SEQRA DETERMINATION: The Zoning Board of Appeals has visited the
property under consideration in this application and determines that this
review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE This application was
referred as required under the Suffolk County Administrative Code Sections
A 14-14 to 23, and the Suffolk County Department of Planning issued a reply
dated May 28, 2008 stating that this application is considered a matter for
local determination as there appears to be no significant countywide or inter-
community impact.
LWRP EXEMPT This application is exempt under Town Code LWRP
Chapter 268, since no natural resource feature was found within 100 feet of
the sheds requested under this zoning variance.
PROPERTY FACTS/DESCRIPTION= The applicant resides on a lot
containing 47,086 sq. ft., which is improved with a historic house, barn and
assorted sheds and a new right-of-way being established on the western side
of the property. The applicant wishes to redivide the lots so that the
historical barn building will be will be on its own lot. The purpose is to
renovate the barn, which dates back to the early 1900s, to a single-family
house for his family and children. He also wishes to build a pool and pool
house near the primary residence.
BASIS OF APPLICATION Request for Variances under Sections 280-12,
280.14, 280-15, based on the Building Inspector's April 23, 2008 amended

Notice of Disapproval concerning
(1) a proposed lot line change between Lots 11 and 9.1 will result in a
reduced lot size for Lot 9.1 from 49,231 square feet to 31,802 square feet,
after deducting the square footage for the right-of-way easement, instead of
the code required 40,000 square feet ;
(2) additions and alterations are proposed for the existing barn (Lot #2)
for the proposed conversion from an accessory building to a single-family
dwelling, which will result in a proposed front yard setback at less than 50
feet (from the new division line in this lot line change), and a single setback
of less than 15 feet from the existing easterly side lot line;
(3) the proposed in-ground swimming pool, deck and accessory pool
(storage) building (Lot #1) is proposed in a front yard, rather than the code-
required rear yard;
(4) the new accessory pool house building is not permitted as proposed
because it is deemed to be the same as a second dwelling unit.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on
May 29, 2008 at which time written and oral evidence were presented. Based
upon all testimony, documentation, personal inspection of the property, and
other evidence, the Zoning Board finds the following facts to be true and
relevant
AREA VARIANCE RELIEF REOUESTED~ The applicant proposes to move
the lot line for the house lot #1 to the south of the barn, creating a larger size
for lot #2 and lot #1 will have a nonconforming square footage of 33,845
square feet, containing the existing nonconforming dwelling at 28 feet from
the front lot line. The barn that will be on new Lot #2 will be converted to a
single-family dwelling, and the lot will be conforming with 101,507 square
feet, except that the setback will be 35 feet from the new lot line (southerly
lot line) and the side yard setback of 12 at the northeast corner and 17 feet at
the southeast corner of the barn will remain nonconforming. The applicant
also wishes to build a pool with an adjoining pool house. The accessory pool
(storage) building was originally deemed a second dwelling by the Building
Inspector because of the proposed indoor shower facility. The applicant has
modified the diagrams and confirmed he will proposed an outdoor shower and
will also bring sheds to code, or remove them from the property. The pool

and pool (storage) building are proposed in the new front yard instead of the
rear yard because applicant's has a 3,109 square foot right-of-way over a
portion of the western portion of his property, which right-of-way provides
access for Lot #2 to the north from the Main Road.
REASONS FOR BOARD ACTION On the basis of testimony presented,
materials submitted and personal inspections, the Board makes the following
findings
1. Town Law §267-b(3)(b)(3)(1). Grant of the variances will not produce an
undesirable change in the character of the neighborhood or a detriment to
nearby properties. The applicant has two lots, the southerly lot existing with
31,802 (excluding the right-of-way), and a very large lot containing 101,507
square feet, surrounded on the East and North side by preserved lands. The
property is heavily landscaped and not visible to the road. The properties
contain two very historic structures, both the house and the barn, and the
owner wishes to preserve both. The house will be re-shingled for a more
historic look. The old two-story barn will be made into a single family home
for his children. He intends to restore the barn, which needs repair, keeping
the original lines in keeping with the original architecture. A southerly
setback of 35 feet and the northerly setback protects the open space behind
that barn. The pool had to be placed in the front yard as a result of the right-
of-way location, constituting a front yard. The indoor shower will be
removed, and the use of the pool storage building will be accessory to meet
code. There will be much landscaping surrounding the pool and pool storage
building for privacy.
2. Town Law 6267-b(3)(b)(3)(2). The benefit sought by the applicant cannot
be achieved by some method, feasible for the applicant to pursue other than
an area variance.
3. Town Law 5267-b(3)(b)(3)(3). The variances granted herein are
substantial relief from the required 40,000 square feet for Lot #1; relief from
front and side yard requirements for Lot #2; relief from the pool and pool
house not placed in the required rear yard and the removal of the sheds.
4. Town Law §267-b(3)(b)(3)(5). The relief has been self-created inasmuch
as the applicant desires to make substantial changes to the property.
5. Town Law §267•b(3)(b)(3)(4). No evidence has been submitted to suggest
that a variance in this residential community will have an adverse impact on
the physical or environmental conditions in the neighborhood.

6. Grant of the requested relief is the minimum action necessary and
adequate to enable the applicant to enjoy the benefits of restoration and
remodeling of the barn and the pleasure of having a pool and pool (storage)
building, while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying
the balancing test under New York Town Law 267-B, motion was offered by Member
Oliva, seconded by Chairman Goehringer, and duly carried, to
Grant as applied for as shown on the survey site plan dated 10-20-
2005, revised 04-17-2008 by John Ehlers, and Page 2 of the pool building and
Page 2 of the Barn Renovation/Conservation Plan, prepared by Nancy Dwyer,
subject to the following conditions
1. The accessory pool (storage) building shower shall be moved to the
outside of the building, rather than an indoor shower,
2. The accessory pool (storage) building must be heavily screened and
the landscape screening shall be continually maintained,
3. No air-conditioning or heating, no sleeping quarters shall be
permitted in the accessory pool (storage) building.
The above conditions shall be written into the Building Inspector's Certificate of
Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are
not shown on the applicant's diagrams or survey site maps, are not authorized under
this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or other feature of
the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in
nature for an alteration that does not increase the degree of nonconformity.

The proposed lot line chance and barn conversion involving two parcels in the R-40 District, is not
permitted pursuant to Article IV, Section 280-14, which states
"No bui]dinE or premises shall be used and no buildine or part thereof shall be erected or altered in
the A-C, R-80, R-120, R-200 and R-400 Districts unless the same conforms to the Bulk Schedule
and Parking Schedule incoroorated into this chapter with the same force and effect as if such
regulations were set forth herein full. "
Bulk Schedule requires a minimum lot size of 40,000 square feet, a minimum front vard setback of 50
feet, and a minimum sin le side vard setback of 15 feet Following the proposed lot line change Lot
#1 will be non-conforming at 33 845 square feet. Lot #2 will remain conforming the new dwelling
(converted barn) will have a front yard setback of 35 feet (Lot #2) and a sinele side vard setback of 12
feet (Lot #2).
The proposed in-ground swimming deck and accessorypool house (Lot #1) is not permitted pursuant
to Article IIh Section 280-15, which states that accessory buildings and structures shall be located in
the required rear yard.
The structures are ro osed to be located in the front ard.
In addition, the proposed accessorv pool house is not permitted pursuant to Article III, Section
280-12, which states,

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or

c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit

e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months afrer the date of

property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an

IN ORDER TO CONFORM WITH THE TOWN CODE IT BECAME LOGICAL TO MOVE THE LOT LINE
TO AVOID DISTURBING THE HISTORICAL NATURE OF THE BARN AND FARM HOUSE SETTING.
IT WAS A TREMENDOUS CHALLENGE IN FINDING THE RIGHT BALANCE DUE TO THE VARIOUS CODES AND
SET BACK REQUIREMENTS. AFTER COUNTLESS HOURS AND SESSIONS WITH JOHN EHLERS WE BELIEVE
THAT WE HAVE REACHED THE BEST POSSIBLE SOLUTION TO THIS VERY COMPLEX SITUATION.
AFTER YOU HAVE STUDIED THIS PROPOSAL I HOPE YOU WILL COME TO THE SAME CONCLUSION.
1. THE BARN HAS BEEN IN THIS LOCATION FOR 83 YEARS AND WE ARE NOT CHANGING THE
OVERALL CHARACTER OF THE BARN OR EXTENDING THE HEIGHT ELEVATION.
2. FOR HISTORICAL REASONS WE WANT TO LEAVE THE BARN IN IT'S ORIGINAL LOCATION,
DUE TO ITS LARGE STRUCTURE AND FINANCIAL COST, RELOCATION WAS NOT AN OPTION.
3. THE OFFENDING FAR NORTH EAST CNR OF THE BARN IS 12'-THE NEAR NORTH EAST CNR
COMPLIES-17' (SEE SURVEY)
THE FRONT SET BACK AT IT'S MOST EXTREME IS 35' TRAILING AWAY TO 43' AT THE NEAR
NORTH WEST PROPOSED CNR PORTION (SEE SURVEY) THE PROPOSED LOT LINE WAS CHOSEN
TO ALLOW MAXIMIM SQ FOOTAGE TO LOT 1 WITHOUT FURTHER AGGRAVATING FRONT SET
BACKS FOR LOT 2.

On May 13`h,2008 I had my letter returned to me that was addressed to Todd Buchanan Memorial Trust
c/- of Frank Zimmer Route 25 PO 355 Orient, New York 11957 (see attached) The letter had been
forwarded by the Orient Post Office however it was returned as there was no current forwarding
address.
On that same day I telephoned the widow of the late Frank Zimmer and was able to obtain their current
address.
On May 14`", 2008 I had the letter remailed by certified mail to: Todd Buchanan Memorial Trust c/-
FrankZimmer c/-Virginia Alice Zimmer 46 West Lane Bay shore, New York 11706

The proposed lot line change and barn conversion, involving two pazcels in the R-40 District, is not
permitted pursuant to Article IV, Section 280-14, which states,
"No building or premises shall be used and no building or part thereof shall be erected or altered in
the A-C, R-80, R-120, R-200 and R-400 Districts unless the same conforms to the Bulk Schedule
and Parking Schedule incorporated into this chapter with the same force and effect as if such
regulations were set forth herein full. "
Bulk Schedule requires a minimum lot size of 40.000 sauaze feet, a minimum front vazd setback of 50
feet and a minimum single side vazd setback of 15 feet. Following the proposed lot line change, Lot
#1 will be non-conforming at 33,845 squaze feet. Lot #2 will remain conforming, the new dwelling
(converted barn) will have a front vazd setback of 35 feet (Lot #21 and a single side vazd setback of 12
feet (Lot #2).
The proposed in-ground swimming, deck and accessorypool house (Lot #1) is not permitted pursuant
to Article III, Section 280-15, which states that accessory buildings and structures shall be located in
the required reaz vazd.
The structures aze proposed to be located in the front vazd.
In addition, the proposed accessory cool house is not aermitted pursuant to Article III, Section
280-12, which states,
"In A-C, R-80, R-120, R-200 and R-400 Districts, no building or premises shall be used and
no buildin¢ or part of a buildin¢ shall be erected or altered which is arranged, intended or
designed to be used, in whole or in part, for any uses except the following:"

to make other attempts to obtain a mailing address or to deliver the letter to the current owner,
to the best of your ability and to confirm how arrangements were made in either a written
statement or during the hearing providing the returned letter to us as soon as possible;
