FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 18, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2 -November 1, 2007 ZB File No. 6080 -Joseph Finora any iNary Grace CTM 126-8-18 AREA VARIANCE RELIEF REQUESTED: The new construction requested by applicant concerns proposed additions and alterations to an existing single-family dwelling, with a request for a variance of eight feet in the rear yard. For the record, applicant's present deck (to be removed) extends beyond the proposed sun room. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 6267-b(3)(b)(3)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed addition/alteration to the rear of the dwelling will not impact the footprint of the home. The lot is only 93+ feet deep on one side, and 110+ feet on the other side of the parcel. The home as a whole is a two-story home with modest setbacks. The raised deck to be constructed for the glass addition is smaller than the existing deck. The proposed construction will be less nonconforming than the existing structure concerning the rear yard setback. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance. The applicant's lot size is approximately 25% of the 40,000 sq. ft. applied in the R-40 Zone, with a significantly reduced depth on both sides of the property lines. Therefore, there is no alternative for applicant. 3. Town Law 6267-b(3)(b)(3). The variance requested herein is not substantial and is the maximum the Board would allow. The Zoning Code requires a 35' rear yard setback; applicant is requesting an addition to the rear of the dwelling with a reduction of the setback to 27 feet, which is a 23% variance. 4. Town Law 6267-b(3)(b)(5). The difficulty has not been self-created and is related to the nonconforming size of the lot and existing location of the dwelling. 5. Town Law 6267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. In effect, the current application will reduce the amount of non-conforming setback. At the hearing, the applicants testified that they currently have a 6 ft. stockade fence along the rear property line and as a buffer between the neighbor to the west, will maintain a new row of evergreens that add to the buffer of screening. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an addition to the dwelling, while Page 3 -November 1, 2007 ZB File No. 6080 -Joseph Finora anc Mary Grace CTM 126-8-18 preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on the July 2, 2007survey prepared by Barrett Bonacci and Van Weele, P.C. and elevation drawing (page 1) prepared by R. Duane Monical dated 5/29/07. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
