carried to accept and approve the report of John W. Davis
regarding the minor subdivisions of Hale and Hushes.
The Orient Hills report from the Soil and Water Conservation
District was received and reviewed and will be forwarded to the
developer.
The Board has received an invitation from L. I. Planners to
attend their meeting this week. The secretary will write a letter
and state that we have an interest in this organization but will
be unable to attend.

On motion made by I~. Coyle, secmnded by Ym. Wall, it was
RESOLVED to recommend to the Southold Town Board release of
the bond for the subdivision "Ore$on View Estates" as per
recommendation of the Plannin~ Board Inspeotor, John W. Davis.
Vote of the Board: Ayes: Raynor, Coyle, Gordon, Wall
Idr. Wall will check and see whose responsibility it is to fix
Crescent Avenue on Fishers Island. He sees no problem with a
two lot minor of the property that lit. Walsh proposes.
On motion made by Ym. Gordon, seconded by YLr. Coyle, it was
RESOLVED to approve the sketch map of the property of
Charles Witherspoon for a two-lot minor subdivision subject to
covenants for the property on the westerly side that it will not
be further subdivided.

On motion made by ~. Gordon, seconded by Pit. Coyle, it was
RESOLVED to approve the map of the minor subdivision of
Philip Ofrias, Jr. and Sharon Ofrias subject to numbering of the
lots.

carried to approve the minutes of the regulsr meeting of February
13, 1979.

5, 1979.
