A regular meeting of the Southold Town Planning Board was held
at 2:00 p.m., Friday, August 17, 1979 at the Town Hall, Main Road,
Southold, New York.
Present were:
Chairman Henry E. Raynor, Jr.
Frederick E. Gordon
James Wall
Bennett 0rlowski, Jr.
Peter Boody, Suffolk Times
Celia Vitale. Rudolph Bruer, Esq., appeared. It will be necessary
to have an affidavit of ownership with regard to interested parties
in the corporation. The right-of-way should show 150 frontage for
Lot #1. There will be no right-of-way construction required on this
150 feet.
On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was
RESOLVED to approve the sketch map of the property of Celia
Vitale located at Bayview, Southold, said map dated July 24,1-~9.
Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski
On motion made by Mr. Orlowski, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency in regard to the State Environmental Quality Review
Act in the matter of the minor subdivision of property of Celia
Vitale.
Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski

On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board declare itself
lead agency in regard to the State Environmental Quality Review Act
in the ma~ter of the minor subdivision of property of North Fork
Equities, Inc.
Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski
On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was
RESOLVED to approve the sketch map of property of North Fork
Equities~ Inc. located at Greenport, said map amended June 25, 1979,
subject to approved corner markers shown on plat.
Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski
On motion made by Mr. Wall, seconded by Mr. Orlowski, it was
RESOLVED to approve the site plan of Fishers Island Development
Corporation~ Inc. for the construction of multiple dwelling to house
employees, said site plan dated July 10, 1979.
Vote of the Board: Ayes: Raynor, Gordon, Wall, 0rlowski
~harles S. Witherspoon (Minor subdivision ~160) The Planning Board
reviewed the restrictions to be placed on the westerly lot outside
this subdivision. The restriction was not contained in declaration
and Mr. Stanley Corwin, attorney for Mr. Witherspoon, is to be
informed of same.
Mr. Orlowski moved for the adoption of the following. Mr. Gordon
seconded the motion.
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below, has determined that the project
will not have a significant effect on the environment.
pESCRIPTION OF THE ACTION
The minor subdivision of Charles S. Witherspoon is a two-lot
residential subdivision on 2.500 acres at Southold, New York (#163)
The project has been determined not to have a significant
effect on the environment for the following reasons:

An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned;
The project does not lie within the jurisdiction of
the Tidal Wetlands Act due to distance of tidal water;
The Suffolk County Department of Health Services has
stated that a precursory review of the project indicates
that adequate sewage disposal and water supply facilities
can be installed;
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land regulations.

This notice is to be sent to Commissioner Flacke, Supervisor
Homan, Lewis Edson, Roy L. Haje, NYSDEC, Royal R. Reynolds, SCDHS,
George Fisher, Sr. Building Inspector and will be posted on the Town
Clerk's Bulletin Board.
Mr. Gordon moved for the adoption of the following. Mr. Orlowski
seconded the motion.
WHEREAS, a formal application for the approval of a subdivision
plat, entitled Minor Subdivision of Charles S. Witherspoon (#163)
was submitted to the Planning Board on May 9, 1979, and an
application fee in the smount of $20 was paid on June 25, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and plat at the Town Hall in Southold, New York on
July 23, 1979 at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application.
Now, therefore, be it RESOLVED, that the application of Charles
S. Witherspoon (#163) for approval of said subdivision plat
prepared by Roderick Van Tuyl, P.C., and dated May 4, 1979 and
amended May 22, 1979 be approved and the Chairman of the Plsnning
Board is authorized to endorse approval on said subdivision plat.

Thornton Smith subdivision. Mr. Smith snd Richard Lark, Esq.,
appeared. The Board had reviewed the four maps submitted by Mr.
Smith and prefer the cluster concept received by the Board
November 20, 1978, map dated September 19, 1978. There were
several suggestions made, one of which was that lots 38 and 39
be left for open space and another that the road be relocated to
the vicinity of lots 44 and 45. It would not be necessary to have
a road built to the open space to the east. This could be reached
by footpaths. Mr. Smith will get back to the board when he has a
new drawing.
Woodhollow Properties. Walter Uhl. Mr. Lark appeared on behalf of
Mr. Uhl and stated that the work should be completed by September
20, 1979. They will be looking for bond release at that time.
Robert Krupski. Mr. Krupski appeared with a sketch of property on
the Sound which is the northernmost of the properties of Alexander
Zanieski, Josephine Zanieski, Sarah M. Garvey Estate, Henry
Domaleski and Vincent J. & Helen P. Krupski. The Planning Board
would like to see what the intention is for the rest of the
property.
Whitcom Realty. Richard Cron, Esq., appeared. The applicant is
prepared to deed the center part of the property to Nature
Conservancy if they will accept it. He presented the deed to the
property on the road which has already been deeded out. An
Environmental Assessment Form will have to be completed for the
Board.
Sunset Bluffs (Nina Stevens). Mr. Cron presented 6 final maps and
~ preliminary maps of this subdivision.
.Wells Estate. The Board will require that a key map be shown on
the map presented and an affidavit of ownership.
On motion made by Mr. Orlowski, seconded by Mr. Gordon, it was
RESOLVED that the Southold Town Planning Board hereby consents
to the amendment of the preliminary subdivision plan of Greenbriar
~cres dated April 16, 1979 as agreed to by Superintendent of High-
ways Dean in letter of July 24, 1979 subject to the following
recommendations of John W. Davis, Planning Board Inspector:

1. An additional oatch basin with drainage rings be installed
at the low point on Birchwood Road (westerly curb line).
2. Installation of 18" CMP line from C.B. #1 to C.B. #3 on a
0.50% grade instead of 0.30% grade as shown.

This resolution is to be forwarded to the Supt. of Highways and
the Town Board Highway Committee, for information only.
On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was
RESOLVED to set 8:30 p.m., Tuesday, September ll, 1979 at the
Town Hall, Main Road, Southold, New York, as the time and place
for a public hearing on the question of the approval of the minor
subdivision of property of O'Connell and Lizza located at Mattituck.
Vote of the Board: Ayes: Raynor, Gordon, Wall, Orlowski
Cleaves Point, Section 4. (Dawn Estates Shopping Center) This
matter will have to go to the Board of Appeals for a variance on
Lot #4 as it is undersized. An affidavit of ownership will be
necessary. An Environmental Assessment Form will be sent to Mr.
Kaplan.
Zena aud Rhoda Kaplan. The Board will want to know the development
plaus for the rest of the parcel. Lot 3 is not a legal building lot.
A meeting will be set up with Mr. Kaplan and Mr. Kontokosta so this
matter can be resolved.
Mr. Ted Dowd's request to use swales in place of curbs on Sea-Aire
Lane in Sea-Aire Estates will be referred to Supt. of Highways Dean
as per 106-25B of the Rules and Regulations for the Subdivision of
Land.
Kenneth Strachan. The Planning Board has determined that this is
a casual sale within the family and not in the jurisdiction of the
Planning Board. The Board has no objection to the setting off of
this piece of property.

Motion was made by Mr. Orlowski, seconded by Mr. Gordon and
carried that the minutes of the meeting of July 23, 1979 be approved
subject to the vote of the board being entered on page 6 for the
action on the revised site plan of Sea Breeze Village. This was
recorded as Ayes: Raynor, Gordon, Orlowski.
There being no further business to come before the Board, Mr.
Wall made a motion, seconded by Mr. Orlowski and carried to adjourn
the meeting. Meeting adjourned at 4:35 p.m.
