GORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765-19~ A regular meeting of the Southold Town Planning Board was held on Monday, April 16, 1979 at 7:30 p.m. at the Town Hall, Main Road, Southold, New York. Present were: John Wickham, Chairmanl Henry E. Raynor, Jr., Vice-Chairman Frank S. Coyle, Member Frederick E. Gordon, Member Arthur and Millicent Gossner, League of Women Voters Supervisor Albert M. Martocchia (first 15 minutes) Troy Gustavson, Suffolk Times (first half hour) Absent was James Wall (inclement weather) Walter $illeck appeared to discuss a minor subdivision of his property on the Main Road in Cutchogue. The lots will be over- sized and covenants will be required that the land will not be further subdivided. He will have to inquire of the State Department of Transportation as to the curb cut. Mr. Martocchia thanked Mr. Wickham for his unselfish hours put in bringing the plan for development along gradually and remarked that Mr. Koppelman of the County Planning Commission has said that Southold is way ahead of the other towns in its development plans. Mr. Martocchia said this comes from good leadership and good backup people. This is Mr. Wickham's last meeting before retiring from the Board and he said it has been a real opportunity for him to serve the Town of Southold. Tesoriero. Robert Celic, real estate person, represented Mr. Tesoriero at the meeting on his proposal to put in a minor subdivision on the Bay for property he wishes to acquire off Main Bayview Road in Southold. The seller is holding out a half acre parcel for himself and selling the rest to Mr. Tesoriero. The Board will require a covenant to run with the land that the rest of the parcel will be developed as a major development when it comes in. Planning Board -2- April 16, 1979 Moebius minor subdivision. Richard Lark, Esq., appeared on behalf of the developers of the Agnes Mothersele Estate. This subdivision has to be made subject to the action of the Board of Appeals regarding the lot that is undersized in area. On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board of Appeals approval of the request for a variance for a lot of insufficient area in the minor subdivision of Hoebius. All of the lots in the area are of much smaller size. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Raynor, seconded by Mr. Gordon, it was RESOLVED to grant approval to the sketch map of the minor subdivision of property of Moebius subject to action of the Board of Appeals granting a variance on the undersized lot. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Richmond Shores at Peconic. (Cummins) Richard Lark, Esq., appeared. A review was made of the recommendation of the Southold Fire Commissioners as to the location of the firewell. It was decided that it should be placed on the southeast corner of the recharge basin. A hearing will be set on the final map upon receipt of same. Thornton Smith. Richard Lark, Esq., appeared. Mr. Smith's property was not chosen in the Phase I of the Suffolk County Farmland Acquisition Program. He decided not to enter it in Phase II and prefers to develop it. There was a long discussion on whether the open land in the cluster should be considered for use as farmland or as use for recreational purposes by the residents within the subdivision. Mr. Wickham stated that the ordinance says the preferred use in a cluster subdivision is agricultural. Land for agriculture in 15 or twenty years will be worth about $5,000 an acre. It is also possible, he said, to sell the open land for farming. Mr. Smith said he had spoken with Mr. Dean about the possible acquisition of property along Sound- view Avenue by the Town in order to widen and straighten this area because of the accidents there and to provide drainage in the area. Mr. Raynor will confer with Mr. Dean regarding this matter. Kirk property. Mr. Wickham discussed this with Mr. Lark as Mr. Lark is the attorney for Mr. Kirk.Mr. Wickham said it is clearly stated that there will be screening on the west side of the property. He said by just looking at the apron it appears the only screening possible would be a stockade fence. He said it looks like the whole curb cut is where the screening should be. There is no provision for planting. Mr. Wickham said his family Planning Board -3- April 16, 1979 will not accept the approved site plan and is prepared to sue. East End Insurance. Edward Boyd, Esq., and Wayne DePetris appeared. This property lies between Mignon's and the Southold Fire Dept. The Board wants to see what the Building Inspector has to say regarding the parking. It will be necessary to have the elevations for the building. They will need a curb cut from the N.Y.S. Dept. of Transportation. Lighting should be provided within the property lines. Russell B. Case minor subdivision. Mr. Coyle was insistent on finding out what other property Mr. Case owns. Mr. Case owns other properties in the vicinity but they are in corporations with different parties. The secretary will contact the DEC as to how to handle these matters as pertains to the SEQRA act. A & P. Philip Cardinale appeared on behalf of his brother Allen. Mr. Cardinale would like to enclose the alleyway to make a bigger store just east of the A & P. There has been some degree of vandalism but the main reason is that they are presently negotiating for a principle tenant who wants to be just east of the A & P. Mr. Raynor stated that the owners had overbuilt originally. The building area should be computed as a percentage of the total lot area and See how it comes out. Imput will be requested from the Fire Dept. as far as the alleyway is concerned. ~aqinn. These people are contemplating purchasing the Madzelan property at the end of Harbor Lane in Southold. They would like to subdivide it into three lots. The Planning Board would like to see elevations of the property and the edge of the meadow shown on a map. On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to grant final approval to the map of the subdivision to be known as "Southold Gardens" and authorize the chairman to sign the map. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Planning Board -4- April 16, 1979 On motion made by Mr. Coyle, seconded by Mr. Raynor, it was RESOLVED to approve the site plan of Drell Corporation dated February 9, 1979 subject to a one-year review by the Planning Board. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to set 7:30 p.m., May 8, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of Peter Sledjeski. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to set 7:45 p.m., May 8, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of Thomas and Jean Jones. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to set 8:00 p.m., May 8, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of Katherine Bitses to be known as Old Town Park. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to set 8:15 p.m., May 8, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on i~h% question of the approval of the minor subdivision of property of Charles Witherspoon. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon Planning Board -5- April 16, 1979 The recommendation of the Southold Fire Commissioners regarding the placement of the firewell in the Bayview Woods Corporation subdivision was reviewed. The Board decided the firewell should be at the southeast corner of Lot 5 on Road A. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED that the inspection has been made of the Southold Savings Bank and the work done complies with the approved site plan as revised. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED to grant a ninety day extension of time in which to present final maps for the subdivision to be known as "Bayview Farm" owned by Peter Blank. Vote of the Board: Ayes: Wickham, Raynor, Coyle, Gordon The Board reviewed the request of Philip Ofrias,Jr., Esq., to divide a piece of business property owned by Lizza & O'Connell. Mr. Raynor will contact the town attorney on the proper way to handle this matter. A request has been received from Mr. Chen regarding a piece of property that he has held out from a larger piece that is now in the Suffolk County Farmland Acquisition program. The Planning Board has no objection to this but will request a covenant that the property will not be resubdivided. Mr. Chen will have to go to the Board of Appeals for approval of access. Reese. The Planning Board directs that the Environmental Assessment Form be sent to the Southold Town Conservation Advisory Council for its determination as to significance. There being no further business to come before the Board, Mr. Coyle made a motion, seconded by Mr. Gordon and carried to ad~ourn the meeting.
