Present were: Henry E. Raynor, Jr., Chairman Frederick E. Gordon, Member Bennett Orlowski, Jr., Member G. Ritchie Latham, Jr., Member Franklin Bear, North Fork Environmental Council George Penny IV minor subdivision (Jennings Estate). George Penny IV, Robert Johnson and Lewis Edson appeared. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of property of George Penny IV. Vote of the Board: Ayes: Ray-nor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED to grant approval to the sketch map of the minor subdivision of George Penny IV dated October 15, 1979 subject to the following: 1. Monument be placed on the southeasterly corner of the property. 2. Access to Lot i be shown as a 25 foot right-of-way over Lot 2 rather than a flag lot. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Planning Board -2- October 29, 1979 On motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of property of John C. and Frank J. Diller. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board grant approval of the sketch map of the minor subdivision of property of John C. and Frank J. Diller, said map dated October 13, 1979. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to set 8:30 p.m., Wednesday, November 14, 1979, at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of John C. and Frank J. Diller located at Peconic. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham Rush M. Forquer, Jr. and Elizabeth F. Forquer minor subdivision. Rudolph Bruer, Esq. presented a tentative proposal for dividing property comprising over 14 acres into four lots. The Planning Board would like to review this property in conjunction with the entire area. Celia Vitale. Mr. Bruer appeared with a request to change the 25 foot right-of-way to the rear lot to 20 feet. There was a mixup in that the contract on the property shows 20 feet. The Board will review Mr. Bruer's request later in the evening. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED to over-ride the following condition of the Suffolk County Planning Commission for the subdivision of property of James M. O'Connell and Philomena Lizz~. Condition #3. No approval of the subdivision shall be given until the question of the potential creation of a new crossing at the northerly terminus of the proposed right-of-way or the relocation of the existing crossing is satisfactorily resolved with the Long Island Rail Road as at-grade crossings present problems of potential hazards, liability, and maintenance. Planning Board -3- October 29, 1979 The reasons for the over-ride are as follows: 1. The crossing has existed for over twenty years. 2. The proposed subdivision is entirely south of the rail- road crossing. At the time the northerly portion of the property is developed the crossing will be taken into consideration along with the 50 foot right-of-way. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Mr. Orlowski moved for the adoption of the following resolution. Mr. Latham seconded the motion. WHEREAS, a formai application for the approval of a subdivision plat, entitled Minor Subdivision of James M. 0'Connell and Philomena Lizza, was submitted to the Planning Board on September 16, 1979, and an application fee of $20 was paid on September 16, 1979, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on October 18, 1979 at 8:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application except as noted below. Now, therefore, be it RESOLVED, that the application of James M. O'Connell and Philomena Lizz~ for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C. and dated July 3, 1979 be approved subject to the following modifications, and that the Chairman of the Planning Board be authorized to endorse approval on said subdivision Plat upon compliance by the applicant with such modifications as noted below. However, if such modifications are not made within sixty days from the date of this resolution, the plat shall be deemed disapproved. Modification of said Plat to show the following conditions of the Suffolk County Planning Commission: A short radius curve (R=20') shall be required at the northwest corner of Main Road and the right-of-way to provide for turning movements should the right-of-way eventually be come a road. Adequate stormwater drainage structures shall be constructed within each lot and the right-of-way to retain on-site all stormwater resulting from the development and improvement of the site so that it does not flow into the State road right-of-way. 3. The triangular parcel having an area of 0.099 acre shall be incorporated into parcel on its easterly side. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Planning Board -4- October 29, 1979 On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to over-ride the following condition of the Suffolk Cotuuty Planning Commission for the subdivision of property of North Fork Equities, Inc. Condition #3. A short radius curve (recommended radius: 20 feet) shall be required at the southeast corner of Main Road and Maple Lane to facilitate turning movements and to help improve sight distance. The reason for the over-ride is that the radius curve should not be required at this time because Maple Lane road bed is privately owned. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Mr. Gordon moved for the adoption of the following. Mr. Latham seconded the motion. WHEREAS, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of North Fork Equities, Inc. was submitted to the Planning Board on August 6, 1979, and an application fee of $40 was paid on August 6, 1979, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on October l, 1979 at 7:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application, Now, therefore, be it RESOLVED, that the application of North Fork Equities, Inc. for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C. and dated October 15, 1979 be approved and that the Chairman of the Planning Board be authorized to endorse approval on said subdivision Plat. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Praetorius. The following deficiencies were found in the minor subdivision of property. 1. Lot numbers are not shown. 2. The map is drawn to the incorrect scale. It should be 1" = 100'. 3. A field survey has not been done on the property. Corner monuments are not shown on map. 5. There is no legal description of the property provided.~ Planning Board -5- October 29, 1979 On motion made by Mr. 0rlowski, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Plauning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of property of Roger H. and Richard J. Praetorius. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham On motion made by Mr. 0rlowski, seconded by Mr. Latham, it was RESOLVED that the following notation be placed on the final map of the Minor Subdivision of Moebius Associates in order to comply with the condition of the Suffolk County Planning Commission. "No stormwater runoff shall be allowed to flow into East Road from any lot in this subdivision." Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham Mr. 0rlowski moved for the adoption of the following resolution. Mr. Latham seconded the motion. WHEREAS, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of Alice F. Milliken, was submitted to the Planning Board on August 22, 1979, and an application fee of $20 was paid on August 22, 1979, and WHEREAS, a public hearing was held on the said subdivision application and plat at the Town Hall in Southold, New York, on October 18, 1979 at 8:00 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application. Now, therefore, be it RESOLVED, that the application of Alice F. Milliken for approval of said subdivision plat prepared by Chandler, Palmer & King and dated August 1979 be approved subject to the following modifications, and that the Chairman of the Planning Board be authorized to endorse approval on said subdivision Plat upon compliance by the applicant with such modifications as noted below. However, if such modifications are not made within sixty days from the date of this resolution, the plat shall be deemed disapproved. Modification of said Plat to show the following conditions of the Suffolk County Planning Commission: 1. Erosion and sedimentation control measures be required during and immediately after construction on either lot. Planning Board -6- October 29, 1979 2. Pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of Alice F. Milliken is a two-lot minor subdivision of 8.61 acres located at Fishers Island. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned; The New York State Dept. of Environmental Conservation states that the state has no jurisdiction under either the Tidal Wetlands Act or the Freshwater Wetlands Act. The property is located more than 300 feet from Tidal Wetlands. The adjacent Freshwater Wetlands is smaller than 12.4 acrees and therefore state rules and regulations do not apply. The Suffolk County Department of Health Services has indicated that a precursory review indicates that public water is available and there would be no objection to the installation of individual sewage disposal facilities provided test holes indicate soil and groundwater condi- tions are suitable. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land regulations. Homan and the Building Inspector. A copy will be posted on the Town Clerk's Bulletin Board. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The New York State Department of Environmental Conservation has stated that state jurisdiction ends at the top of the bluff. The Suffolk County Department of Health Services has not replied in the allotted time indicating that there is no objection from that department. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land regulations. Murray located at Cutchogue. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Planning Board -8- October 29, 1979 On motion made by Mr. Latham, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of property of William L. and Muriel A. Murray. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham Mr. 0rlowski moved for the adoption of the following. Mr. Latham seconded the motion. WHEREAS, a formal application for the approval of a subdivision Plat, entitled Sunset Bluff Estates, was submitted to the Planning Board on September 12, 1977, and an application fee of $175 was paid on September 12, 1977, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on October l, 1979 at 8:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application except as listed below. Now, therefore, be it RESOLVED, that the application of Nina A. Stevens for approval of said subdivision plat prepared by Young and Young and dated August l, 1979, be approved subject to the following modifications, ~nd that the Chairman of the Planning Board be authorized to endorse approval on said subdivision Plat upon compliance by the applicant with such modifications as noted below. 1. Modification of said Plat to show the following: The following conditions of the Suffolk County Plauning Commission shall be placed on the map: A. No sanitary disposal facility shall be installed or constructed within 100 feet of the top of the bluff. No stormwater runoff resulting from the development and improvement of the shorefront lots of the subdi- vision shall be discharged down the face of the bluff in any manner. C® No grading shall be permitted within 50 feet of the top edge of the bluff except that that may be necessary to control or remedy erosion or to direct stormwater from flowing over the edge of the bluff. De Clearing and cutting of vegetation within 50 feet of the top of the bluff shall be limited to that necessary for maintenance. Planning Board -9- October 29, 1979 Ee Access to the beach shall be by means of a suitable structure designed and constructed in a manner that will result in the least disturbance of the stability of the bluff. F. Access to the beach shall be restricted to a single somm~uity access structure. 2. Receipt of bond for improvements in amount approved by the Town Board. 3. Receipt of inspection fee in the amount of Four percent (4%) of the approved bond. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to request that Lawrence M. Tuthill, Town Engineer, prepare a bond estimate for the improvements in the subdivision to be known as Sunset Bluff Estates. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to approve the request of Rudolph Bruer, attorney for the Minor Subdivision of Celia Vitale to decrease the width of the right-of-way from 25 feet to 20 feet. Unbeknown to the attorney, the conveyance stipulated 20 feet and the Board feels it would be a hardship to require the 25 foot width. The maps must be corrected and presented to the Board for signature. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. 0rlowski, seconded by Mr. Gordon, it was RESOLVED to approve the site plan of Knights of Columbus ~ouncil Hall, Marian Council #3852 subject to the following to be shown on the plan: 1. Existing zoning use. 2. Five-foot contour data. 3. Designation of paved and grassed areas. Landscaping and screening on side yards. 5. Proposed outdoor lighting shown. Planning Board -lC- October 29, 1979 6. Recommendations of the Planning Board Inspector being followed to provide adequate drainage of the site. 7. Side yard planting schedule. 8. Change in pitch of the driveway. It cannot pitch to Depot Lane. The Planning Board does not object to the issuance of a building permit with the understanding that the principles will present an amended site plan within 60 days. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham The condition of the Suffolk County Planning Commission for the approval of the Minor Subdivision of the Estate of George Wells designated as Condition #4 "A conservation easement shall be obtained over that portion of the subdivision that is designated as meadow on the map to insure its preservation in its natural state." was reviewed by the Planning Board. It was the consensus of the Board that Mr. Herbert Wells should sign a statement for the Board, said statement to be included in deeds of transfer to read as follows. "That portion of the subdivision that is designated as meadow will remain a scenic easement and will be preserved in its natural state in perpetuity." The report of John W. Davis, Planning Board Inspector, regarding the completion of work in the subdivision "Pebble Beach Farms" was reviewed. It appears that a release of the bond is in order if a property owners association has been formed. A letter is to be written to Rudolph Bruer inquiring about same. The Board of Appeals and Building Inspector are to be informed that as far as the Planning Board can determine in reference to the Minor Subdivision ~ of Peter Warren, this is an accepted subdivision by the Town of Southold. Therefore, any changes of the right-of-way within the subdivision comes under the jurisdiction of the Plarming Board. The Planning Board has informed the Building Inspector of this in letter dated October ll, 1979 approving revision in the right-of-way. The Planning Board Inspector will make recommendations as to the improvement of the right-of-way. There being no further business to come before the Board, Mr. 0rlowski made a motion, seconded by Mr. Latham and carried to adjourn the meeting.
