RAYNOR, Jr. FREDERICK E.C, ORDON JAMES WALL Southold, N.Y. 11971 TELEPHONE 765- 1938 A regular meeting of the Southold Town Planning Board was held at 2:00 p.m., Monday, May 21, 1979 at the Town Hall, Main Road, Southold, New York. Present were: Chairman Henry E. Raynor, Jr. Member Frank Coyle Member Frederick E. Gordon Frank Bear, North Fork Environmental Council Douglas Love, L. I. Traveler-Watchman Dick Curtis, Suffolk Times Anna Hataier, Town Trustee Absent was James Wall because of inclement weather. Witherspoon minor subdivision. Lewis Edson appeared. The maps of the minor subdivision were reviewed. It was noted that the following items should be placed on the map. 1. Five foot contours 2. Lot numbers 3. North-south roadway should say right-of-way on the westerly side of the property East End Insurance. Edward Boyd V, Esq., appeared. Mr. Raynor went over the letter from George Fisher, Building Inspector and Planning Board letter to Mr. Boyd with his answer. This should" not have been regarded as a site plan but approval of the Planning Board concerning adequate parking. This action has not been received from the Board of Appeals as yet. On motion made by Mr. Gordon, seconded by Mr~ Coyle,~it was RESOLVED to approve the amount of parking to, be supplied . in accordance with Section 100-112 of the Code of the Town of Southold for the plot plan of East End Insurance. " Vote of the Board: Ayes: Raynor, Coyle, Gordon Planning Board -2- May 21, 1979 Bertram Holder minor subdivision. Reg Hudson appeared. Island View Lane is a private road which Mr. Holder has a right to use. Mr. Hudson was requested to write the Board and tell them what his client wants to do regarding the road. There is a question as to whether the road should be built to specifications of the town for roads or covenanted that it will be built to specifications when the other portion of property comes in as a major subdivision. The maps will need items listed on sheet for procedures in presenting a sketch map of a minor subdivision. Macari subdivision. Howard Young appeared. There was discussion regarding the reserved area by the entrance. One of the suggestions was that it be made part of the roadway along with a portion of Lot i on the other side of the entrance. There are two drainage areas shown. Mr. Young explained that these drainage areas have growth on them and he finds natural areas recharge water better than the basic recharge basin that gets silted over. He computed the volume of water based on the elevation of the ground water and figured out the contour line the 6 inch waterfall would go to and left that as a drainage area. The water elevation was 6.9 to l0 feet. It could fill with water to nine feet before it hit neighbor's private property. There is no fence shown in the design. Mr. Raynor said if this is done it would have to be done in conjunction with the approvals of the Highway Committee, Highway Superintendent and the Highway Inspector. Mr. Young is to send his explanation to these people for their decision. Mr. Raynor thought Lot #41 might have water on it and Mr. Young asked if there would be any problem with filling. Mr. Raynor said it would probably be classified as buildable but he would like the Board to make a physical inspection of the property at this particular area. Macari owns the fee to all the rights-of-way shown on the m~. Lot 16 turned out to be not a good area for drainage but a good building site. There is going to be a problem in constructing roads so as not to disturb the rights- of-way. They will require a waiver from the requirements for lot 16 as it is a flaglot. There was a question about whether there was enough park and playground area and it was determined that there was. A right-of-way runs through one of the park and playground areas. There was some discussion about the park and playground area by Laurel Lake~ The developer wants to give the lot owners access to the beach. There was some question about 49 lot owners going to 140 feet of beach. This matter will be open for discussion. The rotary at lots 12, 13 and 14 will also require a waiver. The exit and entrance will be reviewed again at a field inspection. Mr. Olsen, attorney for Mr. Macari, will be contacted to see if the developer would be interested in having a cluster subdivision. On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED that the concept of swale construction of the roads and drainage in the subdivision to be known as "Sebastian's Cove, Section I be denied; the clearing of the intersection with Mill Road be done to the west preserving large trees and the slope be cut back to the east forth feet; the spur to the east from the cul de sac be construoted to the property line of Krupski; access Planning Board -3- May 21, 1979 to lots l0 and ll be restricted to Sebastian's Road. Vote of the Board: Ayes: Raynor, Coyle, Gordon A letter from Rudolph Bruer regarding the release of Lot 2 in the subdivision to be known as "Sebastian's Cove~ Section l" was reviewed. There are many problems with this and Mr. Raynor will write a letter to Mr. Bruer explaining them. Fairway Farms. The filling in of the swales in this subdivision in violation of the covenants and restrictions on the property was discussed. A letter from Mr. Babcock, President of the Corporation, was read and placed on file. A study will have to be made as to the construction of the swales as several residents claim they never had swales in the first place. Mr. Tasker, Town Attorney, will also be consulted on this matter. Country Club Estates. Mr. Babcock has written a letter regarding the firewell in this subdivision. A copy of the section of the Code will be forwarded to Mr. Babcock. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to approve the preliminary map of the subdivision to be known as Richmond Shores at Peconic, said map amended May ll, 1979. The requiremen~of sidewalks, street lights, corner monuments and covenants and restrictions on the property being filed are waived on this map. Vote of the Board: Ayes: Raynor, Coyle, Gordon A request is to be made of Lawrence Tuthill, Town Engineer, that he present a bond estimate for roads and improvements in the subdivision to be known as Richmond Shores at Peconic. The Board would like this estimate before May 30th. On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to set 8:00 p.m., Tuesday, June 12, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the final map~o£ t~e zubdivision to'be ~known aS-!'~ichmond Shores at Peconic". Vote of the Board: Ayes: Raynor, Coyle, Gordon Planning Board -4- May 21, 1979 On motion made by Nr. Raynor, seconded by Mr. Gordon, it was RESOLVED to set 7:30 p.m., Tuesday, June 12, 1979 at the Town Hall, Main Road, Southold, New York, as the time and place for a public hearing on the question of the approval of the minor subdivision of property of the Frank H. Case Estate. Vote of the Board: Ayes: Raynor, Coyle, Gordon On motion made by Mr. Coyle, seconded by Mr. Gordon, it was RESOLVED that the Southold Town Planning Board declare itself lead agency in regard to the State Environmental Quality Review Act in the matter of the subdivision of property of the Frank H. Case Estate. Vote of the Board: Ayes: Raynor, Coyle, Gordon On motion made by Mr. Gordon, seconded by Mr. Coyle, it was RESOLVED to refer to the Town Board for its determination on whether it can be developed in the cluster concept the proposed subdivision ~f property to be known as "Richmond Creek Farms". Vote of the Board: Ayes: Raynor, Coyle, Gordon There being no further business to come before the Board, Mr. Coyle made a motion, seconded by Mr. Gordon and carried to adjourn the meeting.
