Jr. Southold, N.Y. 11971 TELEPHONE 765- 1938 A regular meeting of the Southold Town Planning Board was held at 7:30 p.m., at the Town Hall, Main Road, Southold, New York, on December 17, 1979. Present were: Chairman Henry E. Raynor, Jr. Vice-Chairman Frederick E. Gordon Member Bennett Orlowski, Jr. Member G. Ritchie Latham, Jr. (8:05 p.m.) Jack Ryan, Suffolk Times Franklin Bear, North Fork Environmental Council Absent was: Member James Wall Cleaves Point~ Section IV. Ted and Zena Kaplan appeared. On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was RESOLVED to disapprove the sketch map of the minor subdivision of property to be known as Cleaves Point, Section IV, for the following reasons: me Lot i has au existing non-habitable building with insufficient side and front yards. Lot 2 has three existing non-habitable buildings one of Which has an insufficient front yard and two of which have insufficient side yards. e Lot 3 has four existing non-habitable buildings, one of which has insufficient front yard and two of which have insufficient side yards. Lot 4 has insufficient area and an existing non-habitable building with insufficient front, rear and side yards. Planning Board -2- December 17, 1979 Vote of the Board: Ayes: Raynor, Gordon, Orlowski Mr. William B. Smith appeared before the Board with regard to property of Charles Gagen at Gagen's Landing, Southold, which had received an area variance from the Board of Appeals in 1973. Attorney Rensselaer Terry, Jr. was in the office earlier in the week and informed Mr. Raynor that he would get a written decision on this matter from Town Attorney Tasker. Mr. Smith will deliver to the Board a copy of the DEC permit. Maher minor subdivision. The Board will require six maps drawn to t-~equired scale of l" = 100'. On motion made by Mr. Orlowski, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the minor subdivision of property of Thomas F. and Margaret M. Maher. This is an unlisted action. Vote of the Board: Ayes: Raynor, Gordon, Orlowski Praetorius minor subdivision. The following note was received from the Dept. of Environmental Conservation. "This proposed action does not conform to tidal wetland development restrictions which require a minimum of 40,000 square feet on proposed lots in unsewered areas. NYS DEC approval is required of all new subdivisions of land extending into tidal wetlands and areas adjacent to them. No application has been received. Forms will be sent." All processing on this applica- tion has ceased and will not be reopened until such time as any environmental questions are settled. Mr. Latham arrived. On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to approve the sketch map of the minor subdivision of property of Whitcom Investment Company subject to the following: 1. The 100 foot setback line from the top of the bluff should be listed as "building setback line". ® Removal of the notation that there will be a 20 foot gravelled roadway. It has been the policy of this Board to enlist the recommendations of the Planning Board inspector. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Planning Board -3- December 17, 1979 Richmond Creek Farms. Mr. Rod Van Tuyl, surveyor, and Mr. Haefeli, attorney for the principals, appeared. The developer would like to have swale drainage and will need a sixty foot width on the right- of-way to proceed. One open space should be labelled park and play- ground. Cutchogue Joint Ventures. Mr. Orlowski and Mr. Raynor made an inspection of this subdivision along with the engineer, Howard Young. It is their feeling that the cluster is the right way to go in developing this property. There is a problem in the southeast corner in the area shown as low meadow. An agreement was reached that no buildable lots will be below the 14 foot contour. Moving the roadway to the east will alleviate the question of any lots backing up on this contour. 0n motion made by Mr. Gordon, seconded by Mr. 0rlowski, it was RESOLVED to approve the request of Kontokosta Associates for Sea Breeze Village to construct a stone blend access road to be surfaced with two coats of liquid asphalt, both with stone chips or l-l/2 inches of plant mix black top, to go up to and immediately in front of the completed units along with the west parking area and the applicable site lighting for said areas. The balance of the required work will be done as the other units are completed and ready for occupancy. This has been agreed to by John W. Davis, Planning Board Inspector. Vote of the Board: Ayes: Raynor, Gordon, 0rlowsk~. Abstain: Latham On motion made by Mr. 0rlowski, seconded by Mr. Latham, it was RESOLVED to set 8:00 p.m., Monday, January 7, 1980 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of Thomas and Karen Uhlinger located at Cutchogue. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham On motion made by Mr. Latham, seconded by Mr. 0rlowski, it was RESOLVED to set 8:30 p.m., Monday, January 7, 1980 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of Joseph Shipule, located at Southold. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Planning Board -4- December 17, 1979 Murphy-Raeburn minor subdivision. The Board is in receipt of a letter dated December 13, 1979 from the Board of Appeals in regard to the right-of-way off Bridge Lane Extension to the property of Murphy-Raeburn. On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to deny the following options presented by the Board of Appeals until such time as there is information from Baxter Properties that they are willing to go along with either of these two options or some other proposal. To allow Raeburn and Murphy to use the Baxter Properties~ right-of-way only as far as the barn and house and then cross back over onto the Raeburn and Murphy right-of-way. This would be for approximately 200 feet from Oregon Road. ® To allow Raeburn and Murphy the use of approximately six feet in width to any length of the Baxter Properties' right-of-way as may be deemed appropriate. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was moved that WHEREAS, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of John C. and Frank J. Diller, was submitted to the Planning Board on October 12, 1979, and an application fee of $20 was paid on October 12, 1979, and WHEREAS, a public hearing was held on the said subdivision application and Plat at the Town Hall in Southold, New York, on November 14, 1979 at 8:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application, Now, therefore, be it RESOLVED, that the application of John C. and Frank J. Diller for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C. and dated October 17, 1979 be approved subject to the following modifications, and that the Chairman of the Planning Board be authorized to endorse approval on said subdivision Plat upon compliance by the applicant with such modifications as noted below. Modification of said Plat to show the following conditions of the Suffolk County Planning Commission: All stormwater runoff resulting from the development and improvement of either lot shall be retained on-site by adequate drainage structures so that the stormwater does not flow out into Middle Road or into the recharge basin. Planning Board -5- December 17, 1979 All existing driveways shall retain and all proposed driveways shall have a turnaround provision, such as a "T"-shaped shunt, so that vehicles leaving the property will not have to back out into the traffic stream on Middle Road. No residential structure shall be located within 100 feet of the top of the bluff nor shall any sanitary disposal facility be located or constructed within this setback area. No grading shall be permitted within 50 feet of the top edge of the bluff except that necessary to control or remedy erosion or divert stormwater from flowing over the top of the bluff. e Clearing and cutting within 50 fe~t of the top of the bluff shall be limited to that necessary for maintenance. No stormwater runoff resulting from the development and improvement of the property shall be discharged down the face of the bluff in any manner. ® Access to the beach shall be by means of a suitable structure designed and constructed in a manner that will result in the least disturbance of the stability of the bluff. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham Mr. Orlowski moved for the adoption of the following. Mr. Latham seconded the motion. P~rsuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review and 6NYCRR Part 617, Section 617.10 and Chapter ~4 of the Code of the Town of Southold, notice is hereby given that Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION The minor subdivision of John C. and Frank J. Diller is a two-lot residential subdivision of 53.6a9 acres located at Peconic, New York. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned; Planning Board -6- December 17, 1979 The New York State Department of Environmental Conservation has stated that since the subdivision of land is further than 300 feet from tidal wetlands this proposal is beyond state jurisdiction. The Suffolk County Department of Health Services has indicated that a precursory review of the pro~ect indicates conditions are suitable for individual sewage systems and water supply facilities. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land Regulations. Further information can be obtained by contacting Ms. Muriel Tolman, Secretary, Southold Town Planning Board, Town Hall, Southold, New York 11971. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declares the subdivision of property of Richmond Creek Farms as an unlisted action with regard to the State Environmental Quality Review Act. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to accept the report of John W. Davis, Planning Board Inspector, for the right-of-way construction within the minor subdivisions of Hale and Hughes, number 102. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham The maps of the subdivision of Bayview Woods Corporation will be distributed to John W. Davis, Planning Board Inspector, and Lawrence M. Tuthill, Engineer, for their comments and recommendations. The site plan of Michelle Becker has been forwarded to the Building Department for certification of the Building Inspector as to compliance with the Code of the Town of Southold. On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was RESOLVED that the Southold Town Planning Board recommend to the Southold Town Board release of the performance bond for the subdivision known as "Eli~ah's Lane Estates" pursuant to Inspection Report #104 of John W. Davis, Planning Board Inspector. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Planning Board -7- Dec'ember 17, 1979 On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board declare itself lead agency with regard to the State Environmental Quality Review Act for the minor subdivision of property of Baxter Properties~ Inc. and declare this matter to be an uulisted action. Vote of the Board: Ayes: Raynor, Gordon, 0rlowski, Latham A request will be made to the Town Attorney, Robert Tasker, for a meeting date after the first of the year to discuss pending matters. The maps of the subdivision of Gatz will be distributed to John W. Davis, Planning Board Inspector, and Lawrence M. Tuthill, Planning Board Engineer, for their comments and recommendations. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham On motion made by Mr. Gordon, seconded by Mr. Latham, it was RESOLVED to accept Inspection Report #103 of John W. Davis, Planning Board Inspector, for the subdivision to be known as "Long Pond Estates" at Southold, and forward same to Mr. Ernest Wilsberg and Roderick Van Tuyl, P.C. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham An answer from Robert Tasker, Town Attorney, is being awaited in regard to the acquisition of property in Laurel by the Mattituck Park District. Motion was made by Mr. Latham, seconded by Mr. Orlowski and carried to approve the minutes of the regular meeting of November 14, 1979 with an amendment on page 9 to change "Murphy" to "Murray". Motion was made by Mr. Gordon, seconded by Mr. Latham and carried t0 approve the minutes of the regular meeting of December 3, 1979 with an amendment on page 9 to read "Van Manen" not "Van Matten". A committee will be formed to meet in February regarding the development of bowling alley lots in the Town of Southold. Plarnaing Board -8- December 17, 1979 Mr. Raynor discussed with Town Attorney Tasker the major subdivision of property of Mr. Van Marten and the building of a road to town specifications at the site. The consensus of the Board was that a road must be built to town specifications at this location and Mr. Van Manen should proceed with one of the following: 1. Build a 50 foot road on his own property adjacent to Camp Mineola Road. 2. Come to an agreement with the property owners who would eventually use the road. 3. Come to an agreement with the property owner on the other side of Camp Mineola Road. On motion made by Mr. Latham, seconded by Mr. Orlowski, it was RESOLVED to accept the following conditions of the Suffolk County Planning Eommission as pertains to the map of the minor subdivision of G~orge L. Penny IV at Southold. All sanitary disposal facilities constructed or installed within the subdivision shall be located at least 100 feet from the edge of Lilly Pond and at least 75 feet from the edge of the marsh areas adjoining the pond. Erosion and sediment control measures shall be required during and immediately after construction on each lot to prevent soil and other deleterious materials from being carried down into the pond and marsh areas. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham Six c6pies of the map will be required showing the 150 foot right-of-way into lot i to show front of property. On motion made by Mr. Orlowski, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board join the New York Planning Federation at the annual dues of $55.00. Vote of the Board: Ayes: Rap-nor, Gordon, Latham, Orlowski On motion made by Mr. Gordon, seconded by Mr. Orlowski, it was RESOLVED that whereas, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of E. M. Kontokosta, was submitted to the Planning Board on October ll, 1979, and an application fee of $30 was paid on October ll, 1979, and Planning Board -9- December 17, 1979 WHEREAS, a public hearing was held on the said subdivision application aud Plat at the Town Hall in Southold, New York, on November 14, 1979 at 8:00 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision Plat and application, Now, therefore, be it RESOLVED, that the application of E. M. Kontokosta for approval of said subdivision plat prepared by Roderick Van Tuyl, P.C. and dated September 25, 1979 be approved subject to the following modifications, and that the Chairman of the Planning Board be authorized to endorse approval on said subdivision Plat upon compliance by the applicant with such modifications as noted below. Modification of said Plat to show the following conditions of the Suffolk County Planning Commission: 1. No residential structure shall be located within 100 feet of the mean high water line. No sanitary disposal facility shall be constructed or installed within 100 feet of the mean high water line. A conservation buffer or easement having a minimum width of at least 50 feet shall be established along the shoreline. ® No stormwater runoff resulting from the development and improvement of the subdivision and any of the lots shall be discharged directly into Gardiner's Bay. No lot shall be subdivided in the future without the approval of the Planning Board. Vote of the Board: Ayes: Raynor, Gordon, Orlowski, Latham The Board was confused as to exactly what the Commission meant by the third condition$ a letter will be written to them asking for clarification. There being no further business to come before the Board, Mr. Orlowski made a motion, seconded by Mr. Latham and carried to adjourn the meeting.
