HomeMy WebLinkAboutBAKER & VAN BUREN THIs INDENTURE made in duplicate the %kT day of November, 1963, between the TOWN OF SOUTH0~D, in the County of Suffolk and State of New York, by a majority of its duly elected T~ustees, and in pursuance of Chapter 61~ of the Laws of New York passed in 1893 and in pursuance of a written resolution adopted by a maJoritl of the Board of Trustees of said Town of Southold at a meeting held pursuant to notice duly given to all members thereof on the ~ day of~]~ ~'. , 1963, party of the first part, and VINA BA~K~ and GEORGE M. VAN BUREN, both residing at 455 Franklin D. Roosevelt Drive, New York, New York, parties of the second part WITNES SETH That the party of the first part in consideration of the sum of One and 00/100 .............................. ($1.00) Dollar to said Town duly paid before the delivery hereof doth hereby grant, bargain, sell and release unto the said parties of the second part their heirs and assigns forever, ALL that piece or parcel of land situate at Mattituck, Town of Southold, Suffolk County, New York, BOUNDED Northerly, easterly and southerly of the following described boundary: BEGINNING at a point where the westerly line of Wickham Avenue is intersected by Ordinary high water mark of Mattituck Creek, said point being S. 28° 48~ 40" E. 130 feet, more or less, southerly from a concrete monument marking the northerly extremity of said westerly line of Wickham Avenue which runs S. 28° 48~ 40" E.; running thence westerly and southwesterly along high water mark of Mattituck Greek to a point, the tie line, from said point to a point on the westerly line of Wickham Avenue 90 feet S. 28~ 48~ 40" E. from said monument above mentioned, being S. 69" 28~ 10" W. 479.16 feet; thence along said ordinary high water mark of Mattituck Creek southwesterly and northwesterly to a point, the tie line being S. 63" 23~ 00" W. 300.79 feet; thence northwesterly along ordinary high water mark of Mattituck Creek to a point, the tie line being N. 15° 19! 40" W. 393.76 feet; thence northeasterly along ordinary high water mark of Mattituck Creek to a point, the tie line being N. 35° 38~ 00" E. 435.95 feet; thence northeasterly along ordinary high water mark of Mattituck Creek to t~e northwesterl~ corner of land of Galgano, the tie lzne being S. 30~ 46~ 20" E. 201.35 feet. TO HAVE AND TO HOLD the above mentioned and described premise with the appurtenances unto the said parties of the second part, their heirs and assigns forever. IN WITNESS WHEREOF, the said Town of Southold, party of the first part, has by a vote of a majority of the Board of Trustees of said Town, caused its corporate seal to be hereunto affixed, and these presents to be subscribed by a majority of the said Board of Trustees, the day and year above written. In your letter of May 26th you suggested getting in touch with the County to obtain an easement map for this section. We have talked to Jack Sherwood of Van Tuyl~s office which has a copy of the map and have been advised that it is of no practical use in this matter. We have, therefore, drafted the proposed deed to include all land within the present boundaries and trust that this will meet your approval. In the dredging of the Creek, considerable sand was pumped onto their meadow. Enclosed is a survey of their property which shows the present ordinary high water mark of Mattituck Creek. ~nfortanately, there is no survey~to show the exact high water mark prio~ to the dred~ng or the base of the upland prior to dredlng. We would, therefore, appreciate your advice as to how we might frame a description for a quit claim deed from the Trustees if you approve this application. If there are any other requirements, we should also like to have that information. WW:msh Encl. Very cordially yours, Hay 28~ 1963. #llliam Dear Mr. Wickham; Your request for Mrs. Vina Baker and Mr. George VanBuren for information Is to how to acquire a quitclaim deed to the filled land used as spoil area during the dredging of ~ttituck Inlet was discussed at the Town Trustee meeting on ~y 27, 1963. The Board agree~ that the parties were entitled to such a deed and because of the nature of the shoreline it was believed that the new high water m~rk would be the outer boundary. The old high water n~rk should be obtain~]~le from County meps made prior to the dredging. Xf you will prepare the necessary quitclaim deed in duplicate, the Board will give ltos approval.
