WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs Of successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being in the
Town of Southold, County of Suffolk and State of New York, known and designated as
lot 94 on map of property of Mattituck Park Properties, Inc. filed in the office of the Clerk of the County of
Suffolk on 1/12/96 as map number 801, said lot being more particularly bounded and described as
follows:
BEGINNING at a point on the easterly side of Sigsbee Road, distant 513.50 feet (as per old filed map)
556.77 (actual) southerly from the corner formed by the intersection of the southerly side of Main Road
and the easterly side of Sigsbee Road;
THENCE North 69 degrees 22 minutes East 140.00 feet;
THENCE South 20 degrees 38 minutes East 50 feet;
THENCE South 69 degrees 22 minutes West 140.00 feet to the easterly side of Sigsbee Road;
THENCE along the easterly side of Sigsbee Road, North 20 degrees 38 minutes West 50.00 feet to the
point or place of BEGiNNING.
TOGETHER with the right to use in common with the owners of lots shown on said map the tract shown
on said map as Sigsbee Park for park purposes under such conditions, limitations and restrictions as said
Mattituck Park Properties, Inc. may impose. Such use to be as in the unrestricted judgment of Mattituck
Park Properties, Inc. will not unreasonably interfere with the use and enjoyment of said Sigsbee Park by
other owners of lots on said map.
TOGETHER with the right of way over Sigsbee Road as shown on said map and over a right of way three
rods wide running from Peconlc Bay Boulevard over premises shown on said map to Peconic Bay.
BEING AND INTENDED TO BE the same premises as conveyed to the grantors by deed recorded in
Liber 11901 page 354.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and LO any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party or the first part in and to said premises; TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.

the said'premises have been enc~'n,bered in any way whatever, except as aforesaid.

AND the P,irty of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consider-
ation as a trust fund to be applied first for the purpose of paying the cost of the improvement und will apply
the same first to the payment of the cost of' the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
